CC MINS 19771206 M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING DECEMBER 6, 1977 The meeting was called to order at 7 :35 P.M. by Mayor Robert Ryan at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, which was led by Boy Scout Leader Randy Madison of Troop 878, roll call was answered as follows : PRESENT: SHAW, RUTH, DYDA, BUERK & MAYOR RYAN ABSENT: NONE Also present were City Attorney Patrick Coughlan, City Manager Leonard G. Wood, Director of Planning Sharon W. Hightower, Director of Public Works Dennis J. Pikus, Administrative Services Officer George Wunderlin and Deputy City Clerk Mary Jo Lofthus . AGENDA FORMAT Councilman Dyda moved, seconded by Councilman Ruth, to follow the new format proposed by staff. The motion carried unanimously. City Manager Wood explained that the major reason for the change in format was to enable earlier completion of that portion of business which had public participation. APPROVAL OF AGENDA After deletion of Item No. 7 (Repair of Street at Montemalaga & Basswood) and addition of Joint Powers Insurance Authority Report (Dyda) , the Agenda was approved on motion of Councilman Dyda, seconded by Councilman Ruth. There being no objection, MAYOR RYAN SO ORDERED. WAIVER OF FULL READING OF Councilman Dyda moved, seconded by ORDINANCES & RESOLUTIONS Councilwoman Shaw, to waive reading in full of all ordinances and resolu- tions adopted at this meeting with consent to the waiver of reading to be deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. C.U.P. #26 Councilman Dyda moved to re-advertise APPLICANT:PENINSULA RACQUET CLUB the public hearing for January 3, 1978 (1804) and reopen the hearing for new infor- mation only. The motion was seconded by Councilman Ruth. The motion carri- ed on the following roll call vote: AYES : SHAW, RUTH & DYDA NOES : BUERK & MAYOR RYAN 740 APPOINTMENT TO ENVIRONMENTAL Councilman Dyda moved, seconded by COMMITTEE Councilwoman Shaw, to nominate (1205) Mr. Donald F. Baer, 7 La Vista Verde, to the Environmental Committee. Councilman Ruth moved, seconded by Councilman Buerk, to nominate Mr. William Kelso to the Environmental Committee. Councilman Dyda then moved to close nominations. The motion was seconded by Councilman Ruth and carried unanimously. . Councilman Dyda' s motion to nominate Mr. Donald Baer carried on the following roll call vote: AYES : S HAW, DYDA, BUERK & MAYOR RYAN NOES: RUTH ACCEPTANCE OF PARCEL "C" Councilman Ruth noted that he TRACT NO. 32991 - SEACLIFF had been briefed on the discussion HILLS that took place at the last Council (1411) meeting with regard to this parcel. Mayor Ryan moved to accept Parcel "C" . The motion was seconded by Councilman Dyda. Councilman Buerk stated his objection to this acceptance because he felt it would be to the City ' s disfavor inasmuch as it was inaccessible, would be a liability and, further, he felt it would be more practical to have the homeowners association responsible for :this parcel. Mayor Ryan said he felt that access to this lot was no major problem. It was Councilman Dyda' s opinion that the liability for maintenance and weed abatement was small and that the lot would be an asset to the City. Councilwoman Shaw said she felt this was a difficult area to secure and it could be better handled by the homeowners association in the area. Councilman Ruth noted his concern for the liability that might befall the City if this parcel was accepted. Mayor Ryan's motion to accept Parcel "C" failed on the following roll call vote: AYES : DYDA &. MAYOR RYAN NOES : SHAW, RUTH & BUERK Councilwoman Shaw moved not to accept Parcel "C" . The motion was seconded by Councilman Buerk and carried on the following roll call vote: AYES : SHAW, RUTH & BUERK NOES : DYDA & MAYOR RYAN BASKETBALL HOOP & STANDARD The Director of Public Works ON RIO LINDA DRIVE presented the staff memorandum (1403) of November 22 , 1977 which out- lined the facts bearing on this situation. It was staff recommendation that the City Council adopt a policy of allowing the installation of basketball hoops only in cul-de-sacs, and only after the proper permit was obtained. Mr. Najand, 6303 Rio Linda Drive, told the Council that the noise generated by playing basketball was irritating and it was hazardous for children to be playing in the streets. Also , he noted that children from other areas of the city came to play on that street. Council 741 December 6, 1977 Planning Commissioner Mel Hughes asked the City Council to give a good deal of thought before passing the suggested policy. Mr. T.A. Wong, whose home is immediately adjacent to the hoop, said that it is currently being maintained and used by the neighbors. He felt it was no bother to any person in the neighborhood. Mr. Barry Procter, 6300 Rio Linda, said that he plays basketball on weekends and sometimes in the evenings. He told the Council that the hoop was used about 5 hours per week. Mr. Tony Antoville, 6315 Rio Linda, felt that if the basketball hoop was taken down, then everybody would install one in their driveways, and this would probably cause more