A -RESO-LUTION OF THE CITY COUNCIL OF THE
CITY OF RANCHO PALOS VERDES SUMMARILY
VACATING AN EXCESS RIGHT OF WAY OF A
PORTION OF PALOS VERDES DRIVE EAST
BETWEEN VIA SUBIDA AND VIA COLINITA FREE A
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY
RESOLVES, FINDS AND DETERMINES AS FOLLOWS:
Section 1. That excess portion of right of way
of a portion of Palos Verdes Drive East between Via Subida
and Via Col i ni t a in the City of Rancho Palos Verdes and
described as: •
That portion of Palos Verdes Drive East (formerly
Granvia Miraleste) , in the City of Rancho Palos Verdes,
County of Los Angeles, State of California, as shown on
and dedicated by map of Tract No. 9302, filed in Book
127, pages 53, 54 and 55, of Maps,• in the office of the
Registrar-Recorder of said County, within a strip of
land 50 feet wide, the northwesterly, westerly and
southwesterly boundaries of which are described as
follows:
Beginning at the most southerly corner of Lot, 5 ,
Block 5 , said tract; thence northeasterly, northerly
and northwesterly at the northwesterly, westerly and
southwesterly boundaries of said Palos Verdes Drive
East to the most northerly corner of Lot 2, said
block.
Excepting therefrom that portion thereof which
lies northerly of the easterly prolongation of the
northerly line of Lot 1, said block.
Reserving to the City of Rancho Palos Verdes an
easement for sanitary sewers and appurtenant structures
in and across that portion of above described Palos
Verdes Drive East herein vacated, within a strip of
land 20 feet wide, the center line of which is the
northwesterly line, and its northeasterly prolongation,
of Lot 4 , above mentioned block.
Also reserving to the City of Rancho Palos Verdes
an easement for sanitary sewers and appurtenant structures
in and across that portion of above described Palos

Verdes Drive East herein vacated, within a strip of
land 10 feet wide, the southwesterly boundary of which
is described as follows:
Beginning at the intersection of the southeasterly
line of the northwesterly 10 feet of above mentioned
Lot 4 with the northeasterly line of said last mentioned
lot; thence southeasterly along said northeasterly line
to the most northerly corner of above mentioned Lot 5;
thence southeasterly along the northeasterly boundary
of said last mentioned lot a distance of 15.00 feet.
The northeasterly boundary of said 10 foot strip
of land shall be prolonged at the beginning thereof so
as to terminate in the northeasterly prolongation of
said southeasterly line
is hereby vacated. Such vacation is made pursuant to
Chapter 4 of Part 3, Division 9 of the Streets and Highways
Code of the State of California (Sec. 8330, et seq. ) .
Section 2. The City Council has considered the
General Plan of the City of Rancho Palos Verdes and finds
the excess right of way vacation to be in conformity with
said General Plan.
Section 3. Pursuant to Section 2381 of the
Streets and Highways Code of the State of California, the
City Council finds and determines the excess right of way
hereby vacated is not useful as a nonmotorized transportation
facility.
Section 4. The excess right of way described in
Section 1 was dedicated as a 150-foot-wide easement for
street purposes by Tract Map 9302 recorded in 1926. Subse-
quently Palos Verdes Drive East (formerly Granvia Miraleste)
was constructed to a 100-foot width. The portion of the
easement hereby vacated was in excess of the easement
necessary for street purposes, and for that reason the
vacated portion of said easement has not been used or
improved for street purposes.

Section 5. The City Council finds and determines
that the excess right of way hereby vacated has never been
used or developed for street or highway purposes, is not
needed for street or highway purp oses and is an excess right
of way.

Section 6. The City Council hereby finds and
determines that the public convenience and necessity require
the reservation of easements described in Section 1 and the
right from time to time to construct, maintain, operate,
replace, remove, renew and enlarge sanitary sewers and
storm drains and appurtenant structures in, upon, over
and across the excess right of way hereby vacated and
hereby declares that these proceedings are subject to such
reservations and exceptions.
Section 7. The City Council finds that there are
no in-place public utility facilities in the vacated portion

r. of said excess right of way that are in use and will be
affected by the vacation.
Section 8. The City Clerk shall cause a certified
copy of this es
rolution, attested by the City Clerk under
seal, to be recorded in the office of the County Recorder of
Los Angeles County.
Section 9. From and after the date of recordation
of this resolution the excess right of way described in
Section 1 shall no longer constitute an easement for street
or highway purposes.
