CC MINS 19740416 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting April 16, 1974 The meeting was called to order at 7:45 p.m. at Ridgecrest Intermediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: Councilman Gunther Buerk Councilman Buerk arrived at 9:10 p.m. and was present throughout the remainder of the meeting. Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, Planning Director Sharon Hightower and Administrative Services Officer David B. Smith. MINUTE APPROVAL It was moved by Councilman Dyda, seconded by Councilman Ryan and carried, that the Minutes of April 2, 1974, be approved as distributed. PUBLIC HEARING City Manager reported that Planning Director C.U.P. NO. 2 had been in contact with applicant, who indi- ENDO. LAB. (1804) cated a desire to withdraw application. Based on the fact that written communication request- ing withdrawal had not yet been received, it was moved by Councilman Dyda, seconded by Councilman Ryan and passed, that the public hearing be continued to the next regular meeting of Council, May 7, 1974, pending receipt of further communication. PUBLIC HEARING Mayor Ryan declared the public hearing opened VARIANCE NO. 1 on a request for a variance to divide an exist- LOT SPLIT - COACH ROAD ing lot at 8 Coach Road into two parcels of (1804) less than minimum required area. Planning Director reported notice of hearing given, with evidence on file, and receipt of four letters in protest. Planning Director reviewed recommendations of Planning Advisor and staff for denial of the request in view of the lack of sufficient information to support items "B" and "C" of the "Request for Hearing." Chris Smith, applicant, submitted photographs and proposed sketches (Exhibits A, B, C, D & E) in support of his request; Roger Venables of South Bay Engineering, representing Mr. Smith, supported feasibility of building from an engineering standpoint; and Donald Leeds, 12 Coach Road, spoke in support of building in that area. Those who spoke in opposition, stressing view obstruction, increase in traffic and noise, street blockage hazards and extreme steep grade of the area were John Pruett, 6 Coach Road, who submitted photographs (Exhibits F, G & H) ; Ron Council 142 April 16, 1974 Eddings, 4 Coach Road; Ken Leeuwenburgh, 7 Coach Road; and Ed Shimko, 28800 Palos Verdes Drive East, an adjacent property owner. A. Dierl, 28689 Roan Road, an engineer, raised several questions regarding construction of the foundation, which were answered by Mr. Venables. There being no further response to testimony, the hearing was declared closed. Following Council discussion, it was moved by Councilman Ryan, seconded by Councilman Dyda, that Variance No. 1 be denied on the basis that items "B", "C", "E" and "F" of the Variance Case had not been met. Ryan NOES: None ABSENT: Buerk ANIMAL CONTROL (10 4) Animal Control Office representatives Archie Quincey, of the Downey Office, and Leslie Mitchell, of the Gardena Office, presented an overview of the total services and existing ordinances on animal control, and commented on the recommenda- tions outlined in a letter from Robert DeJernett, which had been submitted to Council at its March 5, 1974 meeting. Among those speaking in support of more stringent controls were Herbert Beres, 5902 Waukesha Place; Mrs. J. W. Weiss, 5312 Iron Wood; and Yvonne Goppert, 5507 Bayridge Road. Mr. Campbell suggested that the City hire its own Animal Control Officer and establish a $50 fine to owners of stray dogs. Councilman Buerk arrived at this point and was present for the remainder of the meeting. Following further discussion by audience and Council, it was noted by the City Attorney that Council could enforce a City impound fee to help cover the cost of improvements in animal control, and the City Manager commented that this problem will be explored further when Council meets to develop next year's budget. RECESS At 9:40 p.m. , the Mayor declared a five- minute recess. Council reconvened at 10:00 p.m. , with all Council members present. Councilman Buerk introduced a German American Field Service Exchange student who is attending Miraleste High School and who was attending the meeting to. observe local government in operation in the United States. FINAL PARCEL Planning Director reported that the tenta- MAP 4021 tive map for Tract 4021 had been approved by (1410) Council in October of 1973 and was now being submitted for Council approval of the final parcel map. Action on Final Parcel Map 4021 was continued to May 7 for further information on a motion of Councilman Dyda, seconded by Councilman Buerk. Council 143 April 16, 1974 ORD. 26 Councilman Dyda reported that the Condominium CONDOMINIUMS (18 0 4) Subcommittee had met with interested parties and the Planning Director on the Condominium Ordinance and suggested it be presented for adoption. ORDINANCE NO. 26 OF THE CITY OF RANCHO PALOS VERDES RELATING TO RESIDENTIAL CONDOMINIUMS AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title by the City Attorney, first reading having been given on March 5, 1974. It was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously carried, that further reading be waived and Council adopt the ordinance. On roll call vote: AYES: Bue rk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. 