CC MINS 19750729 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Adjourned Meeting July 29, 1975 The meeting was called to order at 7:45 p.m. at the Palos Verdes Peninsula Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: Councilman Gunther Buerk Also present were City Manager Leonard G. Wood, Acting City Attorney Steve Dorsey, Director of Planning Sharon W. Hightower, Administrative Services Officer George Wunderlin, Public Works Director Dennis Pikus, City Treasurer Jan DuPar, and Acting Deputy City Clerk Martha Cunningham. AUDIENCE QUESTION: Mr. Ken Dixon, 1 Rockinghorse Road, and Rose HORSE KEEPING Westergard, a realtor, 2843 Palos Verdes Drive North, expressed concern with the legal status of horses in the City , particularly as it affects property values of individuals trying to sell their homes. Mr. Dixon presented a letter to Council citing his concerns. Mrs. Hightower explained that horses are technically a violation of the zoning code, but not one which the City is enforcing. Mr. Robert Gruhn, member of the Planning Advisory Committee, summarized the proposed large animal ordinance. The City Attorney was directed to study the matter further and prepare a recommendation on the legal status of horses for the August 5 Council meeting. It was the consensus of the Council that the public be directed to the map prepared by the Planning Committee delineating the proposed horse area, with the understanding that Council has tentatively approved the concept of the ordinance and the general areas to be included in the horse district. AGENDA CHANGES City Attorney requested an executive session to discuss potential litigation; Councilman Ryan indicated he wished to discuss the Abalone Cove Beach as it affects parking and traffic along Palos Verdes Drive South. PUBLIC HEARING - ORDINANCE NO. 71 Mayor Ryan declared the public hearing open L.A. COUNTY ZONING ORDINANCE on Ordinance No. 71, adopting by reference the L.A. County Zoning Ordinance. Planning Director briefed Council and reported that notice had been posted. Mr. Robert Pelton, 2 Packet Road, inquired what the green designation on some areas in the Portuguese Bend area referred to. Mrs. Hightower explained it meant the area was zoned open space until December. There being no further response to the Mayor's call for testimony, the hearing was declared closed. ORDINANCE NO. 71 OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ADOPTING BY REFERENCE, PURSUANT TO SECTION 50022.2 OF THE GOVERNMENT CODE, THE ZONING ORDINANCE OF THE COUNTY OF LOS ANGELES, BEING ORDINANCE NO. 1494 OF THE COUNTY OF LOS ANGELES, RE- PEALING AND AMENDING CERTAIN PROVISIONS THEREOF AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title, first reading having been given July 8, 1975. It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried to waive second reading and adopt the ordinance. On roll call vote: AYES: Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: Buerk PUBLIC HEARING - ORDINANCE NO. 72 Mayor Ryan declared the public hearing open SUBDIVISION ORDINANCE on Ordinance No. 72, adopting by reference the L.A. County Subdivision Ordinance. Plan- ning Director briefed Council and reported that notice had been posted. There being no response to the Mayor's call for testi- mony, the hearing was declared closed. Council 364 July 29, 1975 ORDINANCE NO. 72 OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ADOPTING BY REF- ERENCE PURSUANT TO SECTION 50022.2 OF THE GOVERNMENT CODE ORDINANCE NO. 4478 OF THE COUNTY OF LOS ANGELES KNOWN AS THE SUBDIVISION ORDINANCE, REPEALING CERTAIN PROVISIONS THEREOF AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title, first reading having been given July 8, 1975. It was moved by Councilman Ryan, seconded by Councilman Dyda, and carried, to waive second reading and adopt the ordinance. On roll call vote: AYES: Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: Buerk ORDINANCE NO. 73 ORDINANCE NO. 73 OF THE CITY OF RAN- ADOPTING OFFICIAL ZONING MAP CHO PALOS VERDES, CALIFORNIA, ES- TABLISHING DISTRICTS AND ADOPTING AN OFFICIAL ZONING MAP AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title, first reading having been given July 15, 1975, with public hearing held on the same date. It was moved by Councilman Ruth, seconded by Councilman Dyda, and carried, to waive further reading and adopt Ordinance No. 71. On roll call vote: AYES: Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: Buerk ORDINANCE NO. 74 ORDINANCE NO. 74 OF THE CITY OF RAN- TERMINATING MORATORIUM ON CHO PALOS VERDES TERMINATING THE CERTAIN PERMITS MORATORIUM ON CERTAIN PERMITS AND THE PROCESSING OR APPROVAL OF TENTA- TIVE MAPS, FINAL MAPS OR PARCEL MAPS IN CERTAIN AREAS OF THE CITY, AND CERTAIN RESTRICTIONS ON THE ISSUANCE OF BUILDING AND GRADING PERMITS, AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title, first reading having been given July 15, 1975. It was moved by Council- man Dyda, seconded by Councilman Ryan, and carried, to waive further reading and adopt Ordinance No. 74. On roll call vote: AYES: Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: Buerk BUDGET WORK SESSION Council reviewed portions of the 1975-76 budget; various revisions were made. Mr. John R. Shepherd, 6002 Flambeau, had several questions and comments regarding contracts and moni- toring of contracts for such services as tree trimming, signal maintenance, etc. Mr. Al Rosenthal, 29716 Whitley Collins, of the Mesa Palos Verdes Homeowners As- sociation, had various questions and suggestions. RECESS A brief recess was called at 9:37 p.m. Council reconvened at 9:45 p.m. with the same members pre- sent. ABALONE COVE BEACH Councilman Ryan expressed concern with parking congestion along Palos Verdes Drive South and along Abalone Cove area residential streets since the opening of the Abalone Cove Beach. He re- quested staff to make an investigation and recommendation on the problem. Council- man Ruth indicated staff would soon be meeting with Captain Foreman to discuss methods of alleviating these problems. Council 365 July 29, 1975 EXECUTIVE SESSION On motion of Councilman Dyda, seconded by Councilman Ryan, and carried, the Council ad- journed to an executive session to discuss matters of litigation at 11:00 p.m. Council reconvened at 12:15 a.m. ADJOURNMENT At 12:16 a•m. it was moved, seconded and carried to adjourn the meeting to August 4, 1975 at 7:30 p.m. at the Palos Verdes Peninsula Unified School District Building, for further budget work session.