noise. After Council discussion of what the criteria should be for establish- ing the suggested policy; possible City liability, and whether or not this should be sent to the Planning Commission and Traffic Committee for their consideration, Councilman Buerk moved, seconded by Council- man Ruth, that the City Council take no action and ask the staff to review the situation and see if there was anything serious that had been overlooked and which should be solved. If so, it should be brought to the attention of the City Council. The motion carried on the follow- ing roll call vote: AYES: SHAW, RUTH, BUERK & MAYOR RYAN NOES: DYDA ANNEXATION Council requested staff to prepare (105) a study on annexing the Western Ave. area. This study should take into consideration the economic advantages and disadvantages and the required increase in services that would be necessary for that area. STAFF/COUNCIL Council briefly discussed this matter, CHRISTMAS PARTY but no date was set. SALES TAX DISTRIBUTION Councilman Dyda reported that 89% of (1501) the people responding to his survey re sales tax distribution were in favor of his proposed fair share formula and only 11% opposed. He requested Council ' s authorization to work with staff and the City Attorney to prepare a litigation posture and then solicit on that basis support from other cities and counties, and with sufficient support come back to the Council with a recommendation on whether or not to file a law suit. Councilman Buerk moved to authorize the City Manager to contact the City of Baldwin Park and obtain whatever information can be obtained from that city or what they have paid for with the firm of Rotan and Tucker, and with input from the City Attorney prepare a status report for presentation to Council. The motion was seconded by Councilman Ruth and carried on the following roll call vote: AYES : SHAW, RUTH, DYDA, BUERK & MAYOR RYAN NOES : NONE JOINT POWERS AGREEMENT It was the general consensus that this (902) matter would be discussed at the Adj . Regular meeting scheduled to be held on Tuesday, December 13th. AUDIENCE QUESTIONS Planning Commission Chairman John McTaggart requested the Council ' s per- mission for commission member Mel Hughes Council 742 December 6, 1977 to spend a number of hours with the City Attorney discussing the upper Nike Site. It was the consensus of Council that Mr. Hughes be allowed to confer with the City Attorney. Planning Commissioner Mel Hughes urged the Council to set a date for a work session on the Antenna Ordinance. PALOS VERDES DRIVE EAST The Director of Public Works reported that (1407) notices had been prepared to send to homeowners who had not cleared away bushes= etc. along the public right_of_way. Notices will be mailed to each of the homeowners and will be posted along the public right-of-way. If residents did not respond by the end of the week, the City would then clear away these bushes and charge the property owner. F.A.U. PROJECT Councilwoman Shaw moved, seconded by (601) Councilman Dyda to authorize the Mayor to sign the Local Agency-State Agreement for Federal Aid Projects. The motion carried on the following roll call vote: AYES: SHAW, RUTH, DYDA, BUERK & MAYOR RYAN NOES: NONE On motion of Councilman Dyda, seconded by Councilwoman Shaw, the consent calendar was approved as follows : MINUTES: Approved as presented the minutes of November 1, November 10th, and November 22nd. SPECIAL PARK & Approved the Board of Directors for RECREATION DISTRICTS Miraleste, Ridgecrest and El Prado (1201) Special Park & Recreation Districts. TRACT NO. 29795 Approved agreements for construction and SEWER AGREEMENT connection of sewers as required by conditions (1402) of approval for this tract. REGISTER OF DEMANDS Approved RESOL. NO. 77-96 OF THE CITY COUNCIL RESOL. NO. 77-96 OF THE CITY OF RANCHO PALOS VERDES ALLOWING (1504) CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $697 , 367. 39 --- DEMAND NUMBERS 4202 THROUGH 4204, AND DEMAND NUMBERS 4206 THROUGH 4262. The motion to approve the consent calendar carried on the following roll call vote : AYES : SHAW, RUTH, DYDA, BUERK & MAYOR RYAN NOES: NONE # # # # # # # # # # # ITEMS REMOVED FROM. THE CONSENT CALENDAR: MINUTES OF Councilwoman Shaw moved that the sixth NOVEMBER 15TH paragraph on Page 732 ("After consideration. . . to the parking problem. " ) be deleted in its entirety from the minutes. The motion was seconded by Councilman Dyda. There being no objection, MAYOR RYAN SO ORDERED. Council 743 December 6, 1977 Councilwoman Shaw moved, seconded by Councilman Dyda to approve the minutes of November 15, 1977 as amended. SUBDIVISION AGREEMENT After clarification of some of the (STORM DRAIN) TRACT NO. 30583 provisions of this agreement, Councilman (1411) Dyda moved, seconded by Councilwoman Shaw to approve the subdivision agreements presented for tract No. 30583. RECESS TO EXECUTIVE SESSION Councilwoman Shaw moved, seconded by Councilman Dyda to recess to executive session, the hour being 9 :30 P.M. ADJOURNMENT: At 10 :58 P.M. , Council reconvened with the same members present.
