CC MINS 19740122 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Adjourned Regular Meeting January 22 , 19 7 4 The meeting was called to order at 7 :45 p.m. at Ridgecrest Inter- mediate School, 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows : PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan and Mayor Marilyn Ryan ABSENT : None Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, and Deputy City Clerk Doris Brown. AUDIENCE QUESTIONS Responding to the Mayor' s call ROAD HAZARD (1503) for questions from the audience on items not appearing on the agenda, Earle R. Miller of 6966 Verde Ridge Road reported a run-away truck in the cul de sac of Verde Ridge Road which resulted in a tremendous loss to his home. The City Manager noted this situation is already under study and a report to Council will be made on February 5. ORD. 14 - ENVIRON. ORDINANCE NO. 14 OF THE CITY OF EXCISE TAX (15 01) RANCHO PALOS VERDES TAXING THE CONSTRUCTION AND OCCUPANCY OF RESIDENTIAL DWELLING UNITS, COM- MERCIAL AND INDUSTRIAL BUILDINGS, ESTABLISHING AN ENVIRONMENTAL EXCISE TAX FUND AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented by title for adoption, first reading having been given on January 2 , 1974. Following a summarization of the Ordinance by the City Attorney, Council heard the following speak in opposition to the Ordinance: J. P. Jones; W. H. Winston, Jr. ; John Treacy, representing White- stone Project; Meredith K. Eick; Mrs. Jack Atkinson; and Stanley Wilson. Supportive comments were heard from Dr. Wempen and Janet Kelbley, and a letter in support read from the League of Women Voters. It was moved by Councilman Buerk, seconded by Councilman Dyda that further reading be waived and Ordinance 14 be adopted. On roll call vote: AYES : Buerk, Dyda, Ruth, R. Ryan, M. It was moved by Councilman Buerk, seconded by Councilman Ryan, that further reading be waived and Ordinance No. 14U be adopted as an urgency ordinance. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. 17U - BLDG. CODE ORDINANCE NO. 17U OF THE CITY OF AMEND. (CERT. OF OCCUP. ) RANCHO PALOS VERDES PROVIDING (2 01) FOR CERTIFICATES OF OCCUPANCY, AMENDING THE BUILDING CODE AND THE RANCHO PALOS VERDES MUNICIPAL CODE, AND DECLARING THE URGENCY THEREOF was introduced by title and summarized by the City Attorney. Council heard supportive comments by John McTaggart. It was moved by Councilman Dyda, seconded by Councilman Ryan, that further reading be waived and the ordinance adopted as an urgency ordinance. On roll call vote : AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. 17 - BLDG. CODE ORDINANCE NO. 17 OF THE CITY OF AMEND. (CERT. OF OCCUP. ) RANCHO PALOS VERDES PROVIDING FOR (2 01) CERTIFICATES OF OCCUPANCY, AMENDING THE BUILDING CODE AND THE RANCHO PALOS VERDES MUNICIPAL CODE was presented for first reading. It was moved by Councilman Buerk, seconded by Councilman Dyda, that further reading be waived and the Ordinance be passed to second reading. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None RECESS At 9 p.m. , the Mayor declared a five minute recess. The meeting reconvened at 9 :07 p.m. with the same Council members present. RES. 74-5 Councilman Dyda reported that the FASHION CENTER environmental impact appraisal for E.I.R. (10 3) the proposed Fashion Center in Rolling Hills Estates will be avail- able prior to the scheduled hearing of January 23. Following the full reading of RESOLUTION NO. 74-5 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES STATING ITS OPPOSITION TO THE ROLLING HILLS FASHION CENTER AS PRESENTLY PROPOSED, it was moved by Councilman Dyda, seconded by Councilman Ryan and unani- mously carried, that Resolution 74-5 be adopted. Council 091 Jan. 22 , 1974 On motion of Mayor Ryan, seconded by Councilman Ryan and carried, Councilman Dyda, Councilman Buerk, the City Attorney, and a repre- sentative of the consulting firm, Kennard and Silvers , were designated to present official testimony at the hearing. SCHOOL SITES (14 01) On motion of Councilman Buerk, seconded by Councilman Dyda and unanimously carried, Mayor Ryan was appointed to represent the City at the January 31 meeting of the School District to indicate the City' s need and support in working toward utilization of the unused school sites for recre- ational purposes for the residents of the City and the entire Peninsula. RECREATION AND The City Manager and the City PARKS ELEMENT/ Attorney discussed with the GENERAL PLAN (701) Council the procedures for develop- ing and adopting an Interim Recre- ation and Parks Element as a part of the City' s General Plan. It was moved by Councilman Buerk, seconded by Councilman Dyda and carried, that the Parks and Recreation Council Committee review the amended Interim Recreation Element and report to Council on February 5, with the intent that a public hearing will be scheduled February 19. CITIZENS ADVISORY Council discussed procedures for COMMITTEE - GENERAL establishing a Citizens Advisory PLAN (701) Committee, and it was agreed that Councilman Ruth and Councilman Dyda will work with the City Manager, temporary advisor, until a City Planner is on staff, to develop a time schedule, clarify and re-state the goals and objectives of such committee at the next Regular meeting of the Council. Councilman Dyda requested the City Attorney to pursue possible state legislation with regard to adoption of the General Plan. VERDE RIDGE Jack Spahn read a motion presented ROAD ACCIDENT to the Board of Supervisors regard- (1503) ing the Verde Ridge Road accident wherein a review of subdivision requirements was requested. A number of other streets of similar construction were discussed, and it was indicated to Mr. Spahn that the matter was discussed earlier and is to be reported upon on February 5. PORTUGUESE BEND - Councilman Ryan suggested that the SPEED LIMIT Portuguese Bend area have a reduced speed limit of possibly 25 mph, especially through the slide area. STREET MAINTENANCE Councilman Dyda commented on the reflectors being covered on Monte Malaga due to slurry seal. Council 092 Jan. 22 , 1974 PALOS VERDES SOUTH Councilman Ryan requested and it UNDERGROUNDING (16 01) was agreed that the City Manager, Councilman Ryan and Councilman Buerk would meet with Stu Avera of Southern California Edison regarding undergrounding, Palos Verdes South. PLAN. ADV. COM. In response to a question by Councilman Buerk regarding the sub- committee on Parks and Recreation established by the Planning Advisory Committee, John McTaggart and Eleanore Wiedmann reported that it had been created to explore lot averaging, density, grades , etc. to make recommendation to the Council and not meant to be in conflict with the Council Committee. Mayor Ryan noted that the Council will be reviewing the function of the Planning Advisory Committee within the next month and thought it might be appropriate for the Planning Advisory Committee to sub- mit to the Council a summary of how they see their role and future function. ORD. 14 - PORTUGUESE Tom Major of Portuguese Bend BEND AREA inquired as to the application of Ordinance 14 in the case where a home was burned during the fire of last spring and the owner wished to rebuild. The City Attorney indicated that unless the Council made an excep- tion for that type of hardship case, the tax would apply to all new dwellings. COASTAL COMMISSION In response to Councilman Dyda' s expression of concern regarding studies by the Coastal Zone Com- mission and their effect on the City, Mayor Ryan noted the Planning Director will follow closely the Commission' s activities , but mean- while the City Manager should make contact and obtain a copy of the Coastal Commission' s schedule.
