RANCHO PALOS VERDES CITY COUNCIL
Regular Meeting
May 21, 1974
The meeting was called to order at 7:45 p.m. at Miraleste High School,
29323 Palos Verdes Drive East, having been adjourned from the regular meeting
place because of lack of space. Roll call was answered as follows:
PRESENT: Councilmen Gunther Bue rk, Ken Dyda, Francis D. Ruth,
and Mayor Marilyn Ryan
11/ ABSENT: Councilman Robert E. Ryan
Councilman Ryan arrived at 7:48 p.m. and was present for the remainder of the
meeting.
Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson,
Planning Director Sharon Hightower, Community Services Officer Doris Brown
and Administrative Services Officer David B. Smith.
MINUTES APPROVAL It was moved by Councilman Dyda, seconded by
Councilman Buerk and carried, that the
Minutes of May 7, 1974, be approved as
distributed.
Councilman Ryan arrived at this point and was present for the remainder of the
meeting.
AUDIENCE QUESTIONS: Alan Kempler, 7227 Berry Hill Drive, distri-

Planning Bill and asked Council to pass a
supporting resolution.
Following discussion, Council agreed to contact Congressman Bell for further
information and a copy of the Bill.
MIRALESTE H. S. R. Michael Wyman, 3069 Crest Road, represent-
SUMMER RECREATION ing the students of Miraleste High School,
PROGRAM presented a petition to Council requesting
that the high school gymnasium be available
during the summer months and that the students
be given an opportunity to present in-put with
respect to the programs offered. Mr. Wyman indicated he had just learned that
the gymnasium would be open for the summer but submitted petition to Council for
the record.
Following discussion, Council suggested the students contact Mary Thomas of the
Palos Verdes Park in an effort to work with the recreation directors in develop-
ment of programs and offered their willingness to assist in setting up such a
meeting between the students and the recreation personnel.
VENDING TRUCKS J. B. McGuire of 7213 Rue Godbout, represent-
ing the Ocean View Homeowners Association,
urged Council to take action prohibiting the

vending trucks from operating on the streets of the City. Following discus-
sion, City Manager indicated staff would prepare a report indicating pros and
cons of the situation.
ORD. 33 - EXCLU. OF Following discussion, the City Attorney

in this particular instance and indicated a
written statement pertaining to the matter will
be prepared for Council. ORDINANCE NO. 33 OF

TORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDINANCES NO. 16 AND 16U AS
AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES was read by title,
first reading having been given April 16, 1974. It was moved by Councilman Ryan,
seconded by Councilman Buerk, that further reading be waived and Council adopt
the ordinance. On roll call vote:

ORD. 36 - CODI. OF ORDINANCE NO. 36 OF THE CITY OF RANCHO PALOS
SALES AND USE TAX VERDES CODIFYING THE SALES AND USE TAX ORDINANCE
(ORDS. NOS. 2 & 5) (ORDINANCES NOS. 2 AND 5) AS CHAPTER 1 OF
ARTICLE VI OF THE RANCHO PALOS VERDES MUNICIPAL
CODE was read by title, first reading having
been given May 7, 1974. It was moved by Council-
man Buerk, seconded by Councilman Dyda and carried, that further reading be waived
and Council adopt Ordinance No. 36. On roll call vote:

CABLE TV - PROPOSED Councilman Buerk, on behalf of the Franchise
RATE INCREASE Committee, reported TM Communications had been
invited to make comments and/or changes in the
draft ordinance presented to Council; and upon
adoption of the ordinance, Council will have an
opportunity to investigate any proposed rate change.
Dick Young, Director of Revenue and Service Requirements for Cable TV, commented
on the availability of video equipment for community events.
RES. 74-40 - RESIDENTS In response to request received from residents

VERDES UNIFIED SCHOOL DISTRICT AND THE LOS
ANGELES UNIFIED SCHOOL DISTRICT was read by
title. It was moved by Councilman Dyda, seconded by Councilman Buerk and carried,
that Council waive further reading and adopt the resolution.
RES. 74-41 - RESOLUTION NO. 74-41 OF THE CITY COUNCIL OF
ALCOHOLISM LEGIS. THE CITY OF RANCHO PALOS VERDES, CALIFORNIA,
REQUESTING THAT THE LOS ANGELES COUNTY PLAN

