CC MINS 19750626 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Adjourned Meeting June 26, 1975 The meeting was called to order at 7:50 p.m. at Ridgecrest Intermediate School, 28915 Northbay Road by Mayor Ryan. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, Director of Planning Sharon Hightower, Administrative Services Officer George Wunderlin, Community Services Officer Tom Bandy, and Acting Deputy City Clerk Martha Cunningham. CONTRACT WITH City Manager indicated the agreement before L. A. COUNTY SHERIFF Council is a basic services agreement for Sheriff services for 1975-76; it does not es- tablish the level of services, but sets the basic framework for law enforcement. Councilman Dyda indicated a preliminary report from the Safety Sub-committee should be prepared shortly. Although the Sub-committee is considering the option of chang- ing the level of service (reducing traffic enforcement) , this should not be inter- preted as a flat reduction in service; the emphasis in the services will be shifted to burglary, in order to more closely fit the needs of the City. It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried to authorize the Mayor to execute a contract with the Los Angeles County Sheriff's Department for law enforcement services. CONTRACT WITH City Manager indicated the agreement before L. A. COUNTY Council is for six months of animal control ANIMAL CONTROL DEPT. service, with the option to either (1) have all revenues collected go to the County with no direct City cost; or (2) have the City collect all animal control revenues, and pay the County for services rendered. Staff recommends continuing the same level and arrangement of services. It was moved by Councilman Buerk, seconded by Councilman Dyda, and unanimously carried to authorize the Mayor to execute a contract with Los Angeles County for animal con- trol services. GENERAL PLAN Mayor Ryan indicated that, on the advice of the City Attorney, she had listened to tapes of the General Plan hearing she had missed, in order to vote on the adoption of the Plan. Director of Planning indicated that, since the close of the public hearings, four work sessions had been held to revise the Plan. Most changes were clarifications to the text and/or policies and language clarifications. The major changes involved the Land Use Map, including: (1) The area south of Crest Road from Monaco to Del Cerro was changed from 1-2 d.u./acre to 2-3 d.u./acre. (2) A 13 acre area east of upper Abalone Cove and north of Palos Verdes Drive South was changed from 1 d.u./acre to 1-2 d.u./acre. (3) An area at the northwest corner of Via Campesina was changed from 1 d.u./5 acres to 1 d.u./acre. (4) The canyon area at the southeast corner of Crest Road and Crenshaw was changed from institutional to 2-3 d.u./acre. (5) All slopes of 35% or greater have been included in the Natural Environment/Hazard area. (6) The active slide area is recognized as residential at 1-2 d.u./acre, but with an overlay of Natural Environment/Hazard. Mayor Ryan indicated she was prepared to entertain a motion to restore the area south of Crest Road to 1-2 d.u./acre, due to problems of slope in the area. Councilman Ryan expressed a desire to restore the parcel in Abalone Cove to 1 d.u./acre, since raising the designation to 1-2 d.u./acre might limit planning options, and to Council 350 June 26, 1975 restore the parcel south of Crest Road to 1-2 d.u./acre, since the area is above the active and old landslide areas. GENERAL PLAN - T. J. Mullen, 5725 Sunmist Drive; Ed Bedrosian, PUBLIC COMMENTS 30503 Cartier Drive; Mrs. J. M. Jones, 28950 Crestridge Road; Mrs. L. A. Pittelkow, 28762 Crestridge Road; Victor Cabas, 31021 Marne Drive, speaking for Palos Verdes Monaco Homeowners Association; and Al Rosenthal, 29716 Whitley Collins Drive, speaking for the Mesa Palos Verdes Homeowners Association, ex- pressed opposition to the change in designation for the land south of Crest Road, and requested Council to restore the 1-2 d.u./acre designation. Burke Belknap, 28866 Crestridge Road, expressed opposition to the 2-3 d.u./acre desig- nation south of Crest Road, in that it could influence the zoning of nearby parcels in Rolling Hills Estates to a higher density. George Gleghorn, 28850 Crestridge Road, praised the low density aspects of the Plan, but expressed disappointment with the same amount of agricultural zoning. Mr. Gleghorn indicated opposition to the changes of zoning in the Crest Road and Abalone Cove area. Barbara Hein, 30116 Via Rivera, commended the Council for their work on the General Plan, but expressed disappointment with the same amount of agricultural zoning. Cleve Stoskopf, 30415 Ambersky Drive, expressed concern with access to the area south of Crest Road and east of the radar site at the end of Crenshaw Boulevard. Don Owen, of Cayman Development, owners of 41 acres at Crest and Whitley Collins, expressed interest in meeting with concerned citizens to show them what can be done with a zoning of 2-3 d.u./acre, and still be sensitive to the environment. Mr. Klaus Schuegraf, 30331 Cartier, requested Council to reconsider the change of zoning for the land south of Crest Road, and pledged $100 to the City to help defray the cost of any legal action which might arise from the zoning of the land south of Crest Road as 1-2 d.u./acre. Sheila Hoff, 28205 Ambergate Drive, expressed concern with the change in designation in the Crest Road and Abalone Cove areas. In addition, by using gross acreage, the Council is not really meeting the community's goals. A. V. Eggers, 6904 #4 Los Verdes Drive, commended the City for addressing an archae- ological element, but expressed concern with the lack of policy statements in the archaeological section, particularly the lack of a policy for the City to help pre- serve as many sites as possible, whenever possible. Councilman Ruth explained that the changes in land use were made, on the advice of the City Attorney, to make the Plan more defensible in court. Councilman Dyda pointed out that the Plan (with the land use changes) does meet the goals of the community; the Plan has an average of 1.5 d.u./developable acre, where- as the goal stated in the Preliminary Goals Report was 2 d.u./developable acre. City Attorney indicated the changes in land use were made to meet the requirement that land in the City be treated in a reasonable and uniform fashion. Although a designation of 4 d.u./acre could not be justified (due to proximity to Natural Environment/Hazard area and active and inactive landslide areas) , it was his judge- ment that a 2 d.u./acre designation could be challenged on the basis of uniformity of treatment of similarly situated land. It was moved by Mayor Ryan, seconded by Councilman Ryan and carried, with Council'--- man Dyda dissenting, that the Land Use Map be changed to eliminate the 2-3 d.u./acre category and make those portions which are 2-3 d.u./acre, 1-2 d.u./acre. It was moved by Councilman Ryan, seconded by Mayor Ryan, and carried, with Council- man Buerk dissenting, that the area near Wayfarer's Chapel on the north side of Palos Verdes Drive South be restored to the 1 d.u./acre designation. Council 351 June 26, 1975 ADOPTION OF GENERAL PLAN City Attorney read Resolution No. 75-43, a resolution receiving and certifying the final Environmental Impact Report to the General Plan and adopting the General Plan of the City of Rancho Palos Verdes. It was moved by Councilman Buerk, seconded by Councilman Dyda, and unanimously carried that Resolution No. 75-43 be adopted.
