CC MINS 19750603 M I NUT E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting June 3, 1975 The meeting was called to order at 7:43 p.m. at the Palos Verdes Unified School Dis- trict Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: None Also present were Planning Director Sharon Hightower, Acting City Attorney Pat Coughlan, Administrative Services Officer George Wunderlin, Public Works Director Dennis Pikus, Community Services Officer Tom Bandy, and Deputy City Clerk Dee Krebs. MINUTES APPROVAL Council approved, as submitted, Minutes of May 3, May 10, May 17, and May 20, 1975, on motion of Councilman Dyda, seconded by Councilman Ryan, and carried. It was moved by Councilman Buerk, seconded by Councilman Dyda, to amend the motion relating to accep- tance and correction of the Minutes of May 6, adopted at the May 20, 1975 meeting to read: page 314, paragraph 7; "Following discussion of Criteria No. 3 (cumulative effect) , that there are other existing houses in the immediate vicinity, particularly the next-door neighbor's who could apply for two-story and a number of others in a similar situation, it was moved, seconded and carried that the cumulative effect of these specific applications would have an adverse impact on the view." The motion to amend the Minutes carried unanimously. AUDIENCE QUESTION - Dr. Ferrill Volpicelli, 5733 Capeswood Drive, SHERIFF DEPARTMENT presented Council with a list of concerns re- garding Sheriff department operations within the City and asked that an investigation be conducted concerning incident of a distur- bance of the peace at Granvia Altamira and Hawthorne on May 18. It was moved by Mayor Ryan, seconded by Councilman Ryan, and carried to request a full report from the Sheriff regarding the incident. Councilman Buerk moved to amend the motion, with con- sent of second, and asked that the Council Public Safety Committee review the matter in its entirety and evaluate the Sheriff's contract with this incident in mind and consider whether or not to renew and/or modify the contract and, at the same time, at other alternatives to police rotection. C `d G//7 75 4( look t p p CONSENT CALENDAR On motion of Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, Council denied the appeal from Dayton Realty regarding the environmental excise tax. ORD. NO. 67 ORDINANCE NO. 67 OF THE CITY OF RANCHO PALOS EXEMPTION FROM VERDES REMOVING CERTAIN PROPERTY FROM THE EX- MORATORIUM ISTING MORATORIUM ON CERTAIN PERMITS AND MAPS (Marymount College) AND AMENDING ORDINANCE NO. 54 OF THE CITY OF (1801) RANCHO PALOS VERDES was read by title; first reading having been given May 20, 1975. It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, to waive further reading and adopt Ordinance No. 67. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ABSENT: None ORD. NO. 68 Planning Director stated this was the Club's EXEMPTION FROM second request for a moratorium exemption to MORATORIUM allow them to lease 12 acres in the Portuguese (So. Bay Archery Club) Bend Slide area for an archery range, and in- dicated a conditional use permit would be re- quired if the property is exempted. Council 329 June 3, 1975 Mr. George Zidbeck, 421 W. 224th, Carson, representing the South Bay Archery Club, answered Council questions regarding grading of the land, access to the property and parking, and club membership. In response to Council questions regarding liability and grading, City Attorney indicated City could be named as coinsured and this would be a condition of the use permit as well as restrictions with regard to grading. On motion of Councilman Dyda, seconded by Councilmag, Ryan, and unanimously carried further reading was waived and the ordinance passe to second reading. 4". 4 , /ç7/7ç 42( COUNTY SERVICES AGREEMENT Council deferred action on agreement and Sheriff resolution for law enforcement services and (1206) referred the matter to Council Public Safety Committee for further study. COUNTY SERVICES AGREEMENT Council deferred consideration of agreement Animal Control for animal control services and referred the (104) matter to the Council Public Safety Committee. SCAG (So. Ca. Assoc. of Governments) It was moved by Councilman Buerk, seconded by PROPOSAL FOR STATUTORY STATUS Councilman Ruth, and unanimously carried to (1102) support statutory status for SCAG. RES. NO. 75-39 It was moved by Councilman Dyda, seconded by REGISTER OF DEMANDS Councilman Ryan, and unanimously carried to waive further reading of RESOLUTION NO. 75-39 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $1,603,752.41, DEMAND NUMBERS 1196 THROUGH 1239. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None ZONING ORDINANCE PREPARATION Planning Director and City Attorney discussed (1801) the time constraints involved in adoption of zoning ordinance by September 2, and discussed with Council such measures as adopting interim zoning to allow preparation of zoning ordinance to conform with General Plan by December 31, 1975. Council accepted staff's recommendation to retain Planning Advisory Committee temporarily and delay appointment of Planning Commission until adoption of zoning ordinance. Council asked staff to prepare plan specifying work phases and time schedule in connection with completion of zoning ordinance. EXECUTIVE SESSION At 9:20 p.m. , it was moved by Councilman Dyda, seconded by Councilman Ruth, and unanimously carried to adjourn to executive session to discuss matters of litigation. Council reconvened at 11:30 p.m. with the same members present. LAFCO APPT. It was the consensus of Council to support the candidacy of Joe Barnett for appointment to Local Agency Formation Commission (LAFCO) . SO. BAY CORRIDOR - Phase II It was moved by Councilman Buerk, seconded (1505) by Councilman Dyda, and unanimously carried to authorize the Mayor to sign the Joint Powers agreement for Phase II and instruct the City Manager to budget $1,406 in fiscal 1975-76 for the South Bay Corridor Study. AB 1311 It was the consensus of Council to oppose (Amend. to Quimby Act) AB 1311 and indicate their opposition in writing, to State Assemblyman Beverly.
