CC MINS 19740219 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting February 19 , 1974 The meeting was called to order at 7: 45 p.m. at Ridgecrest Inter- mediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, Planning Advisor Larry Derr and Deputy City Clerk Doris Brown. MINUTES APPROVAL Council considered Minutes of meetings dated February 5, 1974 and February 12, 1974. Correction was made of the Minutes of February 12, 1974 , page 103, second paragraph under Interim Zoning to read Councilman Buerk moved the motion be amended. The Minutes of the two meetings were then approved, as corrected, on motion of Councilman Dyda, seconded by Councilman Buerk. PUBLIC HEARING Hearing was opened on the proposed AND ADOPTION adoption of a Recreation Element of RECREATION ELEMENT the General Plan of the City. The RES. 74-19 Clerk reported notice of hearing given (701) with evidence on file, and no communi- cations received. Council then heard a review of the Council study of the proposed Element by the City Manager and answered questions from Mike Kochan of Palos Verdes Properties regarding the timing of the adoption and some site locations of park areas. In response to a question from Lola Field, the Mayor indicated staff will be pleased to work with her and others in the Portu- guese Bend area to include input of horse owners in the develop- ment of the General Plan. There being no response to the call for further testimony, the hearing was closed. RESOLUTION NO. 74-19 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ADOPTING THE RECREATION ELEMENT OF THE RANCHO PALOS VERDES GENERAL PLAN was presented by title , further reading waived, and adopted on unanimous motion of Councilman Dyda, seconded by Councilman Ryan. EDISON FRANCHISE Council considered the application of (605 x 1601) Southern California Edison Company for an electric franchise in the City for an indeterminate period pursuant to the Franchise Act of 1937, which was filed with the City Council on December 4, 1973. The meeting reconvened at 9 : 50 p.m. with the same Council members present. PAC MEMBERSHIP On motion of Councilman Dyda, EXTENDED (1205) seconded by Councilman Ryan and carried, the office, function and membership of the Planning Advisory Committee was extended for 60 days. CONDOMINIUMS (1804) City Manager and the Planning Advisor presented a status report on the Con- dominium Study Report. Tim Burrell, representing Armaga Springs, Ltd. , urged Council to consider action on their conversion application in view of the fact they are facing foreclosure on February 27. City Attorney commented on the case and agreed to review docu- ments remaining to be submitted and draft a general ordinance on the subject, using the Committee report for guidance. Council agreed to review the Armaga Springs situation at its February 26 study session with intent of taking action at that meeting. SURPLUS SCHOOL SITES The Mayor summarized the results of a (14 01) meeting held with two members of the School Board prior to January 31 at which legal considerations regarding three surplus sites in the City were discussed. The City indi- cated its willingness to work with the School District in utiliza- tion of the sites and the possibility of a joint powers agreement whereby the School District would retain title to the land and the City would utilize the land for recreation purposes . The Mayor and Councilman Ruth will work on aspects of acquisition of the school sites, and the Mayor and Councilman Ryan will work on development of uses. MIRALESTE PARK City Attorney indicated he would sub- DISTRICT (12 01) mit a memorandum to Council outlining specific responsibilities of the City as the supervising authority to this park and recreation district. Council requested City Manager or City Attorney to make contact to clarify if the Miraleste Recreation and Park District is aware of a new law which provides authority to make their own appointment if the vacancy occurs in certain time limits, and report back to Council March 5 . ORD. 22U - FLOOD The Manager explained the Federal Flood INSURANCE PROGRAM Hazard Insurance Program, and it was (604) moved by Councilman Ruth, seconded by Councilman Dyda, that further reading be waived and Council adopt ORDINANCE NO. 22U OF THE CITY OF RANCHO PALOS VERDES REGULATING BUILDINGS IN FLOOD HAZARD AREAS, AMENDING THE BUILDING CODE AND THE RANCHO Council 107 Feb. 19 , 1974 PALOS VERDES MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF, the title of which had been read. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. 