CC MINS 19740115 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting January 15, 1974 The meeting was called to order at 7 : 45 p.m. at Ridgecrest Inter- mediate School , 28915 Northbay Road. Following the Pledge of Allegiance to the Flag, roll call was answered as follows : PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan and Mayor Marilyn Ryan II/ ABSENT: None Also present were City Manager Leonard G. Wood, City Attorney Glenn Watson, Planning Advisor Larry Derr and Deputy City Clerk Doris Brown. MINUTES APPROVAL Council considered Minutes of meetings dated December 29 , 1973 , January 2 , 1974 and January 7 , 1974. Correction of the December 29 , 1973 Minutes to indicate that it was an Adjourned Regular Meeting and the misspelling of a name in the Minutes of January 2 , 1974 , Page 76 , were requested as clerical errors. On Page 77 in the Minutes dated January 2 , 1974, under the item entitled INTERIM DEVELOPMENT PERMIT NO. 4, the action was restated as follows: "Following a discussion of possible actions on Interim Development Permit No. 4 , it was ruled by Mayor Ryan that this case would be referred to the staff for administrative action under the procedures being developed. " The Minutes of the three meetings were then approved as corrected on motion of Councilman Dyda, seconded by Councilman Ryan. AUDIENCE QUESTIONS Responding to the Mayor's call ZONING AND SCHOOL for questions from the audience DISTRICT on items not appearing on the agenda were Mr. J. R. Pagett of 6325 Tarragan Road and Mr. and Mrs. John M. Ivancich of 1757 El Roy Road, San Pedro. Mr. Pagett questioned the Council' s intent to include the remaining lots of Upper Abalone Cove in the moratorium area, and it was agreed that further study might indicate the need to delete some areas. Mr. and Mrs. Ivancich were directed to the School District in regard to having their area incorporated in the Palos Verdes School District. SOUTHERN CALIFORNIA Following a presentation by Ray ASSOCIATION OF Remy, Executive Director of the GOVERNMENTS 1102 Southern California Association of Governments , it was moved by Councilman Buerk, seconded by Mayor Ryan and carried, that the City of Rancho Palos Verdes join SCAG. Council 083 Jan. 15, 1974 SEWERS Mr. Gob s ter and Mr. Sugita answered questions of Council regarding the Health Officer' s report on unsewered areas in the City. Mayor Ryan requested that copies of the pamphlet on maintenance be forwarded to the City. ORD. 14 - ENVIRONMENTAL ORDINANCE NO. 14 OF THE CITY OF RANCHO EXCISE TAX 1501 PALOS VERDES TAXING THE CONSTRUCTION AND OCCUPANCY OF RESIDENTIAL DWELLING UNITS, COMMERCIAL AND INDUSTRIAL BUILD- INGS, ESTABLISHING AN ENVIRONMENTAL EXCISE TAX FUND AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented, first reading having been given January 2, 1974. Following an explanation and summarization of the Ordinance by the City Manager and the City Attorney, Council heard comments in opposi- tion from the following: Richard Wirth, representing the Building Industry Association of California, Inc. ; Kelly Herold, representing Westfield Development Co. ; John Treacy, representing the Whitestone Project; Ray DiPietro; Jack Spahn; Mrs. Herman Smith; Richard Meine; Leo Poxon; J. P. Jones; George Perkovich; John Crossley; Peter Lacombe; and Walt Keusder. Opponents noted the Ordinance would provide a hard- ship on those who have construction already started or sold; the lack of sufficient notice to plan for the payment of this assessment; to its retroactive aspects; and to the fact that it does not affect everyone equally. J. R. Pagett, Realtor, noted plenty of notice given. The Palos Verdes Chamber of Commerce requested by letter a delay of one month. John McTaggart spoke in favor of the Ordinance. Council discussed the points made, a possible delay of two weeks based on Councilman Ruth' s suggestion, and possible changes that could be made by legislative classification. It was moved by Councilman Dyda, seconded by Councilman Buerk, that the Council defer action for one week. AYES: Buerk, Dyda, R. Ryan, M. Ryan NOES: Ruth (desired a two-week delay for review) ABSENT: None Mayor Ryan pointed out that normally an adjourned meeting is not held in a school, so if any member of the audience should plan to attend the meeting on January 22 , they should verify the location of the meeting with the City Offices. RECESS At 9 : 45 p.m. , the Mayor declared a five minute recess. The meeting reconvened at 10 p.m. with the same Council members present. IMPACT ASSESSMENTS ON The City Manager presented report INTERIM DEVELOPMENTS dated January 15 , 1974, outlining 1803 Environment Assessment procedure under Ordinance No. 16U and proposed questionnaire, which will be available from the City Offices , the Lomita County Building Department, and the Los Angeles Regional Planning Office. John Alden suggested some changes regarding views; Walt Keusder requested timetable; R. I. Yoshimura noted he had lot split about to expire and would need an extension; Charles R. Harry Palmer for set- back modification to 15 feet from the required 20 feet frontyard to construct a new carport with a straight-in drive, it was moved by Councilman Buerk, seconded by Councilman Dyda and carried, to deny Plot Plan No. 4. PLOT PLAN Acting on Planning Advisory Com- NO. 5 mittee recommendation