A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES RECITING THE FACTS OF
THE MIRALESTE RECREATION AND PARK DISTRICT
SPECIAL ELECTION HELD IN SAID CITY ON THE
4TH DAY OF NOVEMBER, 1980, DECLARING THE
RESULTS THEREOF AND SUCH OTHER MATTERS AS
ARE PROVIDED BY LAW
WHEREAS, a Special Miraleste Recreation &Park District election was held
and conducted in the Miraleste Recreation & Park District, County of Los Angeles,
State of California, on Tuesday, the 4th day of November, 1980, as required by
law; and
11/ WHEREAS, notice of said election was duly and regularly given in time,
form and manner as provided by law; that voting precincts were properly established;
held and conducted and the votes cast thereat, received and canvassed and the re-
turns made and declared in time, form and manner as required by the provisions
of the Elections Code of the State of California for the holding of elections
in cities; and
WHEREAS, pursuant to the State Elections Code, the Registrar-Recorder
of the County of Los Angeles canvassed the returns of said election and has
certified the results to this City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That there were two voting precincts established for the
purpose of holding said election in the Miraleste Recreation and Park District
as established for the holding of state and county elections.
SECTION 2. That said election was held for the purpose of determining
if each property owner shall pay an equal share of expenses associated with the
maintenance and beautification of the Miraleste Recreation and Park District in
the amount of $50.00 per fiscal year. Said election was held in accordance with
the laws of the State of California.
SECTION 3. That the whole number of votes cast in said Miraleste
Recreation and Park District Special Election (except absent voter ballots)
was 565.
That the whole number of absent voter ballots cast in said Miraleste
Recreation and Park District Special Election was 53 making a total of 618
votes cast in said Miraleste Recreation and Park District Special Election.
SECTION 4. The City Council does declare and determine that 61%
of those voting in the Miraleste Recreation and Park District Special Election
voted in favor of the assessment while 39% voted against said assessment. There-
fore, since passage of said assessment required at least a 66-2/3% affirmative
vote, passage of said assessment is deemed to have failed.
SECTION 5. That the City Clerk shall certify to the passage and adoption
of this resolution; shall enter the same in the book of original resolutions of said
City; and shall make a minute of the passage and adoption thereof in the records of
the proceedings of the City Council of said City, in the minutes of the meeting at
which the same is passed and adopted.
PASSED, APPROVED AND ADOPTED THIS 6th day of January, 1981.
