CC MINS 19740917 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting September 17, 1974 The meeting was called to order at 7:42 p.m. at Ridgecrest Intermediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan, II/ and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, Planning Director Sharon Hightower, Community Services Officer Doris Brown, and Acting Ad- ministrative Services Officer Janice M. DuPar. MINUTES APPROVAL It was moved by Councilman Dyda, seconded by Councilman Ruth, and carried, that the Minutes of August 27, 1974 and September 3, 1974 be approved as distributed. RESOLUTION COMMENDING A resolution commending the Golden Cove Merchants GOLDEN COVE MERCHANTS and Robert Pettengill, President, for their (304) sponsorship of the City's first anniversary celebration was presented to Mr. Pettengill. PUBLIC HEARING - Continued hearing was opened on Conditional C.U.P. NO. 4 Use Permit No. 4, to permit the construction Marymount Tennis Courts of a commercial tennis facility on the Mary- (1804) mount College campus. Director of Planning reviewed list of recommended conditions, developed after further meetings with applicant and members of La Cresta Homeowners. The matters of hours of operation, and immediate landscaped screening remained unsolved after the meetings. Speaking on behalf of the application were Mr. Robert Pettengill and Mr. Isadore Kamen. Mr. Kamen reviewed the proposed lighting for the facility, and indicated concurrence with all conditions except Nos. 6, 10, 12 and 13. He indicated a need for longer hours of operation and higher footcandle lighting in order to be able to compete with clubs in surrounding cities. The following individuals spoke in favor of the proposal and of later hours of oper- ation: William L. Ridpath, 6310 Alto Circle; Robert and Debbie Akerstrom, 28608 Coveridge; Jack Newman, 5619 Seaside Heights Drive; Jim L. Mayfield, 31143 Marne Drive; E.B. MacCuish, 28504 Golden Meadow Drive; Jack Mock, 7042 Hedgewood Drive; James Denton, 28511 Meadowmist Drive; Dr. Lanny Dinesfeld, 29530 Stonecrest Road; W.G. and Mary T. Sander, 30935 Via Rivera; Martin and Myrna Plost, 29113 Oceanridge; and Betty Hill, 27064 Silvermoon. Nancy Guenther, Robert King, and Russell Schweiger, representing the La Cresta Home- owners Association spoke in opposition to the proposal. The requests and recom- mendations of that association were as follows: (1) No lighting be allowed; (2) If lighting is permitted, shielded fixtures and full screening with mature trees and shrubs be required, the lights be 20 footcandles maximum and have individual controls, a low reflectant court surface be required, with provision for its maintenance, and hours of operation be until 8 p.m. Monday through Thursday and until 7 p.m. on Fri- day, Saturday and Sunday; (3) No intense lighting be permitted along the coastline; Council 220 September 17, 1974 (4) In accordance with the Preliminary Goals Report of the General Plan Goals Committee, no spot zoning be permitted; and (5) Prior approval of Condition Use Permit No. 4 be rescinded. Others speaking in opposition to the proposal included: A.W. Guenther, 30714 Via la Cresta; Bill Meikle, 30846 Via la Cresta; J.M. Rubel, 6844 Vallon Drive; B.F. Nelson, 30856 Via la Cresta; and Ed Bedrosian, repre- senting the Monaco Homeowners Association. Following a rebuttal by Mr. Robert Pettengill, the hearing was closed. On the grounds that the conditions presented were fair to both sides, and representative of the meetings held between the two parties, Councilman Buerk moved, and Councilman Dyda seconded for purposes of discussion, that conditions as outlined by staff be approved. Discussion by Council members included the hours of operation, the number of footcandles to be permitted, the size of tree to be used for screening, and the problems of direct and reflected light and the skywave effect. It was pointed out that trees are sold according to box size, not height; trees in a 24" box have a good chance of survival, are usually approximately 16 feet high, and will grow quickly. Councilman Ruth had spoken with many electrical engineers, and recreational experts, all of whom indicated 30 footcandles was the minimum amount of lighting necessary. It was moved by Councilman Ruth, seconded by Mayor Ryan, and carried that the motion be amended to specify 30 footcandles, with Councilmen Buerk and Ryan opposing. It was moved by Councilman Dyda, seconded by Councilman Ruth, and unanimously carried that the motion be amended to specify 24" box trees, rather than trees at least 19 feet high. It was moved by Councilman Dyda, seconded by Councilman Ruth, and unanimously carried that hours of operation be confined to 7 a.m. to 9 p.m. (or dusk) Monday through Friday, and from 7 a.m. to dusk on Saturday and Sunday, with a review of lighting and hours of operation to occur after one year of oper- ation. The original motion to approve conditions with the amendments was thereupon ordered. It was moved by Councilman Ruth, seconded by Mayor Ryan, and carried that the Negative Declaration be approved, with Councilman Buerk dissenting. It was moved by Councilman Ruth, seconded by Mayor Ryan, and unanimously carried that Resolution 74-84 making findings, granting the application sub- ject to conditions as amended be approved in principle. RECESS At 10:15 p.m. the meeting was recessed for approximately ten minutes, recon- vening at 10:25 p.m. with the same members present. PUBLIC HEARING - Hearing was opened on Ordinances No. ORD. 52 AND 52U 52 and 52U, extending interim