32 City Attorney summarized a proposed Ordinance CONDO. APPLI. FOR No. 32 which made provision for the removal of TENT. TR. NO. 31871 Tentative Tracts No. 31871 (Treacy) and AND TENT. TR. NO. 31397 No. 31397 (Tarr) from the moratorium area and (1804) makes possible their applications for conversion to condominiums. ORDINANCE NO. 32 OF THE CITY OF RANCHO PALOS VERDES REMOVING CERTAIN PROPERTY FROM THE EXISTING MORATORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDINANCES NO. 16 AND 16U AS AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES was introduced by title by the City Attorney. Following discussion and minor revision, it was moved by Councilman Ryan, seconded by Mayor Ryan and carried, that further reading be waived and Ordinance No. 32 be passed to second reading. ORD. 33 City Attorney introduced by title ORDINANCE EXCLU. OF NO. 33 OF THE CITY OF RANCHO PALOS VERDES "MAJOR" PROPERTIES REMOVING CERTAIN PROPERTY FROM THE EXISTING (18 01) MORATORIUM ON CERTAIN PERMITS AND MAPS AND AMENDING ORDINANCES NO. 16 AND 16U AS AMENDED BY ORDINANCE NO. 29U OF THE CITY OF RANCHO PALOS VERDES by title and further explained this removed only permits for rebuilding from the moratorium area. Following discussion and minor revision, it was moved by Councilman Dyda, seconded by Councilman Buerk and unanimously passed, that further reading be waived and the ordinance be passed to second reading. ORD. 34 The City Attorney summarized and read by title ENVIRON. ORDINANCE NO. 34 OF THE CITY OF RANCHO PALOS EXCISE TAX VERDES REGARDING COLLECTION OF THE ENVIRONMENTAL (15 01) EXCISE TAX AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE. It was moved by Councilman Buerk, seconded by Councilman Dyda and carried, that further reading be waived and the ordinance be passed to second reading. REQUEST FOR EXEMP. Planning Director reported on the request of FROM MORATORIUM AREA Ken and Shirley Boren for exemption from the (BOREN) (18 01) moratorium area for proposed plans for a tennis club. Ken Boren, applicant, reported having explored easement possibilities for use of Vanderlip Drive for access to the tennis courts. Following discussion of geological questions, it was moved by Councilman Dyda, Council 144 April 16, 1974 seconded by Councilman Ryan and carried, that the request for a tennis court exclusion from the moratorium zone be referred to the Planning Advisory Com- mittee for study and recommendation to the Council. ORD. 35U - PLANNING ORDINANCE NO. 35U OF THE CITY OF RANCHO PALOS ADVISORY COMMITTEE VERDES EXTENDING THE TERM OF THE PLANNING (12 0 5) ADVISORY COMMITTEE, ESTABLISHING ITS FUNCTION, AND AMENDING ORDINANCE NO. l0U AND DECLARING THE URGENCY THEREOF was introduced by title. It was moved by Councilman Dyda, seconded by Councilman Ryan, that further reading be waived and Council adopt Ordinance No. 35U. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None Councilman Buerk requested the record to show Council's appreciation for the many hours and evenings of meeting time spent by the Planning Advisory Committee and for its assistance to Council. ENVIR. EXCISE TAX City Manager summarized agreement between AGREEMENT FOR DEFERRED Herman W. Smith, Jr. and Janice W. Smith for PAYMENTS (SMITH) deferred payments over a period of 5 years of (15 01) the environmental excise tax, and noted the interest rate should be changed to 7% per annum. It was moved by Councilman Dyda, seconded by Councilman Ryan and passed, that Council ratify the agreement and authorize the Mayor to sign on behalf of the City. RES. 74-33 City Attorney read by title RESOLUTION NO. 74-33 REGISTER OF DEMANDS OF THE CITY OF RANCHO PALOS VERDES ALLOWING (1504) CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $115,720.95, DEMAND NUMBERS 307 THROUGH 327. It was moved by Councilman Dyda, seconded by Councilman Buerk and carried, that further reading be waived and the resolution be adopted. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None VEHICLE ALLOWANCE Councilman Dyda inquired as to the status of the (1505) possibility of a city vehicle. FIRST YEAR Following discussion, it was suggested Council ANNIVERSARY consider at a work session plans for organizing a First Year Celebration. MOTORCYCLES (1505) Following discussion, City Attorney agreed to draft an off-street ordinance for Council con- sideration in view of the fire and erosion hazards created by motorcycles operating in Council 145 April 16, 1974 open areas. City Manager suggested obtaining input from motorcyclists since this is a recreational activity, and also that consideration be given to hang gliders. SCAG AIR QUALITY Mayor Ryan reported she had been appointed to TASK FORCE the SCAG Air Quality Control Task Force Com- mittee and noted Councilman Buerk is a member of the Energy Committee. EXECUTIVE SESSION At 11:20 p.m., Council adjourned to Executive Session to discuss a matter of potential liti- gation, on motion of Councilman Dyda, seconded by Councilman Ryan. The meeting reconvened at 12:58 a.m. ADJOURNMENT At 1:00 a.m. , on motion of Councilman Dyda, seconded by Councilman Buerk, the meeting was adjourned to April 20, 1974, 8:30 a.m. , in the City Offices for a work session.
