PLANNING ADVISORY COMMITTEE
November 27, 1973
The adjourned regular meeting of the City Council was called to order at the City
Offices, 31244 Palos Verdes Drive West, at 7:45 p.m. by Mayor Marilyn Ryan. Roll
call was answered as follows:
PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth,
Robert Ryan and Mayor Marilyn Ryan
ABSENT: None
Also present were Acting City Manager Lee Weber, Assistant City Attorney Tom Winfield
and Deputy City Clerk Doris Brown.
MINUTES APPROVAL Council approved as submitted Minutes of the
Adjourned Regular Meeting of November 19, 1973,
the Regular Meeting of November 20, 1973, and
the Adjourned Regular Meetings of November 23, 24, 25, 1973, on motion of Councilman
Buerk, seconded by Councilman Ryan and carried.
RES. 55 - OUTSIDE LIGHTING The City Attorney read in full, RESOLUTION
1405 NO. 55 OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES SUPPORTING ENERGY CON-
SERVATION DURING THE HOLIDAY SEASON. The Resolution was adopted on unanimous
motion of Councilman Buerk, seconded by Councilman Ryan.
PLANNING ADVISORY COMMITTEE The City Council meeting was declared recessed
CONVENES MEETING for the convening of the Special Meeting of
the Planning Advisory Committee by the Chair-
man, Eleanore Wiedmann, who thereupon called
the roll with the following members present: Lou Rosenberg, John McTaggart, Robert
Gruhn, Byron Blue, Robert Marohn, and Ann Shaw, with none absent.
RECREATION ELEMENT, The members of the City Council and Planning
GENERAL PLAN 701 Advisory Committee then convened in joint
session to study and consider a draft of a
proposed Recreation Element of the General Plan
and to discuss the Quimby Act and its possible use by the City.
It was noted by the City Attorney that an ordinance enacting the provisions of the
Quimby Act cannot be adopted by the City until the adoption of a General Plan; that
the Courts, however, have upheld the right of a City to impose a fee or tax on new
development on a uniform basis, such as square footage, number of bedrooms, etc. ,
a portion or all of which could be used for recreation; that the enactment of
such provision should contain a statment of the overall population of the Peninsula
and what the park demands are.
The members of the City Council and Planning Advisory Committee discussed in depth
the various aspects of the drafted Recreation Element, the Quimby Act ordinance,
and an interim environmental tax, which could be imposed either on issuance of
building permit or upon occupancy. Formation of a Four-City park district, or
district covering other areas were discussed, as well as the types of recreation
needs that are usual and others that should be considered such as open space, canyon
and ocean views, etc. The City Attorney commented that the City Council might
prefer having construction and grading rights only, rather than fee dedication, so
that developers could not build upon canyons in some cases, and that this might be

considered the same as dedication for park, or as credit toward the park dedication
requirement.
It was agreed that it would be desirable to have an across-the-board occupancy tax
with a single rate and that Councilman Buerk should work with the Planning Advisor
to refine the Recreation Standards on page 2 of the drafted Element, and that open
space should be considered separately from this Element.
PLANNING ADVISORY COMMITTEE On motion duly made, seconded and carried,
ADJOURNMENT the Special Meeting of the Planning Advisory
Committee was adjourned at 10:20 p.m.
EXECUTIVE SESSION At 10:22 p.m. , the City Council adjourned
to Executive Session to discuss the City
Manager Recruitment Program, on motion of
Councilman Dyda, seconded by Councilman Buerk and carried. The meeting reconvened
at 11:45 p.m. with the same Council members present.
ADJOURNMENT At 11:47 p.m. the City Council on motion of
Councilman Buerk, seconded by Councilman
Ruth and carried, adjourned the meeting to
December 1, 1973 at 9:00 a.m. in the City Offices.