regarding 1803 Plot Plan No. 5, application of Mr. and Mrs. Frank Vidovich for modification to 20 feet frontyard and 5 foot highway widening set- II/ back requirement, it was moved by Councilman Dyda, seconded by Councilman Ryan and carried, to approve Plot Plan No. 5. PLOT PLANS - Noting that the staff had brought GENERAL the first plot plans to Council for information and orientation, the Mayor commented that future plans would be considered administratively as was the normal practice. PERFORMANCE BOND - It was moved by Councilman Dyda, TRACT 29300 seconded by Councilman Ryan and 1409 carried, that the Council accept the City Engineer's recommendation that Council find work on water system for Tract 29300 completed as indicated in report dated 12/19/73 and reduce General Insurance Company of America Performance Bond 948062 from $20 ,000 to $5 ,000 . RES. 74-3 , Acting on the City Engineer's STORM DRAIN - recommendation, it was moved by TRACT 28053 Councilman Dyda, seconded by 604 Councilman Ruth and carried, to approve work and accept Private Drain No. 835 in Tract No. 28053 for public use and cancel Western Casualty and Surety Company Performance Bond. No. 356890 in amount of $52 ,000. It was moved by Councilman Ruth, seconded by Councilman Buerk and unanimously carried, that Council adopt RESOLUTION NO. 74-3 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, REQUEST- ING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS AND DRAINAGE SYSTEM KNOWN AS PRIVATE DRAIN NO. 835, IN THE CITY OF RANCHO PALOS VERDES FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZING THE TRANSFER AND CONVEYANCE THEREOF. RES. 74-4 , Acting on the City Engineer' s STORM DRAIN - recommendation, it was moved by TRACT 29300 Councilman Buerk, seconded by 604 Councilman Ryan and carried, to approve work and .accept for public use Private Drain No. 1062 in Tract 29300 and cancel General Insurance Company of America Performance Bond No. 948061 in the amount of $11,000. Council 086 Jan. 15, 1974 It was moved by Councilman Dyda, seconded by Councilman Ryan and unanimously carried, that Council adopt RESOLUTION NO. 74-4 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES , CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS AND DRAINAGE SYSTEM KNOWN AS PRIVATE DRAIN NO. 1062 , IN THE CITY OF RANCHO PALOS VERDES FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZING THE TRANSFER AND CONVEYANCE THEREOF. FASHION CENTER Council scheduled a study session E.I.R. for January 19 , 1974 , to discuss 103 a presentation on the proposed fashion center at Rolling Hills Estates ' hearing scheduled January 23 . RES . 74-2 - RESOLUTION NO. 74-2 OF THE CITY REGISTER OF DEMANDS COUNCIL OF THE CITY OF RANCHO 1504 PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM of $5152 . 38 DEMAND NUMBERS 181 THROUGH 193 was introduced by title, with the City Manager noting that Demand No. 192 had been voided. It was moved by Councilman Dyda, seconded by Councilman Ryan that further reading be waived and the resolution be adopted on roll call vote: AYES: Buerk, Dyda,• Ruth, R. Ryan, M. Ryan NOES : None ABSENT : None CEREMONIAL TREE Mayor Ryan reported that the tree PLANTING planting ceremony honoring Dorothy LeConte, Gordon M. Curtis , Jr. , and Frederick W. Hesse has been scheduled at 10 a.m. , February 2 , at Palos Verdes Park. ABALONE COVE Mayor Ryan moved, Councilman BEACH ACQUISITION Buerk seconded and the motion 109 carried, that a resolution be drafted in support of the Abalone Cove Beach Acquisition, to be communicated to Supervisor Hayes. COASTAL FENCES Councilman Buerk recommended that further discussion take place at the next Executive Session of the Council regarding the coastline fence issue. ABANDONED VEHICLE Councilman Buerk requested that ABATEMENT abandoned vehicle abatement be placed on the next Council agenda, with estimates. POSTAL SERVICES Councilman Buerk reported 57 per- cent of the residents responded in favor of possible zip code change for Rancho Palos Verdes eastern side in response to Postal Services questionnaire, and the Department may recommend a new Zip Code for the entire City. Council 087 Jan. 15 , 1974 SOUTH BAY Councilman Buerk reported on the CORRIDOR STUDY South Bay Corridor Study which 1505 will cover the South Bay area and will review proposed freeway and recommended alternatives. _ . _ - _ - - - - _ - _ -_ - I : . It was agreed the cost of all phases should be reviewed, the City Attorney should review and the item be placed on the agenda for the next Regular Meeting of the Council. STREET MAINTENANCE Councilman Ruth inquired about repairs being done on Palos Verdes Drive South, and the City Manager indicated a report will be given to the Council. Councilman Dyda reported reflector buttons on Monte Malaga being covered with slurry seal. PRIVATE SCHOOL Councilman Dyda asked the City USE Manager to contact the Board of Directors of Marymount High School regarding the leasing of an unused building to a doctor for research. SALES TAX SUIT Councilman Ryan requested the City Attorney and the City Manager to read and present a report on the Baldwin Park sales tax lawsuit at the next meeting. ADJOURNMENT At 12 : 35 a.m. , on motion of Councilman Ryan, seconded by Councilman Ruth, the City Council adjourned to 9 a.m. , Saturday, January 19 , 1974, in the City Offices.
