CC MINS 19740507 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting May 7, 1974 The meeting was called to order at 7:40 p.m. at Ridgecrest Intermediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, 11/ Robert E. Ryan and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, Attorneys Glenn Watson and Colin Lennard, Planning Director Sharon Hightower, Community Services Officer Doris Brown and Administrative Services Officer David B. Smith. MINUTE APPROVAL It was moved by Councilman Dyda, seconded by Councilman Buerk and carried, that the Minutes of April 9, 1974, April 16, 1974, April 20, 1974 and April 25, 1974 be approved as distributed. AUDIENCE QUESTION: Lou Rosenberg, 2768 Vista Mesa Drive, spoke SIGNS about signs and urged preparation of a sign ordinance as soon as possible. PUBLIC HEARING Continued hearing was opened on C.U.P. No. 2, C.U.P. NO. 2 application for lab use on school facility. ENDO. LAB A letter was presented from the applicant (1804) requesting withdrawal of the application. There being no further discussion, the Mayor closed the hearing. It was moved by Councilman Ryan, seconded by Councilman Buerk and carried, that Council approve the request for withdrawal of the application by the applicant. ORD. 32 - CONDO. ORDINANCE NO. 32 OF THE CITY OF RANCHO PALOS APPLI. FOR TENT. TR. VERDES REMOVING CERTAIN PROPERTY FROM THE NO. 31871 AND TENT. EXISTING MORATORIUM ON CERTAIN PERMITS AND MAPS TR. NO. 31397 (18 0 4) AND AMENDING ORDINANCES NO. 16 AND 16U AS AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES was read by title, first reading having been given April 16, 1974. It was moved by Councilman Buerk and seconded by Councilman Ryan that further read- ing be waived and the Council adopt the ordinance. Following Council discussion, it was decided that action be delayed until Council considered Tentative Tract 31871 and Tentative Tract 31397 applications for con- version to condominiums later in the meeting. (See Page 152.) Council 149 May 7, 1974 ORD. 33 - EXCLU. OF Council considered exclusion of certain "MAJOR" PROPERTIES properties from the moratorium area that had (1801) been damaged by fire. ORDINANCE NO. 33 OF THE CITY OF RANCHO PALOS VERDES REMOVING CERTAIN PROPERTY FROM THE EXISTING MORATORIUM ON CER- TAIN PERMITS AND MAPS AND AMENDING ORDINANCES NO. 16 AND 16U AS AMENDED BY ORDI- NANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES was read by title, first read- ing having been given April 16, 1974. It was moved by Councilman Dyda, seconded by Councilman Ruth, that further reading be waived and Council adopt Ordinance No. 33. Following Council discussion, the City Attorney reported a thorough research is in progress concerning City liability and a report will be made to Council May 21, 1974. The motion to adopt the ordinance was withdrawn and a substitute motion, by Councilman Buerk, seconded by Councilman Ruth, was adopted that the ordinance be continued to the May 21 meeting of Council. ORD. 34 - ENVIRON. ORDINANCE NO. 34 OF THE CITY OF RANCHO PALOS EXCISE TAX - AMEND. TO VERDES REGARDING COLLECTION OF THE ENVIRONMENTAL PROVIDE FOR DEFERRED EXCISE TAX AND AMENDING THE RANCHO PALOS VERDES PAYMENTS OF ENVIRON. MUNICIPAL CODE was reviewed and read by title, EXCISE TAX (1501) first reading having been given April 16, 1974. It was moved by Councilman Ruth, seconded by Councilman Buerk, that further reading be waived and Council adopt the ordinance. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. 36 - CODI. In order to properly number the sections of the OF SALES AND USE Municipal Code for ordinances already adopted, TAX (ORDS. NOS. 2 ORDINANCE NO. 36 OF THE CITY OF RANCHO PALOS & 5) VERDES CODIFYING THE SALES AND USE TAX ORDINANCE (ORDINANCES NOS. 2 AND 5) AS CHAPTER 1 OF ARTICLE VI OF THE RANCHO PALOS VERDES MUNICIPAL CODE was introduced by title. It was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously carried, that further reading be waived and the ordinance be passed to second reading. FINAL PARCEL James Mahoney, 3608 Grove Drive, requested MAP 4021 Council approval of Final Parcel Map 4021 (1410) so it could be recorded, and pointed out Council had approved Tentative Parcel Map 4021 on October 17, 1973. It was moved by Councilman Dyda, seconded by Councilman Ryan and carried, that Council approve Final Parcel Map 4021. Council 150 May 7, 1974 MORATORIUM ZONE - Planning Director reported on the following four REQUEST FOR EXEMP. requests for exemption from the moratorium zone (Brunning; Meine et al. ; and summarized staff recommendation that Council Pettengill, Kamen & Assoc. ; request the Planning Advisory Committee to review So. Ca. Edison Co.) the moratorium and the requests, and forward a (1801) recommendation to the Council within one