RANCHO PALOS VERDES CITY COUNCIL
Regular Meeting
March 5, 1974
The meeting was called to order at 7:45 p.m. at Ridgecrest Intermediate School,
28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call
was answered as follows:
PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth,
Robert E. Ryan and Mayor Marilyn Ryan
II/ ABSENT: None
Also present were City Manager Leonard G. Wood, Acting City Attorney Clark Brown,
Planning Advisor Larry Derr, Planning Director Sharon Hightower and Deputy City
Clerk Doris Brown.
MINUTES APPROVAL Councilman Dyda requested a correction on
Page 106 of the Minutes of February 19, 1974,
under the heading Interim Zoning, paragraph 4,
that his motion show the staff requested to
verify ownership and recordation of the Butcher property.
It was moved by Councilman Buerk, seconded by Councilman Dyda, that the Minutes
of the meetings be approved as corrected.
ANIMAL CONTROL Mr. Robert DeJernett presented to Council a
letter containing a set of recommendations
for Animal Control and stressed forced
enforcement, particularly concerning dogs.
City Manager confirmed there is a leash law and requested that this subject be
placed on Council agenda for the second meeting in April and have a representative
from Animal Control present.
PUBLIC HEARING AND ADOPTION Hearing was opened on the proposed Mossbank
MOSSBANK FUTURE ST. ABAND. future street abandonment. The Clerk reported
RES. 74-22 (1408) notice of hearing given, with evidence on file
and no communications received. There being
no response to the call for testimony, the
hearing was closed.
RESOLUTION NO. 74-22 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
ORDERING THE VACATION OF THE SLOPE EASEMENTS AND RIGHTS OF WAY ALONG MOSSBANK
DRIVE NEAR THE INTERSECTION OF GRAYSLAKE ROAD was read by title, further reading
waived, and adopted on unanimous motion of Councilman Dyda, seconded by Council-
man Ryan.
PUBLIC HEARING AND ADOPTION Hearing was opened on the proposed Mossbank
MOSSBANK SLOPE EASEMENT ABAND. slope easement abandonment. The Clerk reported
RES. 74-23 (1408) notice of hearing given with evidence on file
and no communications received. There being
no response to the call for testimony, the
hearing was closed.
Council 115 Mar. 5, 1974
It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously
carried that further reading be waived and Council adopt RESOLUTION NO. 74-23
OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING THE VACATION OF
THE MOSSBANK DRIVE SLOPE EASEMENT, the title having been read.
PUBLIC HEARING Hearing was opened on proposed amendment to
ZONING ORD. AMEND. Zoning Ordinance to allow an endocrinology
ORD. 25 (1801) laboratory as a permitted use on a school
site in the RA zone with special use permit.
The Clerk reported notice given, with evidence
on file, and no communications received.
There was no response to the Mayor's call for testimony.
ORDINANCE NO. 25 OF THE CITY OF RANCHO PALOS VERDES PROVIDING FOR CERTAIN LAND
USES UNDER CONDITIONAL USE PERMITS AND AMENDING THE INTERIM ZONING ORDINANCE AND
ORDINANCES NO. 16 AND NO. 16U OF THE CITY OF RANCHO PALOS VERDES was read by
title. There being no further discussion, the hearing was declared closed. It
was moved by Councilman Dyda, seconded by Councilman Buerk and unanimously carried,
that further reading be waived and Ordinance No. 25 be passed to second reading.
TRAFFIC REGULATIONS City Traffic Advisor Charles Sutton summarized
RES. 74-24 (1503) request for modification of existing stop
regulations on each side of Crest Road from
Hawthorne Boulevard, to and including the
intersection with Crenshaw Boulevard. Fol-
lowing discussion, RESOLUTION NO. 74-24 OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES PROVIDING FOR STOP SIGNS ON CREST ROAD was read by title. It was
moved by Councilman Dyda, seconded by Councilman Ruth and unanimously carried,
that further reading be waived and the resolution be adopted.
TRAFFIC REGULATIONS Mr. Sutton explained basis for recommendation
RES. 74-25 (1503) that signs and markers prohibiting pedestrian
crossing and permitting double turn lanes be
posted at the intersection of Crest Road and
Crenshaw Boulevard. Following reading of
title to RESOLUTION NO. 74-25 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES PROVIDING FOR "NO PEDESTRIAN CROSSING" AND "LEFT TURN" SIGNS AND MARKINGS
AT THE INTERSECTION OF CREST ROAD AND CRENSHAW BOULEVARD, it was moved by Council-
man Ryan, seconded by Councilman Dyda and unanimously carried, that further read-
ing be waived and Council adopt the resolution.
TRAFFIC - SPEEDING John McTaggart indicated that the 25 mph
PROBLEMS speed limit on Hawthorne Boulevard should
be applied to buses, motor homes, etc. , as
well as trucks. Responding to a question
by a representative of the Monte Verde Home-
owners Association regarding speeding on Crest Road, Mr. Sutton indicated enforce-
ment would be the best means of control. Mayor Ryan called attention to the fact
that the Council has a Committee for Law Enforcement and Traffic Safety and indi-
cated that Committee and staff would be willing to work with any homeowners group
to ameliorate these problems. City Manager suggested Council establish a Traffic
and Transportation Committee, possibly include a school representative, Sheriff,
etc. Councilman Ryan volunteered to serve on such a committee. Mayor Ryan asked
the Manager to come back with a specific recommendation.

