M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting December 3, 1974 The meeting was called to order at 7:35 p.m. at Ridgecrest Intermediate School, 28915 North- bay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilman Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: Councilman Gunther Buerk Councilman Buerk arrived at 7:38 p.m. and was present for the remainder 11/ of the meeting. Also present were City Manager Leonard G. Wood, Assistant City Attorney Patrick Coughlan, Community Services Officer Doris Brown, Administrative Services Officer George Wunderlin, Public Works Director Dennis Pikus, and Deputy City Clerk Dee Krebs. MINUTES APPROVAL It was moved by Councilman Ryan, seconded by Councilman Dyda, and carried, that the Minutes of November 19, 1974 be approved as dis- tributed. EXECUTIVE SESSION At 7:40 p.m. , Council adjourned to Executive Session to discuss matters of potential litigation, reconvening at 8:25 p.m. with all members present. CITY NAME CHANGE The City Attorney briefed the Council on the (501) procedure to certify the official results of November 5, 1974 election measure regarding the City name change. RESOLUTION NO. 74-96 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RECITING THE FACT OF THE SPECIAL ELECTION TO CHANGE THE NAME OF SAID CITY FROM RANCHO PALOS VE RDE S TO PALOS VE RDES, HELD ON THE 5TH DAY OF NOVEMBER, 1974, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW was read in full. On motion of Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, the Council adopted Resolution No. 74-96 and ordered the election results spread in the Minutes. The City Attorney reviewed his report on the legal effect of possible actions by the City Council in view of the conflict between Government Code Section 34507 requiring two-thirds of the total votes cast to change the name; and Elections Code Section 63, adopted later, providing that a plurality of the votes given at any election shall constitute a choice where not otherwise directed in the Constitution. The City Attorney indicated the City Council could direct the City Clerk to file a statement of the election results with the Secretary of State and Board of Supervisors under the Elections Code, or take no action following the Government Code requirements; but, in any event, the matter would probably be resolved in court in view of the Writ served, but not yet filed, on behalf of the name change. The following individuals spoke in opposition to the name change citing reasons of his- torical precedent, identity and public safety factors: Corena Green, 5710 Scotwood Dr. ; Kay Conrad, 28649 Crestridge Rd.; Estelle Burkhart, 30423 Via Cambron; Burke Belknap, 28866 Crestridge Rd. ; James D. Stewart, 32735 Seagate Dr. ; R. E. Godfrey, 30905 Ganado; and Betty Field, 10 Pomegranate Rd. Speaking in favor of the name change were: J. B. McGuire, 7213 Rue Godbout; Ruth Shaffer, 27131 Indian Peak Rd. ; Ann Richardson, 30823 Cartier Dr. ; Mrs. Betty Mullen, 5725 Sunmist; Mrs. George Griese, 28331 Plainfield Dr.; Patsy Rein, 27829 Longhill Dr. ; Franklyn Weiss, 30711 Via La Cresta; Mrs. Richard Henke, 30437 Oceanaire Dr.; Barbara Walch, 30510 Oceanaire; Joan Vrba, 30243 Oceanaire; Jim Moore, 6810 Locklenna Ln. ; George Finley, 5435 Middle Crest Rd. ; and Mr. John Schimmenti, attorney for Bertha Coffineau. Mr. Schimmenti reported that the Writ of Mandate served on the City Clerk November 18, 1974 had not been filed pending consideration of the name change by Council at the December 3, 1974 Regular meeting. He indicated it was the petitioner's request that the City Council support the granting of a Writ to change the City's name or, in the alternate, not authorizing expenditure of funds to oppose the Writ. Council 249 December 3, 1974 Following a number of questions and comments by members of the City Council, it was moved by Councilman Buerk, seconded by Councilman Dyda, and unanimously carried, that the City Council file a statement of the holding of the election and the result with the Secretary of State and Board of Supervisors citing divergency between Government Code Section 34507 and Elections Code Section 63 and recommending the filing under Elections Code to change the name of .the city to Palos Verdes. RECESS At 10:50 p.m. , the Mayor declared a ten- minute recess. Council reconvened at 11:04 p.m. with the same members present. RES. NO. 74-97 Clancy Leland of the County Administrative 911 EMERGENCY TELEPHONE SYSTEM office briefed the Council on the 911 (401) Emergency program. He stated that the 911 telephone dialing system would be used statewide for access to emergency-responding agencies. City Manager recommended sub- mission of tentative plans with staff to continue meeting with South Bay group of five cities contracting with Sheriff Dept. to investigate other alternatives to 911 system. RESOLUTION NO. 74-97 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AUTHORIZING THE CITY'S PARTICIPATION WITH THE COUNTY OF LOS ANGELES IN A JOINT DEVELOPMENT AND SUB- MITTAL OF 911 TENTATIVE PLANS TO THE STATE OF CALIFORNIA BY JANUARY 31, 1975, OR ANY OTHER DATE THAT MAY BE PRESCRIBED BY LAW was read by title. It was moved by Councilman Ryan, seconded by Councilman Dyda, and unanimously carried, that Council waive further reading and adopt the resolution. RES. NO. 74-98 The City Manager summarized the resolution SPEED ZONES which would establish speed zones on streets (1503) where the existing posted speed limit has been confirmed by study, and four streets having a prima facie speed limit of 55 mph. Following discussion concerning the variance of speed zone posting on specific streets, RESOLUTION NO. 74-98 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING SPEED LIMITS ON VARIOUS STREETS WITHIN THE CITY was read by title. It was moved by Councilman Ruth, seconded by Councilman Dyda, and unanimously carried, that further reading be waived and Council adopt the resolution. RES. NO. 74-99 RESOLUTION NO. 74-99 GRANTING CONSENT AND ANNEXATION TO CO. LIGHTING DISTRICT JURISDICTION TO THE COUNTY OF LOS ANGELES Island View Condominiums IN THE MATTER OF COUNTY LIGHTING MAINTENANCE (1405 x 1409) DISTRICT NO. 1865, PETITION NO. 330-113, was read by title. Following questions concerning costs of maintaining lights, it was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, that further reading be waived and Council adopt the resolution. RES. NO. 74-100 RESOLUTION NO. 74-100 GRANTING CONSENT AND ANNEXATION TO CO. LIGHTING DISTRICT JURISDICTION TO THE COUNTY OF LOS ANGELES Peacock Ridge IN THE MATTER OF COUNTY LIGHTING MAIN- (1405 x 1409) TENANCE DISTRICT NO. 1865, PETITION Nd. 72-74, was read by title. On motion of Councilman Buerk, seconded by Councilman Ryan, and carried, further reading was waived and the resolution was adopted. PUBLIC HEARING Continued hearing was opened on Conditional C.U.P. NO. 3 & VAR. NO. 2 Use permit No. 3 and Variance No. 2 to permit SO. CALIF. EDISON MICROWAVE FACILITY the construction of a microwave facility in (1804) the City. The Council directed the Mayor to issue a press release requesting commercial establishments to confine Christmas lighting to normal hours of operation and asking residents to use lighting displays only between the hours of 7-10 p.m. ADJOURNMENT At 1:00 a.m. , on motion of Councilman Ruth, seconded by Councilman Dyda, and carried, the meeting was adjourned to December 5, 1974, 7:30 p.m. , in the City Offices to discuss personnel matters.