month: (a) Tract 27980, Plat Map No. 51, Parcel 2, at Silver Spur Road and Silver Spur (Brunning) (b) Via Campesina area (Meine et al.) (c) Tennis Club at Marymount College (Pettengill, Kamen & Associates) (d) Microwave Relay Station (Southern California Edison Company) Richard Meine, 3270 Via Campesina, reported he had met with the neighbors and agreement had been reached as to what would be desirable in the area. I. Kamen, 31238 Palos Verdes Drive West, addressed Council in support of the tennis club at Marymount College, which would be opened to the public on a commercial basis. It was moved by Councilman Ryan, seconded by Councilman Dyda and carried, that three of the requests (b, c and d, identified above) be referred to the Planning Advisory Committee to review the moratorium and requests for exemption, that a recommendation be forwarded to Council within one month, and that one request (identified as a above) be rejected in view of the fact it was a request for commercial building. TENT. TR. MAP 31871 Planning Director reviewed staff report with (Treacy) (1411) respect to the application for conversion to condominium of Tentative Tract Map 31871. Those speaking in favor of the application were John Treacy, 32679 Seagate Drive; James E. McKee, 100 S. Guadalupe, Redondo Beach; and Charles Gould, Villa Antique. Alan Kempler, 7227 Berry Hill Drive, inquired as to revenue impact from the con- version and extent of management/maintenance services that would be available. Lou Rosenberg, 2768 Vista Mesa Drive, urged Council to consider past history of this particular development before reaching a decision. Following Council discussion, it was moved by Mayor Ryan, seconded by Councilman Ryan, that Council approve the condominium conversion with conditions upon adoption of the ordinance removing the property from the moratorium area. Motion failed with Councilmen Buerk, Dyda and Ruth voting in opposition. A motion moved by Councilman Dyda, seconded by Councilman Buerk, that the appli- cation for Tentative Tract Map 31871 be denied carried with Mayor Ryan and Councilman Ryan voting in opposition. TENT. TR. MAP 31397 Planning Director reviewed and summarized staff (Tarr) (1411) report with respect to the application for con- version to condominium of Tentative Tract Map 31397. Tim Burrell, representing Leisure Living Residentials, Inc., addressed Council on behalf of the applicant. Valla Blanch, a resident, inquired as to the effect on the schools if such a conversion were approved. Council 151 May 7, 1974 Following Council discussion, a motion by Councilman Dyda, seconded by Council- man Buerk, that application for Tentative Tract Map 31397 be denied was adopted with Mayor Ryan opposing the motion. ORD. 32 (Continued Council again considered Ordinance No. 32 and from Page 149) the motion to waive further reading and adopt. Following denial of approval of applications for Tentative Tract Map 31871 (Treacy) and Tentative Tract Map 31397 (Tarr) , the adoption of Ordinance No. 32 failed on the following roll call vote: AYES: None NOES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan ABSENT: None RECESS At 9:30 p.m. , the Mayor declared a five-minute recess. Council reconvened at 9:40 p.m. , with all Council members present. CITY AUDITOR City Manager briefed Council on staff recommenda- SELECTION (602) tion that the CPA firm of Francisco and Cotton be selected as City Auditors. City Attorney commented on the agreement submitted for Council approval and recommended minor modification under "Extraordinary Services." It was moved by Councilman Buerk, seconded by Councilman Ruth and carried, that the Mayor be authorized to sign the agreement with Cotton and Francisco, with modifications as submitted by the City Attorney. RES. 74-35 - FLOOD RESOLUTION NO. 74-35 OF THE CITY OF RANCHO PALOS INSURANCE PROGRAM VERDES EXPRESSING REQUEST AND ASSURANCES FOR (604) FLOOD AND LANDSLIDE INSURANCE UNDER THE NATIONAL FLOOD INSURANCE PROGRAM was read by title. It was moved by Councilman Dyda, seconded by Council- man Buerk and unanimously carried, that Council waive further reading and adopt the resolution. RES. 74-36 - PLAN. City Manager reported on request of Planning ADV. COM. MTG. TIME Advisory Committee to change their meeting dates & PLACE (1205) to the second and fourth Tuesdays of the month at 7:30 p.m. , in the City Offices. RESOLUTION NO. 74-36 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING THE TIME AND PLACE OF MEETINGS OF THE PLANNING ADVISORY COMMITTEE AND RESCINDING RESOLUTION NO. 74-6 was read by title. It was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously carried, that further reading be waived and Council adopt Resolution No. 74-36. Council 152 May 7, 1974 P.V. PANORAMA - Council