zoning. INTERIM ZONING There being no one present to give (1801) testimony, the hearing was declared closed. It was moved by Mayor Ryan, seconded by Councilman Ryan, that the exemption be denied. Following discussion, the motion was withdrawn. Discussion by Council included concern with the urgency of the application and the precedent which might be set. Director of Planning indicated that approving the exemption could, in terms of future subdivision, preclude more options for the applicant that for the City. Councilman Ruth left the chamber at 11:40 p.m. and returned at 11:45 p.m. ORDINANCE NO. 56 OF THE CITY OF RANCHO PALOS VERDES REMOVING CERTAIN PROPERTY FROM THE EXISTING MORATORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDI- NANCES NO. 54 AND 54U OF THE CITY OF RANCHO PALOS VERDES was read by title. It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, that further reading be waived, and the ordinance be passed to second reading. RES. NO. 74-85 City Manager reviewed the City's cost PERS CONTRACT under the Public Employees Retirement (1313) System. RESOLUTION NO. 74-85 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES GIVING NOTICE OF INTENTION TO AP- PROVE CONTRACT PROVIDING FOR PARTICIPATION IN PUBLIC EMPLOYEES RETIREMENT SYSTEM was read by title. It was moved by Councilman Dyda, seconded by Councilman Ruth, and unanimously carried that further reading be waived and Council adopt the Resolution. RES. NO. 74-83 RESOLUTION NO. 74-83 OF THE CITY REGISTER OF DEMANDS COUNCIL OF THE CITY OF RANCHO PALOS (1504) VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $439,826.41, DEMAND NUMBERS 559 THROUGH 590 wa s read by title. Following questions, it was moved by Councilman Dyda, seconded by Councilman Ryan that further reading be waived and Council adopt the resolution. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None MORATORIUM EXEMPTION Director of Planning indicated she APPEAL OF PAC DENIAL had no new information to present. (Great Lakes Properties) Council could either uphold the Plan- (1801) ping Advisory Committee's denial, or overrule it and direct staff to pre- pare the proper ordinance. Mike Kochan, representing the applicant, presented a revised site plan for the project. A total of 1.2 acres had been added, including a 20 foot ease- ment along a portion of the property (but not including any portion of the Paseo del Mar easement) . The additional land will serve to buffer the pro- ject and provide open space. The number of on-site guest parking spaces had been doubled, and an outdoor activity area, tennis court, paddleboard court, and a putting green added. Approximately 56.5% (3.15 acres) of the Council 223 September 17, 1974 site is now devoted to recreation or open space. If the exemption is approved, Mr. Kochan indicated he would construe it as approval of the condominium conversion and would go ahead with the construction changes, approval of the Coastal Commission, and the engineering of the additional recreational features. The project will com- ply with the state requirements for the handicapped. Robert Marohn, 3567 Heroic Drive, speaking on behalf of the residents of the South Coastal region, spoke in favor of the conversion and presented Council with a list of concerns and recommendations. John McTaggart indicated that the concessions made by the applicant were precisely what the Planning Advisory Committee was hoping for. He suggested not vacating any portion of the Paseo del Mar easement until the circulation element is complete. Also speaking in favor of the conversion were Gary Kinnett, 4253 Admirable; Byron Blue, 3675 Cliffsite Drive; and Mike Steponovich, of Great Lakes Properties, who indicated a geologist's report had been done on this property several years ago, and no problems found. Council indicated concern with such factors as traffic, lights (including tennis court lighting) , fencing, easements, access, geology, etc. Councilman Buerk re-stated previous request that report on General Plan housing study and policy toward condominiums be ready prior to consideration of conditional use permit. Mayor Ryan left the chamber at 12:55 a.m. and returned at 12:57 a.m. It was moved by Mayor Ryan, seconded by Councilman Ryan, and unanimously carried, that staff be directed to draft an ordinance exempting this property from the mora- torium. CODE AMENDMENT - Director of Planning summarized the Planning VETERINARY CLINICS Advisory Committee's recommendation regarding (1801) veterinary clinics. It was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously carried, that Council approve the initiation of a Code amendment to allow veterinary clinics in C-1 zones, with conditions, and that a hearing be set for October 15, 1975. SO. BAY CORRIDOR STUDY Councilman Buerk indicated there would be a COMMITTEE meeting of the South Bay Corridor Study Com- mittee on September 30, 1974 at 7:30 p.m. at Ridgecrest Intermediate School. SILVER SPUR MEDIAN City Manager indicated that a letter and a bill from the City of Rolling Hills Estates re- garding the Silver Spur median had been re- ceived and acknowledged. EXECUTIVE SESSION At 1:08 a.m. on motion of Councilman Dyda, seconded by Councilman Ryan, Council adjourned to executive session to discuss matters of litigation. The meeting reconvened at 1:29 a.m. with the same members present. FASHION MALL City Attorney was directed to take the neces- sary steps preparatory to appealing the de- cision of the Superior Court to uphold the Rolling Hills Estates Environmental Impact Report on the proposed Fashion Mall.
