CC MINS 19740716 MINUTES RANCHO PALOS VERDES CITY COUNCIL Regular Meeting July 16, 1974 The meeting was called to order at 7:40 p.m. at Ridgecrest Intermediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Ken Dyda, Francis D. Ruth and Mayor Marilyn Ryan II/ ABSENT: Councilmen Gunther Buerk and Robert E. Ryan Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, Planning Director Sharon Hightower, Associate Planner Max Williams, Community Services Officer Doris Brown, and Administrative Services Officer David B. Smith. MINUTES APPROVAL It was moved by Councilman Dyda, seconded by Councilman Ruth and carried, that the Minutes of the meetings of July 2, 1974 and July 3, 1974 be approved as distributed. PUBLIC HEARING Mayor declared public hearing open regarding ORD. 46 - ZONING Code amendment ordinance to allow for a com- CODE AMEND. (Tennis mercial tennis facility in the RA-1 District Facility) with a conditional use permit. Planning Director briefed Council and reported that notice had been given with affidavit thereto on file with the Clerk, and no correspondence had been received. There being no response to the Mayor's call for testimony, the hearing was declared closed. ORDINANCE NO. 26 OF THE CITY OF RANCHO PALOS VERDES PROVIDING FOR CERTAIN LAND USES UNDER CONDITIONAL USE PERMITS AND AMENDING THE INTERIM ZONING ORDINANCE AND ORDINANCES NO. 16, 16U AND NO. 42 OF THE CITY OF RANCHO PALOS VERDES AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was introduced for first reading by title. It was moved by Councilman Dyda, seconded by Councilman Ruth and carried unani- mously, that further reading be waived and Ordinance No. 46 be passed to second reading. Ryan FIRE CODE Community Services Officer reported notice had been sent to all homeowner associations in the City with copies of present and proposed regulations concerning the removal of flammable growth around structures, and introduced Monroe Polk of the Agricultural Commis- sion and Battalion Chief Sarno of the Fire Department. No comments or written communications regarding the subject had been received. Isidore Kamen, 37 Cresta Verde Drive, and Lee McGee, 30552 Avenida Corona (President of LaVista Verde Estates Homeowners Association) , who spoke as an individual, commented regarding removal of trees near chimneys if spark arresters are in place. Following discussion, Council referred the proposed ordinance to staff to recom- mend further clarification in wording and requested that the subject be discussed at the adjourned meeting of Council scheduled for Tuesday, July 23, 1974. ORD. 47 - MORATORIUM Planning Director briefed Council on the EXEMPTION - LOWER recommendation for excluding the lower Abalone ABALONE COVE AREA Cove area. ORDINANCE NO. 47 OF THE CITY OF (Kirwan) RANCHO PALOS VERDES REMOVING CERTAIN PROPERTY FROM THE EXISTING MORATORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDINANCES NOS. 16 AND 16U AS AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES was then introduced for first reading by title. It was moved by Councilman Dyda, seconded by Mayor Ryan and carried unanimously, that Council waive further reading and pass the ordinance to second reading. ORD. 48 - MORATORIUM ORDINANCE NO. 48 OF THE CITY OF RANCHO PALOS EXEMPTION - VIA CAMPESINA VERDES REMOVING CERTAIN PROPERTY FROM THE AREA (Meine) EXISTING MORATORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDINANCES NOS. 16 AND 16U AS AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES, removing from the moratorium the central portion of the Via Campesina property was introduced for first reading by title. It was moved by Councilman Ruth, seconded by Mayor Ryan and carried unanimously, that Council waive further reading and pass Ordinance No. 48 to second reading. STREET LIGHTING - Planning Director reported on street lighting PEACOCK RIDGE - for Peacock Ridge Road and indicated the two TR. NOS. 31871 & 31493 builders involved (Messrs. Jones and Treacy) (1405) are willing to increase their on-site lighting, if necessary, to provide adequate security with low level lighting, if the City does not wish the usual amount of street lighting to be pro- vided, which would light the rear yards of the single-family homes on Scotmist. Following discussion, it was moved by Councilman Dyda, seconded by Councilman Ruth and carried, that street lighting be modified to include the lower illumina- tion ornamental street lighting and that the City pay the difference in costs. Council 189 July 16, 1974 INVENTORY OF ENVIRON- Planning Director reported on proposal for MENTAL RESOURCES (701) an inventory of environmental resources for the City, and recommended the firm of EDAW, Inc. to prepare the inventory. It was moved by Councilman Dyda, seconded by Councilman Ruth and carried, to authorize the Mayor to execute the agreement with EDAW, Inc. to conduct the study at a cost not to exceed $10,000. L.C.C. ANNUAL It was moved by Councilman Ruth, seconded CONFERENCE by Councilman Dyda and carried, that the Mayor be authorized to attend the League of California Cities Annual Meeting, to be held in Oakland, California, July 30, 1974. P.V.P. YOUTH