considered request for placing advertise- 8th EDITION (305) ment in annual "Panorama" to be published by the Daily Breeze, the theme of which this year will be a "Salute to the New Fourth City--Rancho Palos Verdes." It was moved by Councilman Dyda, seconded by Councilman Ryan and carried, that the City purchase a one-page ad and a Council committee will work with staff to prepare. CITY NEWSLETTER City Manager reported on staff research of cost, (1107) possible methods of preparation, and distribu- tion of a City newsletter. Samples of newsletters from surrounding cities were distributed for Council review. Council discussed format, frequency of publication and means of distribution and indicated its desire to follow initially the least expensive proposal submitted. Staff was requested to draft material to be presented to Council for review, and the Mayor indicated a committee of the Council would be named to assist staff with the preparation of the City's newsletter. GEN'L. GOALS COM. William Petak, Chairman of the General Plan REPORT (701) Goals Committee, reported to Council, summarized progress to date, and reviewed procedures recom- mended for the Committee to meet goals and objec- tives in a timely fashion. Following discussion, Mr. Petak agreed to submit a budget request and monthly reports or summaries to Council. RIDGECREST RANCHOS Council received notice of appointment of RECREATION & PARK Mrs. Kay K. Conrad and the re-appointment of DIST. APPTS. (1201) Mrs. Julia Loder to the Ridgecrest Ranchos Recreation and Park District. It was moved by Councilman Ryan, seconded by Councilman Dyda and carried, that receipt of the communications be acknowledged and congratulatory letters be sent to new Board members. REQUEST FOR INCLU. IN City Manager summarized request received from P.V.P. SCHL. DIST. Milnor E. Gleaves on behalf of the residents in the neighborhood adjacent to Friendship Park to be transferred from the Los Angeles Unified City School District to the Palos Verdes Peninsula Unified School District. It was moved by Councilman Dyda, seconded by Councilman Buerk and carried, that staff be directed to prepare a resolution supporting the efforts of these resi- dents in their attempt to be a part of the Palos Verdes Peninsula School District. RES. 74-37 - OPPOSING Following discussion and review of a draft resolu- OFFSHORE OIL LEASES tion of the City of Manhattan Beach, Councilman (310) Dyda requested that the following be inserted after the second paragraph: Council 153 May 7, 1974 "WHEREAS, accelerated depletion of this finite resource will only hasten the day of real crisis not only in energy but also in petro- chemical products such as plastics, synthetic fibers, antiseptics, drugs and anesthetics; and" and Councilman Ryan requested that the following be inserted as the last "whereas": WHEREAS, a meaningful long-range petroleum conservation program has not yet been initiated;" It was moved by Councilman Ryan, seconded by Councilman Dyda and unanimously carried, that Council waive further reading except by title of RESOLUTION 74-37 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, OPPOSING THE PROPOSED OFFSHORE OIL LEASES IN FEDERALLY CONTROLLED SOUTHERN CALIFORNIA WATERS IN REFERENCE TO THE DEPARTMENT OF INTERIOR'S REQUEST FOR COMMENTS, as amended. Ryan NOES: Ruth ABSTAIN: Buerk ABSENT: None COASTAL FENCES Alan Kempler, 7227 Berry Hill Drive, represent- (109) ing the Oceanview Homeowners Association, requested Council to consider declaring the fence west of Palos Verdes Drive West, between the City limit of Palos Verdes Estates and Hawthorne Boulevard, as a nusiance and have it removed. It was reported that the Mayor, the City Manager and Councilman Buerk are pur- suing the matters with Supervisor Hayes, the County Parks and Recreation Director and County Counsel. VIEW OBSTRUCTION Council requested staff to respond to a letter (310) from Mr. Benmeyr regarding the status of deal- ing with the view obstruction problems of the City. ALCOHOLIC BEVERAGE Application for person-to-person transfer of LICENSE (102) off-sale beer and wine license at 6118 Palos Verdes Drive South was received and filed by Council. BUS. LIC• ORD. Council accepted a letter from Palos Verdes (310) Peninsula Chamber of Commerce commending the City Council for its procedure in establishing the business license ordinance. CLAIM AGAINST CITY It was moved by Councilman Dyda, seconded by (Perkovich) (303) Councilman Ryan and carried, that the claim submitted by George R. Perkovich, Jr. and Florine L. Perkovich be denied. FASHION MALL It was moved by Councilman Dyda, seconded by Councilman Ryan and carried, that the Mayor be authorized to direct a letter of agreement with Dr. Paul Peppard relating to the cost of litigation.