22 - FLOOD ORDINANCE NO. 22 OF THE CITY OF RANCHO INSURANCE PROGRAM PALOS VERDES REGULATING BUILDINGS IN (604) FLOOD HAZARD AREAS, AMENDING THE BUILD- ING CODE AND THE RANCHO PALOS VERDES MUNICIPAL CODE was presented for first reading. It was moved by Councilman Dyda, seconded by Council- man Ryan and unanimously carried, that further reading be waived and the ordinance be passed to second reading. SCHOOL BUS Council received application of Cali- SERVICE (605) fornia Sightseeing Tours, Inc. before the Public Utilities Commission for passsenger service to schools in the PVP Unified School District. The City Manager was asked to check into the question of franchising. ORD. 21 - ABANDONED It was moved by Councilman Buerk, VEHICLE ABATEMENT seconded by Councilman Ruth, that (17 01) further reading be waived and Council adopt ORDINANCE NO. 21 OF THE CITY OF RANCHO PALOS VERDES REGULATING ABAN- DONED AND INOPERATIVE VEHICLES DECLARING THEM TO BE A PUBLIC NUISANCE AND SETTING FORTH PROCEDURES FOR THE ABATEMENT OF SUCH NUISANCES, AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE, the title of which had been read. Ryan NOES: None ABSENT: None ORD. 18 - CONFLICT ORDINANCE NO. 18 OF THE CITY OF OF INTEREST (1202) RANCHO PALOS VERDES ADOPTING GUIDELINES FOR IMPLEMENTATION OF THE GOVERNMENTAL CONFLICT OF INTERESTS ACT, AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE, was read by title. Ryan NOES: None ABSENT: None ORD. 24 - PERMIT Following a report by the City FEES (201) Manager, Council indicated its desire to increase permit fees . ORDINANCE NO. 24 OF THE CITY OF RANCHO PALOS VERDES AMENDING THE BUILDING, ELECTRICAL, PLUMBING AND MECHANICAL CODES RELATING TO PERMIT AND OTHER FEES, was read by title. It was moved by Mayor Ryan, seconded by Councilman Dyda and carried, that further reading be waived and the ordinance be passed to second reading. ORANGE CRATE It was moved by Councilman Dyda, DERBY (305) seconded by Councilman Buerk and carried, that the request from PVP Jaycees to close Indian Peak Road, Crenshaw to Crossfield Drive, 7 a.m. to 5 p.m. , Sunday, June 2, for third Annual Orange Crate Derby be approved. MIRALESTE TRAFFIC Responding to a question by Council- (1503) man Buerk, the Mayor briefed Council on findings of an on-site visit to the Miraleste schools area and reported further trimming, lighting and enforcement of traffic regulations has been studied and is in progress for this particular area. SIGNS Councilman Ryan urged early considera- tion of a sign ordinance. Councilman Ruth suggested study begin on "Entrance to the City" signs. Council 109 Feb. 19 , 1974 CITY NAME Councilman Ryan commented on citizen CHANGE action to change the name of the City. BIKEWAYS Mayor Ryan called attention to the Bikeways Plan submitted to Council and requested this item be discussed Febru- ary 26 and action scheduled for March 5. ICMA COMMITTEE It was moved by Mayor Ryan and seconded (1101) by Councilman Dyda and carried, to authorize the Manager to accept member- ship on an International City Manager's Association committee and approve travel to San Francisco and Washington, D. C. RAPID TRANSIT It was reported that a letter had been (1505) received from Rolling Hills Estates asking the City for an endorsement or a recommendation that the Rapid Transit District include Palos Verdes Peninsula cities in a study to deter- mine feasible transportation alternatives . It was moved by Mayor Ryan, seconded by Councilman Buerk and carried, that staff submit such a letter to the Rapid Transit District indicating the City' s support of such a study and endorsing the efforts already made by the City of Rolling Hills Estates. NEWSLETTER Council requested City Manager to (1107) explore costs and alternatives in pro- ducing and distributing a newsletter. Eleanore Wiedmann complimented Council on their team effort and urged that open communication be maintained. FASHION CENTER (103) Inasmuch as Rolling Hills Estates is considering the relocation of roads as a next possible step toward the develop- ment of a fashion center, Council felt it appropriate for Councilman Dyda and Councilman Ruth to meet with the City Manager or the City Attorney to plan a meeting with Rolling Hills Estates . NIKE SITE (110 9) City Manager summarized progress on the possible acquisition of the Nike site, and Mayor Ryan reported a meet- ing set for February 22 with Congress- man Bell and Nike staff to explore the possibilities for the City. Council was requested to submit comments to the City Office by February 21. Council 110 Feb. 19 , 1974 EXECUTIVE SESSION At 12: 00 a.m. , the Council adjourned to Executive Session to discuss potential litigation, reconvening at 12 : 58 a.m. with the same members present.