FOR DISTRIBUTION OF MONIES MADE AVAILABLE BY THE STATE OF CALIFORNIA FOR
PREVENTION AND TREATMENT SERVICES IN THE FIELD OF ALCOHOLISM INCLUDE THE
SOUTH BAY COMMUNITY was read by title. It was moved by Councilman Dyda,
seconded by Councilman Ryan and carried, that further reading be waived
and Council adopt the resolution.
FIRE PREVENTION/ Chief Paul Schneider, representing the Fire
WEED ABATEMENT Department, and Messrs. Monroe Polk and
John Manning, representing the Agricultural
Commission, explained services performed by
their respective agencies in the weed abate-
ment and fire control programs, and discussed with Council more restrictive
measures in vegetation clearance for fire control.
It was agreed the Fire Department would work with these representatives and the
Community Services Officer to recommend an ordinance to the City Council regard-
ing additional fire regulations.
RECESS At 9:10 p.m. , the Mayor declared a five-
minute recess. Council reconvened at
9:20 p.m. , with all members present.
FIREWORKS Council considered application of the Kiwan i s
DISPLAY Club of Palos Verdes for permission to conduct
a fireworks display on the grounds of Marine-
land on July 4th, this year.
On motion of Councilman Buerk, seconded by Councilman Dyda and carried, Council
approved the application, subject to compliance with all requirements of the
Fire Department and law enforcement agencies.
TENT. TR. At the request and concurrence of the respec-

(Tarr) Tract No. 31397 prior to Tentative Tract
No. 31871.
Tim Burrell, representing Leisure Living Residentials, Inc., addressed Council
on behalf of the applicant (Dr. Tarr) and distributed materials relating to
the request for reconsideration and approval of application for conversion to
condominium, Tentative Tract Map 31397.
A motion by Councilman Ryan, seconded by Councilman Ruth, that Council reconsider
application for conversion to condominium of Tentative Tract Map 31397, denied
May 7, 1974, carried on roll call vote:

In order to provide an opportunity for Council to review the additional data,
it was moved by Councilman Ruth, seconded by Councilman Dyda, that consideration
of this matter be deferred until the next regular meeting of Council. Motion

CLAIM AGAINST CITY The City Attorney reported a claim against City
filed by attorney for applicant of Tentative
Tract Map 31397. It was moved by Councilman
Dyda, seconded by Councilman Buerk and carried,
that the claim be denied.

John McTaggart, 6916 Purpleridge Drive, spoke against the application. Byron
Blue, 3675 Cliffsite Drive, reported that the Planning Advisory Committee will
be presenting a recommendation to Council regarding exemptions from the mora-
torium and urged Council to defer taking action until these recommendations had
been presented. 111
It was moved by Mayor Ryan, seconded by Councilman Ryan, that Council approve the
application in principle. Councilman Buerk spoke against the proposed motion and
urged Council delay action until the Planning Advisory Committee recommendation.

unanimous motion of Councilman Ruth, seconded by Councilman Ryan.
It was moved by Councilman Ryan, seconded by Councilman Ruth, that Ordinance No. 37
be passed to second reading. On roll call vote:

Following discussion, it was moved by Councilman Ruth, seconded by Councilman
Ryan, that Council approve Tentative Tract Map 31871 subject to conditions
identified by staff and any other conditions recommended by staff on re-examination,
to be effective on the adoption of Ordinance No. 37.
A motion by Councilman Dyda, seconded by Councilman Buerk, to amend the original
motion to call for conditions to be reported back at the next meeting, together
with all prior variances and waivers applied for and granted on this property,
was defeated on the following roll call vote:

Council 160 May 21, 1974
A motion by Councilman Buerk, seconded by Councilman Dyda, to amend the original
motion to call for conditions only to be reported back at the next regular meet-
ing was adopted.
The amended motion to approve Tentative Tract Map 31871 subject to conditions
to be reported back to Council at the next regular meeting by staff, with
approval to be effective on the adoption of Ordinance No. 37, was adopted on
the following roll call vote:
AYES: Ruth, R. Ryan, M. Ryan
NOES: Buerk and Dyda
ABSENT: None
Tim Burrell, representing Tentative Tract Map 31397 (Tarr) , requested Council
to reconsider their application at this time. It was moved by Councilman Ryan,
seconded by Mayor Ryan, that Council rescind Ordinance No. 37 and reintroduce
Ordinance No. 32, which included both the Treacy and Tarr properties.
EXECUTIVE SESSION At 10:55 p.m. , on motion of Councilman Ruth,
seconded by Councilman Ryan, Council adjourned
to Executive Session to discuss potential liti-
gation, with the understanding that Council
would not discuss the merits of this particular map (#31397) . Council reconvened
at 11:00 p.m. , with the same members present.
The motion to reintroduce Ordinance No. 32 was withdrawn with permission of the
second.
RES. 74-39 - Following the reading by title of RESOLUTION
CONVEYANCE OF NO. 74-39 OF THE CITY OF RANCHO PALOS VERDES
PARK TO CITY REQUESTING CONVEYANCE OF A COUNTY-OWNED PARK
TO THE CITY OF RANCHO PALOS VERDES, it was moved
by Councilman Dyda, seconded by Councilman
Buerk and unanimously carried, that Council
waive further reading and adopt the resolution.
It was moved by Councilman Dyda, seconded by Councilman Ryan and carried, that
the staff be authorized to take appropriate action to have the sign changed and
make preparation for any ceremony that may be planned attendant to the transfer
of title.
Council indicated a desire to change the name of the park to Rancho Palos Verdes
Park.
POLL. REFORM Following discussion of the summary of the
ACT OF 1974 Political Reform Act of 1974, it was moved by
Councilman Buerk, seconded by Councilman Ryan
and carried, that Council receive and file the
material.
APPROVAL OF WATER Following report by the Planning Director, it
SYSTEM - TRS. was moved by Councilman Dyda, seconded by
NO. 29115 & Councilman Ruth and carried, that Council
NO. 29594 approve the findings of the City Engineeer
that all work has been completed as required

by the Subdivision Water System Agreements, Form A-3, for the two subdivisions
listed herein; and accept the recommendation to release the Subdivision Water
System Agreements, Form A-3, between the City of Rancho Palos Verdes and the
subdivider, and the Bond for Faithful Performance for Tract No. 29115, in the
vicinity of Crest Road and Avenida De Calma, and Tract No. 29594, in the
vicinity of Granvia Altamira westerly of Highridge Road.
APPROVAL OF WATER It was moved by Councilman Dyda, seconded by
SYSTEM - TR. Councilman Ryan and carried, that Council
NO. 28450 approve the findings of the City Engineer that
all work had been completed as required by
the Subdivision Water System Agreement, Form A-2,
for Tract No. 28450 and accept the recommenda-
tion to release the Subdivision Water System Agreement, Form A-2, between the
City of Rancho Palos Verdes and the subdivider for Tract No. 28450.
RES. 74-38 - REGISTER It was moved by Councilman Dyda, seconded by

SUIT RE. City Attorney briefed Council on the suit by
OVERHEAD the City of Los Angeles and certain taxpayers
COSTS FOR of the City of Los Angeles against the County
POLICE SERVICE of Los Angeles and contract cities regarding
the question of charging County administrative
overhead costs for police service.
Following discussion of costs, the City Manager suggested a staff report and
recommendation be submitted for Council consideration.
QUESTIONS FROM THE Byron Blue, 3675 Clif f site Drive, urged Council
AUDIENCE: VIEW to begin a study of fences, unusual construction,
OBSTRUCTIONS trees, shrubs, etc. which create view obstruc-
tions and result in decreased property values.
Planning Director reported a list of proposed
projects of the Planning Advisory Committee
will be submitted to Council at its next regular meeting and includes this
subject.
CONDOMINIUM John McTaggart, 6916 Purpleridge Drive, suggested
CONSTRUCTION requirement that a certified engineer make sound
transmittal determination in condominium construc-
tion.

SCHOOL SITES The Mayor reported attending a School Sites
COM. MTG. Committee Meeting at which some concepts of
financing the acquisition of school sites was
discussed and indicated a report will be sub-
mitted to Council at a later date.
EXECUTIVE SESSION At 12:02 a.m., it was moved by Councilman
Dyda, seconded by Councilman Buerk and carried,
that Council adjourn to an executive session
to discuss legal matters. The meeting recon-
vened at 1:00 a.m., with the same members present.
ADJOURNMENT At 1:01 a.m. , on motion of Councilman Ryan,
seconded by Councilman Ruth and carried, the
meeting was adjourned.
