CC RES 1982-036 RESOLUTION NO. 82-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RE: RANCHO PALOS VERDES IMPROVEMENT DISTRICT NO. 4 FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF UTILITY CONVERSION PROJECT IN DALADIER DRIVE AND OTHER RIGHTS OF WAY; RESOLUTION OF INTENTION WHEREAS, the City Council of the City of Rancho Palos Verdes did on June 5, 1979 adopt a resolution instituting proceedings and acknowledging a waiver of Debt Limit Investigation Proceedings as provided in Section 2804 (3) , Division 4, Streets and Highways Code of the State of California, and that proceedings be commenced and conducted under and in accordance with provisions of the Municipal Improvement Act of 1911 for the acquisition of necessary rights of way and the construction of the utility conversion project under City Improvement District No. 4; and WHEREAS, the Council has found and determined by resolution that the public interest and convenience requires the construction of the utility conversion project in Daladier Drive and other rights of way. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RESOLVES: Section 1: That the public interest and convenience require and that it is the intention of the City Council to order acquisition to be made, work to be done and improvement made as follows, to wit: First: The acquisition of rights of way for underground utility purposes by gift or purchases or eminent domain proceedings consisting in general of the following: PARCEL A - The northerly 5 feet of Lot 33, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps, and all that portion of Lot 32, of said Tract, bounded westerly by the northerly prolongation of the westerly line of said Lot 33. PARCEL B - Those portions of Lots 22, 23, 24, 27, 28 and 29, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps, within the area reserved for ingress and egress, as described in Document recorded on May 7, 1976 in Book D7072, page 243, of Official Records. PARCEL C - The southwesterly 15 feet of the southeasterly 40 feet of the northwesterly 90 feet of Lot 21, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps. PARCEL D The northerly and northwesterly 30 feet of Lot 48, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps; the westerly 30 feet of Lots 49, 50, 55 and 56 of said Tract; and the westerly 30 feet of Parcels 1, 2 and 3, Parcel Map No. 7956, as shown on map filed in Book 92, page 63 of Parcel Maps. PARCEL E - The easterly 6 feet of Lot 12, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps. PARCEL F - The northerly 6 feet of Lot 17, Tract No. 21143, as shown on map recorded in Book 599, pages 96 to 100 of Maps, and the northerly 6 feet of the easterly 44 feet of Lot 18, of said Tract. PARCEL G - All that portion of Lot 15, Tract No. 23438, as shown on map recorded in Book 627, pages 63 and 64 of Maps, bounded northerly by the westerly prolongation of the northerly line of Lot 1, of said Tract. PARCEL H - Those portions of Parcels 1, 2 and 3, shown as ingress and egress easements on Parcel Map No. 6467 and filed in Book 79, pages 77 to 79 of Parcel Maps. PARCEL I - All that portion of the southeasterly 15 feet of Parcel 20, as shown on map filed in Book 64, pages 8 to 11 of Record of Surveys, bounded northeasterly by a line concentric with and 35 feet southeasterly, measured radially from the southwesterly line of said parcel. Second: The excavation of trenches, backf illing, resurfacing and the installation of conduit and underground structures together with appurtenant work in - MIRALESTE DRIVE between the centerline of SUANA DRIVE and approximately 600 feet northerly of the centerline of CHANDELEUR DRIVE as shown on map of Tract No. 21143, recorded in Book 599, pages 9'6 to 100 -of- naps; and in • • CHANDELEUR DRIVE the westerly line of MIRALESTE DRIVE and the westerly terminus of said CHANDELEUR DRIVE, as shown on above mentioned Tract No. 21143; and in DALADIER DRIVE • between the westerly line of CHANDELEUR DRIVE and the northerly terminus of said DALADIER DRIVE, as shown on above mentioned Tract No. 21143; and in SUANA DRIVE within Tract No. 23436, as shown On map recorded in Book 627, pages 63 and 64 of Maps; and in THE ABOVE DESCRIBED EASEMENTS (PARCELS A THRU I) -'° = .. Third: The relocation or alteration of existing pipeline utilities where required to complete -the above mentioned work within the above described limits. All of said work shall be performed in-the streets -and rights of way and between the limits herein before des&ribed except Where -the plans indicate that said work shall be omitted. Exception to the resurfacing of existing surfaces will be the work to be done on private property -outside of :underground utility easements dedicated to the City of Rancho Palos' Verdes. This.wor-k'will not include the restoration of any landscaping twelve inches or less in height within a ten-foot strip of land lying five feet on each side of the ` trench centerline. THAT SUCH WORK'OR IMPROVEMENTS, IT IS ESTIMATED, WILL COST THE TOTAL SUM OF SIX HUNDRED THIRTY THOUSAND FOUR HUNDRED EIGHTY DOLLARS ($630,480.00) IN WHICH IS INCLUDED A PORTION OF THE COSTS OF THE UNDER- GROUND ELECTRIC AND COMMUNICATION FACILITIES IN ACCORDANCE WITH THE HEREINAFTER REFERRED TO AGREEMENTS BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE SOUTHERN CALIFORNIA EDISON COMPANY AND THE PACIFIC TELEPHONE COMPANY OF CALIFORNIA. ALSO INCLUDED IS. THE ESTIMATED COST OF ACQUISITION, ENGINEERING AND INCIDENTALS=THERETO IN THE AMOUNT OF $72,000. _ THAT THE ESTIMATED COST OF DOING WORK ON PRIVATE PROPERTY IS INCLUDED IN THIS AMOUNT,OF MONEY, ASSUMING 100--PERCENT PARTICIPATION. THE COST OF=THIS WORK ON PRIVATE PROPERTY MAY -BE INCLUDED IN-THE INDIVIDUAL'S FINAL ASSESSMENT IF THE OWNER OF SAID PRIVATE PROPERTY FILES A WRITTEN REQUEST FOR SAID WORK WITH THE CITY CLERK. Among other things, said agreements shall provide that upon confirmation of the assessment said public utilities shall have legal title to the electric or communication facilities, which shall= thereafter constitute part of a system of public utilities and further provides the utility companies will furnish and install the underground cable facilities within the district in accordance with said agreements, and furthermore shall pay a portion of the costs of said underground cable facilities in accordance with said agreements, that the district to be assessed for the conversion is within the service area of said public utilities. Section 9: That Tuesday the 6th day of July, 1982, at the hour 7:30 P.M. of said day, is the day and the hour and 30940 Hawthorne Boulevard ,. City of Rancho Palos Verdes, California 90274, is the place fixed by the Council when and where any or all persons having any objections to the proposed acquisition, work or improvement or to the extent of the district to be assessed, or to any or all of the foregoing, may appear before the Council and show cause why the proposed acquisition, work or improvement should not be carried out in accordance with this Resolution. Section 10: That answers to inquires regarding the hearing proceedings may be obtained at the office of the Public Works Director, Mr. Carl Abel at 377-0360. Section 11: That the Street Superintendent shall cause to be conspicuously posted along the line of the contemplated work or improvement and along all open streets within the district liable to be assessed notices of the adoption of this Resolution in the manner and in the form required by law. Section 12: The Clerk of the City Council shall certify to the adoption of this Resolution and shall cause the same to be published for two days in the Peninsula News, a newspaper circulated in the City of Rancho Palos Verdes, which is hereby designated for that purpose by the Council. The Council does hereby direct the Clerk thereof to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed for the work herein described whose names and addresses appear on the last equalized assessment roll of the County of Los Angeles or as known to the Clerk the contents of said notices to be as required' by law.