INTERIM ZONING - ORD. 23 Planning Advisor presented staff report
VIA CAMPESINA AND on properties in the Via Campesina area
UPPER ABALONE COVE (18 01) and the Upper Abalone Cove area proposed
for exclusion from the Moratorium Zone.
The staff recommendation for the Via
Campesina area was that Council:
Retain the subject area in the Moratorium Zone at this time;
The City set this as a priority area for early study as a part
of the General Plan;
Such studies make an early determination of the basic criteria
for its subsequent development;
A specific plan be created for the area pertaining to develop-
ment of better access for the properties and an overall
sewer system; and
II/ Immediate action be taken to determine the ability of emergency
equipment to respond to the respective homes in the area.
Those speaking against the property being removed from the Moratorium Zone
were Ralph Allman; Mrs. Nancy Werner; and William M. Foltz, who submitted a
petition stating it was signed by 24 of the homeowners of the area. Pro-
ponents Richard Meine and Leo Poxon submitted a poll of neighbors' opinions
on lot size and pointed out the development would create a new water system
with fire protection pressure, a sewer system, proper drainage to prevent
erosion, and underground utilities. Truman Tyler requested Council consider
the case favorably. Mr. Husted commented on the lack of water pressure for
the area. The Manager was requested to check on the water service in the area.
Planning Advisor called Council's attention to the Daluiso property, which is
less than 1 acre but was granted a zoning exception prior to incorporation.
Staff recommendation for this property was that:
The subject property be excluded from the Moratorium Zone;
It be required to comply with the City's environmental assess-
ment procedures;
The grading and environmental impact be subject to critical
review by the Environmental Review Subcommittee; and
Such review shall be possible cause for cancellation of this
exclusion.
It was moved by Councilman Ryan, seconded by Councilman Ruth and passed, that
the two staff recommendations be adopted.
Planning Advisor reported on property in the Upper Abalone Cove area, which
has only 2 undeveloped lots, recommending:
Area be removed from the Moratorium Zone;
Any subsequent applications for building be subject to the
environmental procedure; and
Any grading be given a very critical review.
Council indicated its agreement with the recommendation, and it was pointed out
that an exhibit was attached to a proposed ordinance showing this area and one
for the Daluiso property in the Via Campesina area.
ORDINANCE NO. 23 OF THE CITY OF RANCHO PALOS VERDES REMOVING CERTAIN PROPERTY
FROM THE EXISTING MORATORIUM ON BUILDING AND GRADING AND AMENDING ORDINANCES
NO. 16 AND NO. 16U OF THE CITY OF RANCHO PALOS VERDES was read by title. It
was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously
carried, that further reading be waived and the ordinance be passed to second
reading.
CONDOMINIUMS Planning Director briefed Council on
ORD. 26 (1804) establishment of a $250 per acre processing
fee for condominiums. Ordinance 26 was
then introduced by title by the City

Attorney. It was moved by Councilman Ryan, seconded by Councilman Dyda and
unanimously carried, that further reading be waived and ORDINANCE NO. 26 OF THE
CITY OF RANCHO PALOS VERDES RELATING TO RESIDENTIAL CONDOMINIUMS AND AMENDING
THE RANCHO PALOS VERDES MUNICIPAL CODE be passed to second reading.
CONDOMINIUM FEES RESOLUTION NO. 74-26 OF THE CITY COUNCIL OF
RES. 74-26 (180 4) THE CITY OF RANCHO PALOS VERDES FOR ESTABLISH-
ING FEES FOR CONDOMINIUMS AND CONDOMINIUM
CONVERSIONS was introduced by title. It was
moved by Councilman Ruth, seconded by Council-
man Ryan and unanimously carried, that further reading be waived and Council
adopt the resolution.
ARMAGA SPRINGS CONDOMINIUM On motion of Councilman Ryan, seconded by
FINAL MAP TR. 31249 (1412) Councilman Ruth and carried, Council
adopted the findings and approved the
recommendations of the City Engineer as
outlined in his letter of March 4, 1974,
pertaining to approval of final map for Tract No. 31249.
NACKOWSKI CONDOMINIUM Planning Director presented staff report
TENTATIVE TR. 32086 and recommendations regarding the conversion
(1411) of 7 units to a condominium on Armaga Springs
Road. Mr. Nackowski spoke on behalf of his
application. Council expressed concern with
density as a major problem. Planning Advisor indicated application could be denied
at this time and the applicant could re-apply at a later date. On motion of
Councilman Buerk, seconded by Councilman Dyda, Council agreed to deny Tentative
Tract 32086.
RECESS At 10:40 p.m. , the Mayor declared a five
minute recess. The meeting reconvened at
10:50 p.m. with the same Council members
present.
BIKEWAYS (112) Mr. Alfred P. Weber presented a report on
the County-wide concept plan of bikeways and
pointed out to Council that SCAG and the
Federal government are most supportive of
developing bikeway trails. Jeane Burke reported on available funding, and Mayor
Ryan read a statement of Jacki Bacharach, representing the League of Women Voters,
supporting the Bikeways Plan and urging Council to adopt the Planning Advisory
Committee's recommendation. City Manager noted funds available from SCAG and
other sources and recommended that Council adopt the plan, submit it to the
County Road Department and request cost estimates.
It was moved by Councilman Dyda, seconded by Councilman Ruth and carried, that
the Bikeways Plan .be adopted and consideration be given to revising the Plan
later on the basis of the General Plan studies.
MIRALESTE PARK There being no action required to confirm
DISTRICT (12 01) the appointment to fill the vacancy on
Miraleste Recreation and Park District

