CC MINS 19780607 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR ADJOURNED MEETING JUNE 7, 1978 The meeting was called to order at 9:00 P.M. by Mayor Ken Dyda at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard, notice having been given with affidavit thereto on file. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT RYAN, SHAW, HEIN AND MAYOR DYDA II/ LATE ARRIVAL: BUERK (at 9:05 P.M.) Also present were City Manager Leonard Wood, Director of Planning Sharon W. Hightower, Director of Public Works Dennis Pikus, Community Services Officer Tom Bandy, Administrative Services Officer George Wunderlin and Deputy City Clerk Mary Jo Lofthus. ORDINANCE NO. 98 ORDINANCE NO. 98 OF THE CITY OF RANCHO ANIMAL CONTROL PALOS VERDES CONCERNING ANIMAL CONTROL AND (104) AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title. It was moved by Councilwoman Shaw, seconded by Councilman Ryan that further reading be waived, and Ordinance No. 98 be passed to second reading. 911 EMERGENCY TELEPHONE Director Pikus presented the staff memorandum SYSTEM of May 25, 1978 which explained that state (401) law requires every local public agency to establish a 911 Emergency Telephone System, or to be a part of a 911 System established by another agency. Since Rancho Palos Verdes contracts with the County Sheriff and is part of the Fire Protection District, the County will be preparing the City's 911 System. Staff recommended that the City Council adopt the proposed minute resolution. Councilman Ryan moved that adoption of the proposed minute order be contingent upon state funding, since this was a state mandated program. The motion was seconded by Councilwoman Hein and carried unanimously. Mayor Dyda moved, seconded by Councilman Buerk, to adopt the proposed minute order authorizing and directing the City Manager to file the necessary documents stating intent to participate in Los Angeles County's 911 Emergency Telephone System Plan in compliance with Government Code Section 53100. The motion carried unanimously. ORDINANCE NO. 96 Mr. Ray Brunstrom, representing the Los ADOPTING BY REFERENCE THE Angeles County Fire Department, briefed the FIRE CODE OF THE COUNTY OF Council on the provisions and necessity for LOS ANGELES COUNTY adopting this proposed ordinance. (603) ORDINANCE NO. 96 OF THE CITY OF RANCHO PALOS VERDES ADOPTING BY REFERENCE PURSUANT TO SECTION 50022.2 OF THE GOVERNMENT CODE, THE FIRE CODE OF THE COUNTY OF LOS ANGELES, BEING ORDINANCE NO. 2947 AS AMENDED BY ORDINANCE NO. 11,556 ADOPTING WITH AMENDMENTS THE UNIFORM FIRE CODE OF THE WESTERN FIRE CHIEFS ASSOCIATION AND THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title. It was moved by Councilman Ryan, seconded by Councilwoman Shaw that further reading be waived and Ordinance No. 99 be passed to a second reading. VARIANCE NO. 27 Director Hightower presented the staff APPLICANT: ALL CITIES ENGINEERING memorandum of June 6, 1978 which indicated LOCATION: TRACT NO. 22946 that the Planning Commission denied this (1804 x 1411) variance for the inability to make all necessary findings; however at the same meeting the Planning Commission approved parcel map 10241 which allowed for two lots. The applicant was now appealing the Commission's denial of the variance for the third lot which was below the minimum 871 lot size. In light of the fact that no significant or new information had been sub- mitted: since there was nothing exceptional or extraordinary about this land: that no substantial property right of the applicant was being jeopardized: and, that grant- ing a variance of this type would be in conflict with the General Plan, staff recom- mended that the Council affirm the decision of the Commission and dismiss the appeal. Mr. Darwin Cooper, the appellant and landowner, described the terrain of this property and explained the proposed building for this lot. Council inquired of Mr. