RANCHO PALOS VERDES CITY COUNCIL
Regular Meeting
June 17, 1975
The meeting was called to order at 7:41 p.m. at the Palos Verdes Peninsula Unified
- School District Building, 30942 Hawthorne Boulevard. Following the Pledge of
Allegiance to the Flag, roll call was answered as follows:
PRESENT: Councilmen Gunther Buerk, Ken Dyda, Robert E. Ryan, and Mayor
Marilyn Ryan
ABSENT: Councilman F. D. Ruth
Councilman Ruth arrived at 8:20 p.m. and was present for the re-
mainder of the meeting.
Also present were City Manager Leonard G. Wood, Acting City Attorney Pat Coughlan,
Planning Director Sharon Hightower, Administrative Services Officer George Wunderlin,
Public Works Director Dennis Pikus, Community Services Officer Tom Bandy, and Deputy
City Clerk Dee Krebs.
MINUTES APPROVAL Council considered Minutes of June 3 and 5,
1975. Corrections to Minutes of June 3 were
as follows: page 329, Audience Question section, delete: "to police protection";
page 330, second paragraph, delete "passed to second reading" and substitute "intro-
duced". Corrections to the Minutes of June 5 were as follows: page 332, paragraph
6, change "20" to "200". It was moved by Councilman Buerk, seconded by Councilman
Dyda, and carried to approve the Minutes of June 3 and the Minutes of June 5, 1975,
as corrected.
CONSENT CALENDAR On motion of Councilman Dyda, seconded by
Councilman Buerk, and unanimously carried,
Council approved items on the Consent Calendar as follows:

CONSULTANT INVOICES Approved payment of consultant invoices as
follows: David L. Peterson for work on

PUBLIC HEARING - Hearing was opened on code amendment to allow

on file.
In response to a question from Mr. Keith Knight, 2810 San Ramon,. Planning Director.
stated college enrollment could be regulated by the City through the conditional use
permit. There being no response to the call for testimony, the hearing was closed.
Whereuporr, ORDINANCE NO. 69 OF THE CITY OF RANCHO PALOS VERDES PROVIDING FOR CERTAIN
LAND USES UNDER CONDITIONAL USE PERMITS IN RESIDENTIAL ZONES AND AMENDING THE RANCHO
PALOS VERDES MUNICIPAL CODE was introduced by title, further reading waived, and
passed to second reading on motion of Councilman Dyda, seconded by Councilman Ryan,
and carried unanimously.
ORD. 68 ORDINANCE NO. 68 OF THE CITY OF RANCHO PALOS
EXEMPTION FROM VERDES REMOVING CERTAIN PROPERTY FROM THE
MORATORIUM EXISTING MORATORIUM ON CERTAIN PERMITS AND
(So. Bay Archery Club) MAPS AND AMENDING ORDINANCE NO. 54 OF THE CITY
OF RANCHO PALOS VERDES was read by title, first
reading having been given June 3, 1975. It was moved by Councilman Buerk, seconded
by Councilman Dyda, and unanimously carried to waive further reading and adopt the
ordinance. On roll call vote:

ORD. 70 City Manager reviewed proposed ordinance to

time period. City Manager then introduced by title ORDINANCE NO. 70 OF THE CITY OF
RANCHO PALOS VERDES SETTING FORTH THE PROCEDURES TO ABATE NUISANCES AND AMENDING THE
RANCHO PALOS VERDES MUNICIPAL CODE.
Following Council discussion, it was moved by Councilman Buerk, seconded by Councilman
Dyda, and unanimously carried, that further reading be waived and the ordinance be
passed to second reading with the understanding that copies of the ordinance be dis-
tributed to the homeowners' associations requesting their comments.
ENV. ASSESS. APPEAL Council considered the appeal of the Environ-

Rockinghorse Road.
Mr. Julius Johnson of the City staff reviewed the action of the Environmental Assess-
ment Committee noting that the Committee believed the negative effect on the environ-
ment to be such that an environmental impact report be performed on the proposed
grading project.
Mr. J. L. White, owner of the property, said the grading was initiated to widen drive-
way to allow vehicle turnaround and requested the project be allowed to proceed because
of safety factors. He indicated willingness to construct retaining wall on canyon
ridge adjacent to waterway. Mr. Hammerle, the applicant, said he did not see what an
EIR would accomplish.
Following Council discussion of procedures involved in obtaining grading permit, ef-
fects of retaining wall, and necessity of EIR, it was moved by Councilman Ryan,
seconded by Councilman Dyda, and carried to table the matter until the meeting of
July 15, 1975.