Board, it was moved by Councilman Buerk, seconded by Councilman Dyda and
carried, that the correspondence be received and filed.
BUSINESS LICENSE City Manager opened discussion on business
ORD. 27 (202) licenses and reviewed proposed ordinance
with Council. John McTaggart commented on
the requirement for contractors. Stu Avera
of Southern California Edison Company
requested exemption of utilities, and the City Manager indicated that it was not
the intent that public utilities be included.
ORDINANCE NO. 27 OF THE CITY OF RANCHO PALOS VERDES LICENSING THE TRANSACTION
AND CARRYING ON OF CERTAIN BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND
OCCUPATIONS FOR THE PURPOSE OF RAISING MUNICIPAL REVENUE, PROVIDING A PENALTY
FOR VIOLATION THEREOF, RENUMBERING CERTAIN SECTIONS AND AMENDING THE MUNICIPAL
CODE was introduced by title. It was moved by Councilman Dyda, seconded by
Councilman Buerk and unanimously carried, that further reading be waived and
the ordinance be passed to second reading.
Council requested that consideration be given to possible revision to assure
that funds from Classifications G & H be placed in Environmental Excise Fund;
to exempt utilities; and to expand Section on Professions to include others
not listed. Staff is to prepare amendment to ordinance accordingly.
DOOR-TO-DOOR Following a discussion of an ordinance
SOLICITATION (2 02) draft prohibiting door-to-door solicitation,
it was moved by Councilman Ruth, seconded
by Councilman Ryan and carried, that action
be delayed until further study has been
completed.
LIBRARY DISTRICT Council received letter from the Palos
ANNEXATION (1001) Verdes Library District requesting the
southeastern portion of the City be included
in the Library District. It was moved by
Councilman Buerk, seccnded by Councilman
Dyda and passed, that Council approve the proposal to annex this area to the
Library District.
INTER-CITY Council indicated its desire to postpone
TRANSPORTATION (1505) action on the invitation to join the Inter-
City Transportation Committee until budget
consideration.
ORD. 22 - FLOOD ORDINANCE NO. 22 OF THE CITY OF RANCHO
INSURANCE PROGRAM (6 0 4) PALOS VERDES REGULATING BUILDINGS IN FLOOD
HAZARD AREAS, AMENDING THE BUILDING CODE
AND THE RANCHO PALOS VERDES MUNICIPAL CODE
was read by title, first reading having
been given February 19. It was moved by Councilman Dyda, seconded by Councilman
Ryan, that further reading be waived and the ordinance be adopted. On roll call

FEDERAL LAND Councilman Ruth reported on contacts made
NIKE SITE (110 9) regarding possible acquisition of the Nike
site. City Manager was requested to prepare
a report summarizing the present status.
Mayor Ryan reported meeting with Peat, Marwick & Mitchell, Councilman Ruth and
City Manager, and EDA funds will be available for agencies acquiring excess Nike
sites.
RES. 74-21 - REGISTER It was moved by Councilman Dyda, seconded
OF DEMANDS (303) by Councilman Ryan, that further reading be
waived and Council adopt RESOLUTION NO. 74-21
OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES ALLOWING CERTAIN CLAIMS AND
DEMANDS IN THE SUM OF $207005.62, DEMAND NUMBERS 232 THROUGH 269, introduced by
title. On roll call vote:

NOES: None
ABSENT: None
SCAG ENERGY COM. Councilman Buerk reported that he has been
appointed to SCAG Energy Committee.
COASTAL FENCES (10 9) Councilman Buerk commented that the County
is now interested in taking action concern-
ing the coastal fences and suggested Council
appoint a committee to meet with the County,
volunteering to work on such a committee. The Mayor indicated she would work with
him and the City Attorney in this regard.
ADJOURNMENT At 1:00 a.m. , on motion of Councilman Ryan,
seconded by Councilman Ruth, the City Council
adjourned to 7:30 p.m. , Wednesday, March 6,
1974, in the City Offices for Executive Session
regarding Citizens Advisory Committee.
