CC RES 1982-050 RESOLUTION NO. 82-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING IMPROVEMENT MADE FOR UTILITY CONVERSION IN DALADIER DRIVE AND OTHER RIGHTS OF WAY (RANCHO PALOS VERDES IMPROVEMENT DISTRICT NO. 4) THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE AS FOLLOWS: II/ WHEREAS, the Resolution of Intention (82-36) in the matter of Rancho Palos Verdes Improvement District No. 4, for the conversion of existing overhead electric and communication facilities to underground in Daladier Drive and other rights of way in the City of Rancho Palos Verdes, was adopted by the City Council of the City of Rancho Palos Verdes on June 1, 1982, and WHEREAS, due notice of said hearing has been published and posted as required by law, and notice of said proposed improvement has been mailed to the property owners; and WHEREAS, all protests in the matter have been duly considered. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RESOLVES: 1. That all protests against the proposed improvement be and they are hereby overruled and denied, upon the finding which is hereby made, that they are made by owners of less than 50% of the area of the proposed district. 2. That the work described in the Resolution of Intention for Rancho Palos Verdes Improvement District No. 4, adopted on the 1st day of June 1982, is required by public interest and convenience and it is hereby ordered that said work be done. 3. Proposals or bids for doing the work herein ordered shall be opened, examined and declared by the City Clerk in a public meeting called by the City Clerk. The results of the bidding shall be reported to the City Council at the next regular meeting after the opening of bids. 4. The time before which proposals or bids will be received by the City Clerk is hereby fixed at 7:30 P.M. , on the 21st day of September, 1982 and will be opened, examined and declared by the City Clerk on the same day in the City Hall at 30940 Hawthorne Boulevard in the City of Rancho Palos Verdes, California. 5. That the Clerk of the City Council shall post conspicuously, for five days on or near the door of the Council Chambers of the City Council, notice inviting sealed proposals or bids for doing the work herein ordered, and shall publish notice of said work or improvement inviting such proposals II/ and referring to the plans and specifications on file, for two days in the Palos Verdes Peninsula News, a newspaper circulated in the City of Rancho Palos Verdes. Said notice shall prescribe that all proposals or bids be accompanied by cash, a cashier's check, a certified check or by a bond, all as prescribed by law, payable to the City of Rancho Palos Verdes for an amount which shall not be less than ten per cent (10%) of the aggregate of the proposal Bids so submitted must be satisfactory to the City Council. Said notice shall further set forth time before which proposals or bids must be delivered to the City Clerk and the time that proposals or bids will be opened, examined and declared by the City Clerk. 6. The City Council hereby directs that the assessment hereafter to be made in these proceedings shall be made and signed by the City Engineer. 7. The City Council hereby directs that the work shall be done under the direction of the City Engineer and the materials used shall comply with the specifications and be to the satisfaction of said City Engineer. 8. That in accordance with the provisions of Section 5256 of the Streets and Highways Code this Council hereby waives the payment in advance of all incidental expenses and c:qul.Ation costs.
