CC MINS 19750520 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL Regular Meeting May 20, 1975 The meeting was called to order at 7:44 p.m. at the Palos Verdes Peninsula Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Alle- giance to the Flag, roll call was answered as follows: PRESENT: Councilmen Gunther Buerk, Ken Dyda, Francis D. Ruth, Robert E. Ryan, and Mayor Marilyn Ryan ABSENT: None Also present were City Manager Leonard G. Wood, Acting City Attorney Pat Coughlan, Planning Director Sharon Hightower, Administrative Services Officer George Wunderlin, Public Works Director Dennis Pikus, Community Services Officer Tom Bandy, and Deputy City Clerk Dee Krebs. MINUTES APPROVAL Council considered Minutes of April 26, April 29, May 6, and May 7, 1975. Corrections to Minutes of May 6 were as follows: page 314, paragraph 9, correct to read: seconded by Mayor Ryan; and in the same paragraph, delete "not". It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried to approve the Minutes of May 6, as corrected, and Minutes of April 26, April 29, and May 7. PENINSULA Dr. Leslie Loschen, president of the Peninsula SYMPHONY ASSOC. Symphony Association, presented background and history of the Association and asked that the City consider financial support of the organization. Following questions and comments by Council, it was moved by Councilman Buerk, seconded by Councilman Dyda, and carried, to refer the matter to staff for consideration in fiscal 1975-76 budget. CONSENT CALENDAR On motion of Councilman Buerk, seconded by Councilman Dyda, and unanimously carried, Council approved items on the Consent Calendar as follows: Orange Crate Derby Adopted RESOLUTION NO. 75-36 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES CLOSING PORTIONS OF INDIAN PEAK ROAD ON JUNE 1, 1975, FROM 7 A.M. TO 5 P.M. Resurfacing Project Approved plans and authorized advertising for bids on resurfacing project for Palos Verdes Drive East. PUBLIC HEARING The Mayor opened the hearing on Conditional C.U.P. No. 8 Use Permit No. 8 to allow the operation of a Mt. Olive Lutheran Church Pre-School pre-school in the church facilities. Plan- (1804) ning Director reported that notice of hearing II/ was given, with affidavit thereto on file with the Clerk. Planning Director stated that the only proposed addition to the existing facility would be a 5-ft. high chain link fence enclosing the play area, and reviewed the recommended conditions for approval contained in the resolution including Director's approval of final plans and approval of a landscaping plan for the property. Mr. John Melde, chairman of the pre-school committee, said they would be happy to comply with the two conditions. There being no further response to the call for testimony, the hearing was closed. RESOLUTION NO. 75-37 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES GRANTING A CONDITIONAL USE PERMIT FOR A PRE-SCHOOL was read by title. It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, to waive fur- ther reading and adopt the resolution. Council 326 May 20, 1975 PUBLIC HEARING - The Mayor opened the hearing on request for VAR. NO. 3 TO CREATE TWO a variance from RA-1 zoning to allow creation 30,000 SQ. FT. PARCELS of two 30,000 sq. ft. lots and a parcel map (Via Campesina) to record the lots. Planning Director re- (1804 x 1410) ported that notice of hearing was given, with affidavit thereto on file with the Clerk. Planning Director briefed Council and summarized staff recommendations of conditions for approval. The applicant Richard Meine, 3270 Via Campesina, Lee Purcell, 3330 Via Campesina, and Leo Poxon, 5375 Rolling Ridge Road, spoke in favor of the proposal. Charles Williams and Nancy Werner, 5251 Rolling Ridge Road, spoke in opposition, citing concerns for low density and open space. Following rebutall by Mr. Meine, the Mayor declared the hearing closed and called for questions and comments from Council. Following discussion, it was moved by Councilman Dyda, seconded by Councilman Ruth, and unanimously carried to waive further reading of RESOLUTION NO. 75-38 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES GRANTING A VARIANCE AND APPROVING PARCEL MAP NO. 5726. It was moved, seconded and carried to adopt the resolution with Councilman Ryan voting "no". ORD. NO. 67 ORDINANCE NO. 67 OF THE CITY OF RANCHO REMOVING CERTAIN PROPERTY PALOS VERDES REMOVING CERTAIN PROPERTY FROM EXISTING MORATORIUM FROM THE EXISTING MORATORIUM ON CERTAIN (Marymount College) PERMITS AND MAPS AND AMENDING ORDINANCE NO. 54 OF THE CITY OF RANCHO PALOS VERDES was read by title. Planning Director stated the applicant seeks a moratorium exemption for property located at 30800 Palos Verdes Drive East to change its use from a preparatory school to a college campus, and that the proposed change would require a code amendment as well as a conditional use permit. On motion of Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, further reading was waived and the ordinance passed to second reading. GOLF TOURNAMENT It was moved by Councilman Dyda, seconded by Councilman Ryan, and unanimously carried, to purchase a trophy for the golf tournament sponsored by the Palos Verdes Chamber of Commerce and co-hosted by Rancho Palos Verdes. ENVIRONMENTAL On motion of Councilman Dyda, seconded by EXCISE TAX Councilman Ryan, and unanimously carried, Council authorized the Mayor to execute a reconveyance of the trust deed back to Kenneth M. Duffy conditioned upon payment of fee to the City. GOLDEN COVE AREA City Attorney reported the Supreme Court DEVELOPMENT denied appeal of Dayton Realty and Beverly Realty regarding proposed development in Golden Cove area. RES. NO. 75-35 Following discussion, it was the consensus REGISTER OF DEMANDS of Council to delete Warrant No. 1168, and refer the matter of ambulance billing collections to staff for further study. Whereupon, it was moved, seconded and carried unanimously to waive further reading of RESOLUTION NO. 75-35 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $889,018.26, DEMAND NUMBERS 1147 THROUGH 1167 AND 1169 THROUGH 1195 AND THE PAYMENT OF A CLAIM AND DEMAND IN THE SUM OF $8,000.00 AGAINST THE TECHNICAL ASSISTANCE GRANT PROJECT NO. 07-6-09486-26, ACCOUNT DEMAND NUMBER 2. On roll call vote: AYES: Buerk, Dyda, Ruth, R. Ryan, M. Ryan NOES: None Council 327 May 20, 1975 RECESS At 9:25 p.m. , the Mayor called a brief recess. The meeting reconvened at 9:35 p.m. with the same members present. MAYORS' LEGISLATIVE The Mayor reported on the Mayors' and City CONFERENCE Council Legislative Conference in Sacramento and following discussion it was the consensus of Council to have staff send a resolution to Assembly Committee and other cities supporting proposed legislation AB 1762 regarding reapportioning of sales tax. BEACH COMMITTEE Councilman Buerk reported that the following residents had recently been appointed to a committee to work with the County Beach Dept. : Bob Smolley, Bob Pelton, Elinor Shadle, Joe Clifford, John McTaggart, and Ann Shaw, and following discussion, Council agreed to appoint additional members: a high school student, Dennis McNeil, and a representative from the Palos Verdes South Homeowners Association, John Ihde. Mr. Buerk explained a meeting was planned for May 24 with Bob Donahue from the Beach Department. UNIFICATION PROPOSAL Councilman Ryan discussed various methods FOR PENINSULA CITIES for unification of Peninsula cities including the possibility of reorganizing as a charter city and stated there are tax and service advantages in unification. GENERAL PLAN In discussing the timetable for the Plan, it REPORT was the consensus of Council to have staff determine date Draft to be delivered to printer. Council denied Great American Land Development's request for a 30-minute presentation at June 5 Formal Public Hearing on the General Plan.
