CC RES 1981-039 RESOLUTION NO. 81-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 41 WHEREAS, the Episcopal Home has requested an amendment to Conditional Use Permit no. 41 to allow for the addition of a twenty-eight (28) bed skilled nursing facility within the Community Building of an approved retirement facil- ity; and WHEREAS, the approved retirement facility is located at 5801 Crestridge Road which is in an Institutional (I) zone; and WHEREAS, the Planning Commission approved the proposed amendment at a public hearing held on December 9, 1980; and WHEREAS, after being appealed by Mr. and Mrs. John K. Arand, the matter was considered at a public meeting of the City Council on May 19, 981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed revisions include redesign of the Commu- nity Building to allow for a twenty-eight (28) bed (fifteen (15) room) skilled nursing facility and appurtenant improvements on the upper level (second floor) . Section 2: That the proposed use is permitted in any zone, subject to a Conditional Use Permit. Section 3: That the property is adequate in size and shape to accommo- date the proposed skilled nursing facility. Section 4: That the site is served by Crestridge Road, an improved public street, which is designed to carry the type and quantity of traffic generated by the facility. Section 5: That the proposed improvements will not result in any sig- nificant effects on the subject property or adjacent properties or to the permitted uses thereof. Section 6: That the City Council does hereby declare that a Final Negative Declaration and Initial Study have been completed and that the Council has reviewed and considered the contents of the report in reaching its decision. The City Council further finds that the approval of the proposed amendment will not have a significant adverse environmental impact. Section 7: That the proposed improvements do not conflict with the goals and policies of the General Plan which designate the site as appropriate for institutional uses. Section 8: For the foregoing reasons the City Council of the City of Rancho Palos Verdes hereby denies the appeal by Mr. and Mrs. John K. Arand and grants approval of an amendment to Conditional Use Permit No. 41, subject to the conditions found in Exhibit "A", which are necessary to protect and preserve the health, safety and general welfare in the area. GULUZZY, CITY CLERK & EX OFFICIO CLERK OF THE COUNCIL At 26, O. ffk,/ /i6/- CI `ARK %' "/ Page two Resolution No. 81- 39 EXHIBIT "A" THIS AMENDMENT TO CONDITIONAL USE PERMIT NO. 41 IS HEREBY APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. This amendment shall expire within one (1) year from this date unless the project has been initiated. 2. All final plans for the redesign of the Community Building shall be approved by the Director of Planning prior to issuance of con- struction permits. 3. Within thirty (30) days of this date, the applicant shall submit a written statement certifying that all of the conditions con- tained herein are understood and agreed upon. 4. The maximum ridgeline height shall not exceed that which is shown on the plans approved by the Planning Commission on December 9, 1980. 5. The nursing area shall be operated as a skilled nursing facility and licensed by the Los Angeles County Health Service Department for a maximum of twenty-eight (28) beds. Proof of said licensing shall be provided to the Director of Planning. 6. If the nursing facility is not able to receive the appropriate license or if it is at any time revoked, use of the nursing por- tion of the Community Building shall cease and desist and any other use shall be approved by the City of Rancho Palos Verdes. 7. Including the twenty-eight (28) skilled nursing beds, no more than two hundred ten (210) total licensed resident beds shall be permitted. A maximum of two (2) guest beds shall be permitted in Building "C" and shall be used on a temporary basis only. Resolution No. 81-39