Mrs. Betty Jo MacPhee, 28819 Blythewood COMMISSION Drive, representing the Palos Verdes Peninsula Youth Commission, reported to Council goals and objectives of the organization. Following discussion relative to long-term goals and funding of same, Mrs. MacPhee indicated budget information could be presented to Council at the Public Hearing on the Budget scheduled for July 23, 1974. SO. BAY YOUTH Mr. Marc Scherbacher, Consultant, South Bay- TREATMENT PROJECT Harbor area, of the South Bay Youth Treatment Project, addressed Council relative to the distribution of Federal funding for the sur- rounding areas and answered questions of Council pertaining to program and objectives of the Project. He recommended that a resolution or letter of intent be forwarded to the California Council on Criminal Justice indicating an interest and a willingness to cooperate in the program. Council was invited to attend meeting on July 25, 10 a.m., in Redondo Beach Council Chambers. RECESS At 9:35 p.m. , Mayor declared a five-minute recess. Meeting reconvened at 9:50 p.m. with same Council members present. RES. 74-56 - RESOLUTION NO. 74-56 OF THE CITY COUNCIL OF FED. MASS TRANSIT THE CITY OF RANCHO PALOS VERDES OPPOSING A FUNDING (1505) PROPOSAL TO ASSIGN LOS ANGELES COUNTY SECOND PRIORITY FOR FEDERAL MASS TRANSIT FUNDING was read by title, supporting Los Angeles' Federal Mass Transit Funding. It was moved by Councilman Dyda, seconded by Councilman Ruth and unanimously carried, to waive further reading and adopt the resolution. APPROVAL OF WATER It was moved by Councilman Dyda, seconded by SYSTEMS - TR. NOS. 29593 Councilman Ruth and carried, that Council & 29596 & PARCEL MAP approve the findings of the City Engineer that NO. 2803 (1409Y all work had been completed as required by the Subdivision Water System Agreements for Tracts Nos. 29593 and 29596 and Parcel Map No. 2803, Council 190 July 16, 1974 and accept the recommendation to release the Subdivision Water System Agree- ments between the City of Rancho Palos Verdes and the Subdivider and the Bond for Faithful Performance for each division of land. F.A.U. PROJECT Following discussion, it was suggested the (1403) Contract Cities Association be contacted relative to possible projects for F.A.U. funding consideration. It was moved by Councilman Dyda, seconded by Councilman Ruth and carried, that a representative of the City attend the District League meeting on August 1, 1974, and that the representative review information and attempt to encourage other cities to join in amending the Proposal to allow the County to give cities at least 50% of their allocated dollars. CLAIM AGAINST It was moved by Councilman Dyda, seconded by CITY - Nackowski Mayor Ryan and carried, that the claim of (303) Robert S. Nackowski against the City be denied. PORTUGUESE BEND Council reviewed letter from William R. SLIDE Griffin, 5 Ginger Root Lane, relative to the inactive landslides in that area. Planning Director reported letter had been forwarded to the County Engineer, who forwarded it to the Chief Geologist of the County. Following discussion, it was moved by Councilman Dyda, seconded by Councilman Ruth and carried, that Council receive and file the material and defer to the General Plan Goals Committee for part of the General Plan Seismic element. P.V.P. NEWS - AD On motion of Councilman Dyda, seconded by Councilman Ruth and carried, the City was authorized to place an ad in the Palos Verdes Peninsula News' 37th Anniversary publication of September 19, 1974. RES. 74-54 - REGISTER Following discussion, it was moved by OF DEMANDS Councilman Dyda, seconded by Councilman Ruth and carried unanimously, that further reading be waived and Council adopt RESOLUTION NO. 74-54 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $471,847.59, DEMAND NUMBERS 444 THROUGH 478. On roll call vote: AYES: Dyda, Ruth, M. Ryan NOES: None ABSENT: Buerk, R. Ryan VIEW OBSTRUCTION Ed Bedrosian pointed out to Council some of the problems relating to view obstruction in the Monaco area and urged Council to pass an ordinance as soon as possible regulating the quality and type of constructions and the granting of permits for same. Council 191 July 16, 1974 CITY NAME City Manager reported distributing informa- CHANGE tion relative to estimates of costs to Council and reviewed some of the steps involved in this item being placed on the November ballot. City Attorney indicated materials outlining the legalities involved would be available for Council in the near future. LEAGUE OF CITIES Mayor reported attending League of Cities MEETING (re. trash Meeting at which newspaper collection was collection) discussed, and indicated that B.F.I. is interested in conducting a newspaper collec- tion demonstration. It was noted that Council should be receiving the B.F.I. proposal in the near future. NIKE SITE Councilman Ruth reported that it will probably be mid-August or early September before a decision will be reached relative to the City acquiring the Nike Site. PLANNING BILL City Attorney reported that the bill extending various general planning dates was signed by the Governor on July 11, 1974.
