CC MINS 19760203 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting February 3, 1976 The Mayor called the meeting to order at 7:43 p.m. at the Palos Verdes Peninsula Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, F. D. Ruth, Robert Ryan, and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, City Attorney Pat Coughlan, Planning Director Sharon Hightower, Administrative Services Officer George Wunderlin, Public Works Director Dennis Pikus, Community Services Officer Tom Bandy, and Deputy City Clerk Dee Krebs. AUDIENCE QUESTIONS - Mr. Melvin Hughes, 28017 San Nicolas Drive, ANTENNAE HEIGHT representing the RPV Amateur Radio Club, RESTRICTIONS requested revision of the Development Code (1802) concerning height restrictions for antennae, and presented proposed revisions to Council. It was the consensus of Council to refer the matter to the Planning Commission for further study. Council also directed a letter be sent to the FCC for assignment of special call letters for the radio club in honor of the Bicentennial year, on motion of Councilman Ruth, seconded by Councilman Dyda, and carried. CIVIL LIABILITY Dr. David Rabinov, 2 Surrey Lane, asked (902) Council to direct letter to Governor Brown, State Senator Stevens and Assemblyman Beverly, to request their assistance in reform of present tort system in cases of civil liability. Following discussion that the term "panel of experts" contained in the sample letter be expanded to include public members, it was moved by Councilman Ruth, seconded by Councilman Dyda, and carried, that such a letter be sent. WAIVER OF FULL READING OF It was moved by Councilman Buerk, seconded ORDINANCES & RESOLUTIONS by Councilman Ruth, and carried unanimously, to waive further reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all Council members after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. CONSENT CALENDAR Council asked that Items 1 and 5 be removed from the Consent Calendar. Whereupon, on motion of Councilman Dyda, seconded by Councilman Buerk, and carried unanimously, action on the Consent Calendar was as follows: MINUTES Approved, as presented, Minutes of December 30, 1975; January 13, and January 20, 1976. EASEMENT Accepted easement from F. Dennis and Alice Forrestal Imp. Dist. Pryor and authorized the Mayor to sign it. (901) RES. NO. 76-9 Approved RESOLUTION NO. 76-9 OF THE CITY CITY CLERK CANVASS COUNCIL OF THE CITY OF RANCHO PALOS VERDES OF MUNICIPAL ELECTION ORDERING THE CANVASS OF THE GENERAL MUNI- (501) CIPAL ELECTION TO BE HELD ON THE 2ND DAY OF MARCH 1976 TO BE MADE BY THE CITY CLERK OF THE CITY OF RANCHO PALOS VERDES. Council 438 February 3, 1976 VERDE RIDGE ROAD BARRIER Received and filed status report on re- (1503) straining barrier for Verde Ridge Road. AGREEMENT - ATMOSAT Approved license agreement and authorized Balloon Project Mayor to execute it. (1109) ITEMS REMOVED FROM CONSENT CALENDAR: MIRALESTE DRAIN Following discussion, Council agreed that a (604) representative from the Flood Control Dis- trict should be invited to appear before Council at a future meeting to discuss the Miraleste Drain project. JOINT WORK SESSION It was Council consensus to schedule the Specific Plan joint work session of the Council and (701) Planning Commission on the Specific Plan for the Regular meeting of February 17, 1976. 1111#IfIf CRENSHAW RIGHT OF WAY Following testimony from Cleve Stoskopf, ORDINANCE 30415 Amber Sky Drive, who asked that oil (1502) treatment not be applied to the roadway, and John Reeves, 30450 Amber Sky, who requested restriping of the roadway at the intersec- tion of Crenshaw and Del Cerro homes area; it was moved by Mayor Ryan, seconded by Councilman Buerk, and carried unanimously, to defer action on a proposed ordinance to regulate motor vehicle traffic on the Crenshaw Right of Way until nuisance solu- tions acceptable to the City and Del Cerro homeowners can be worked out. Council- man Buerk moved, seconded by Mayor Ryan, and carried unanimously, to immediately initiate enforcement of Section 7021 of the County Traffic Ordinance on the Right of Way prohibiting all usage except for utility companies and emergency vehicles. On motion of Councilman Buerk, seconded by Councilman Ryan, Park and Recreation Committee was asked to look into areas in the City that might be suitable sites for hang gliding and report back to Council. RECESS At 9:10 p.m. , a brief recess was called and Council reconvened at 9:27 p.m. with the same members present. APPEAL OF PAC DECISION RE: Council agreed to defer consideration of SETBACK MODIFICATION #44 appeal of PAC decision concerning Setback Appellant: Manuel Real et al Modification #44 and Second Story Construc- (1803) tion Permit #14 until the next Regular meet- ing, pending further information from the City Attorney. LEASE AGREEMENTS City Manager briefly reviewed the purchase School Sites schedule for the Highland and Crestmont (1401 x 1201) School sites at a cost of $1,900,000 over a five-year period. It was moved by Council- man Ryan, seconded by Councilman Dyda, to approve the agreement and authorize the Mayor to sign it on the following roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None Council asked that the Bicentennial Committee suggest a procedure for renaming the school sites as parks and come back to Council with a recommendation. 439 Council February 3, 1976 NIKE RE-USE REPORT Planning Director explained that additional REVISIONS revisions were necessary and it was moved (1109) by Councilman Dyda, seconded by Councilman Ryan, and carried unanimously to continue the item. PRELIMINARY NIKE SITE PLAN Following perusal of the Plan, Council (1109) asked that the application not rule out possibility of more active use of Nike Site in utilizing existing structures for such activities as astronomy and amateur radio center. ROAD MAINTENANCE - Slide Area Council asked Public Works Director to (1404) supply anticipated budget expenditures for the slide area, and requested City Attorney research question concerning County paying for the maintenance of road in the slide area. RES. NO. 76-8 It was moved by Councilman Dyda, seconded REGISTER OF DEMANDS by Councilman Ryan, to adopt RESOLUTION NO. 76-8 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $379,980.01, DEMAND NUMBERS 1924 THROUGH 1970, on the following roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None RECYCLING CENTER On motion of Councilman Buerk, seconded by (1301) Councilman Dyda, and carried, Council directed letter be sent in support of a Resource Recovery Market Place with the stipulation that the Center be self-supporting. TIDEPOOL PROTECTION Councilman Ryan reported on meeting he and (109) the Mayor had with the State director of the Fish and Game department concerning designating Abalone Cove as a marine refuge. Following discussion, it was the consensus of Council that a Beach subcommittee be convened to consider procedure to establish Abalone Cove as such a refuge. Council directed a letter be sent to the County putting them on notice that any construc- tion in area of recent slide movement near Abalone Cove is at their own risk and City does not encourage any construction at present time. STAFF INFORMATION It was moved by Councilman Buerk, seconded GUIDELINES by Councilman Dyda, and carried unanimously, (1101) to accept staff guidelines as set out in the City Manager's memorandum. TRAFFIC SIGNALS & CONTROLS Requests for crosswalk at Barkentine, clo- sure of section of Whitley Collins, closure of one end of Forrestal Drive, and no "U turn" signing at entrance to Portuguese Bend, were referred to staff with appropriate items to be directed to Traffic Committee.
