CC RES 1981-024 RESOLUTION NO. 81-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING SPECIAL ANIMAL PERMIT NO. 13 WHEREAS, Richard Buchholz has requested a Special Animal Permit to maintain up to four (4) horses at 27067 Silvermoon Lane (Lot 11, Tract No. 28421) , which is zoned for single family residential (RS-4) and Open Space Hazard (OH); and II/ WHEREAS, proposed improvements include construction of a corral, stable, landscaping and other improvements required by this permit; and WHEREAS, after being appealed by Richard Berg, a public meeting was held on April 7, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the approval of a Special Animal Permit is consis- tent with the City's Development Code and General Plan. Section 2: That the requested animals, at the location proposed, will not jeopardize, endanger, or otherwise be detrimental to the public health, safety, or general welfare since physical improvements and main- tenance conditions are imposed and since said permit can be revoked at any time if the Director of Planning finds that any conditions of approval have not been fully met or complied with. Section 3: That the proposed site is adequate in size and shape to accommodate the animals without material detriment to the use, enjoyment, or valuation of property of other persons located in the vicinity of the site, and the keeping of animals is an appropriate use of the site since the site is 2.27 acres in size, the corral and stable improvements will be no closer than 100 feet from the nearest adjacent residence, and since equestrian trails and/or easements are readily accessible. Section 4: That there are no requested variances from the terms or requirements of the Code that would be materially detrimental to the use, enjoyment or valuation of property of other persons located in the vicinity and will not jeopardize, endanger or otherwise be detrimental to the public health, safety, or general welfare. Section 5: That the City Council does hereby declare that a Final Negative Declaration and Initial Study have been completed in compliance with City and State guidelines and that the Council has reviewed and con- sidered the contents of the report in reaching its decision. The City Council further finds that the approval of Special Animal Permit No. 13 will not have a significant adverse environmental impact because mitigation measures are required. Section 6: For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby denies the appeal by Richard Berg, et al, and grants approval of Special Animal Permit No. 13 subject to the attached con- ditions marked Exhibit "A", which are necessary to protect the public health, safety and general welfare in the area. C- ; RK A t Page two Resolution No. 81-24 EXHIBIT "A" SPECIAL ANIMAL PERMIT NO. 13 IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. A maximum of four (4) horses will be allowed. 2. Except as specifically provided herein, all permitted animals kept or maintained shall be for the personal use of members of the family of the owner or lessee of the property. a. Property owners may permit other persons to keep or maintain horses on such owner's property, provided that such owner does not directly or indirectly receive payment other than expenses for such use. b. Incidental sales of animals, not constituting a commercial activity or the conduct of a business is permitted. c. Animals may be raised for sale by members of 4-H Clubs, Future Farmers of America, or similar organizations as part of a regular youth project. 3. Submit plans and gain approval from the Director of Planning for the stable/corral improvements (including landscaping, irrigation and erosion control). Also submit plan and gain approval for schedule of regular main- tenance and upkeep of all stable/corral improvements. 4. The horses shall gain access to the stable/corral area via the bridle trail through the canyon only. Access shall not be taken via Silver Moon Lane, unless required by emergency. 5. Applicant shall take necessary measures (e.g. watering down) to con- trol airborne dust in and around the stable/corral area. Furthermore, during rain and wet weather conditions the applicant shall cause to have excessive manure in and around the stable/corral area removed. 6. The applicant is required to fully landscape and maintain the stable/ corral area with a variety of vegetation including native shrubs. Also install a permanent irrigation system for said landscaping. The goal of the landscape plan shall be to minimize visual impact of the stable/corral area. 7. Prior to construction of the required corral/stable facility, the applicant shall submit plan for positive fly and waste control pro- gram for approval by Director of Planning. Violation of said program at any time will constitute grounds for revocation. 8. All required emergency signing per Development Code shall be placed on corral. 9. All plans submitted by the applicant including those approved by the Director of Planning shall be kept in the file and become a permanent record of the City. 10. Approval will be for a probationary period of six (6) months,following completion and implementation after which the Director of Planning will review the applicant's compliance with these conditions and, grant final approval. 11. This Special Animal Permit shall be revoked at any time when the Director of Planning finds that any conditions of approval have not been fully met or complied with. Resolution 81-24 -1- 4/7/81 12. a. Daily removal of waste materials. b. Storage of said waste materials in a tightly covered approved contrainer. c. Removal of stored waste materials at least once a week, via an approved disposal method. d. Implementation of a dust control program such as watering, oiling, or equal to prevent excessive airborne dust. Resolution No. 81-24 -2- 4/7/81