APPT. - South Bay It was the consensus of Council that committee
Information & Referral of the Mayor and Councilman Ruth would make
Center recommendations to Council regarding two ap-
pointments to the Advisory Committee of the
South Bay Information & Referral Center.
SEWER CONNECTION It was moved by Councilman Ryan, seconded by
AGREEMENT Councilman Dyda, and unanimously carried to
(Private Contract No. 75-1) authorize the Mayor to accept the easement deed
(1402) for the subject sewer system and authorize the
Mayor to sign agreement between Meine Con-
struction Company and the City, and an agreement between the City of Rancho Palos
Verdes and City of Palos Verdes Estates, to enable sewer shown on Private Contract No.
75-1 to be connected to the sewer system of Palos Verdes Estates.
RES. 75-40 Administrative Services Officer indicated
REGISTER OF DEMANDS that Warrant No. 1281 was voided and replaced
with Warrant No. 1287 in the amountof $636.80.
Whereupon, it was moved by Councilman Dyda, seconded by Councilman Buerk, and unani-
mously carried, to waive further reading and adopt RESOLUTION NO. 75-40 OF THE CITY
COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE
SUM OF $195,295.75, DEMAND NUMBERS 1240 THROUGH 1280 AND DEMAND NUMBERS 1282 THROUGH
1285 AND 1287. On roll call vote:

RECESS At 8:55 p.m. a brief recess was called and at
9:07 p.m. the meeting reconvened with the same
members present.
SEPARATE COUNTY FORMATION Councilman Buerk reported on a recent proposal
by Los Angeles City Council to form a new
county to include the City of Los Angeles and possible other cities. Following dis-
cussion, it was the consensus of Council to try to obtain additional information re-
garding the proposal and suggest at the next South Bay Cities Association meeting that
a South Bay Cities committee be formed to look at the proposal as well as possibility
of forming a county composed of South Bay area cities.
COUNCIL PUBLIC Councilman Dyda indicated the Sheriff's Depart-
SAFETY COMMITTEE ment was continuing investigation of the inci-
(1206) dent that took place on May 18 and a report
would be forth-coming. In regard to Sheriff's
contract, the committee indicated talks were in progress and the City Manager said
the contract would be brought to the Council at the June 26 meeting. Councilman Dyda
proposed convening an ad hoc committee to define objectives, criteria and alternatives
that could be included in a proposal for federal funding to do an in-depth analysis
of alternatives, ranging from continuing contracts on an individual basis to consid-
eration of a public safety department. Council was in agreement that the Public Safety
committee prepare a written report regarding proposed membership of ad hoc committee
and its functions.
MIRALESTE City Manager reported on estimates for con-
TENNIS COURTS struction of three tennis courts at Miraleste
(1401 x 1201) High School and, following discussion, the
motion was made by Councilman Ryan, seconded
by Mayor Ryan, and carried unanimously, to find that it was in the public interest to
give up to $30,000 to the school system for the purpose of constructing tennis courts
and that such construction would serve both the City and the public interest. It was
moved by Councilman Ryan, seconded by Councilman Buerk, and carried unanimously to
allocate $30,000 to construct three tennis courts at Miraleste High School and to
authorize the City Attorney to forward letter of intent to the school district.

MEDIAN STRIP City Manager reported Silver Spur Garden Club
MAINTENANCE assessed work to be done and arrangements had

(1404) median strip committee will have their recom-
mendations ready in the near future and subject
will be considered during budget sessions.
ZONING ORDINANCE Planning Director presented a flow chart and
(1801) briefed Council on time schedule for adoption
of zoning ordinance. Following questions and
comments by Council, it was moved by Councilman Dyda, seconded by Councilman Ruth, and
carried unanimously, to accept staff's recommendation to initiate adoption of the Los
Angeles County zoning ordinance as the zoning ordinance for Rancho Palos Verdes to be
used until the City adopts its own ordinance prior to December 31, 1975.
EXECUTIVE SESSION On motion of Councilman Dyda, seconded by
Councilman Ryan, and carried, the Council
adjourned to executive session at 10:40 p.m. to discuss litigation matters. Council
reconvened at 10:49 p.m. with no action taken.
ADJOURNMENT At 11:00 p.m. , it was moved by Councilman
Dyda, seconded by Councilman Buerk, and
carried to adjourn to June 19, 1975, 7:30 p.m. , for final public hearing on the
General Plan.
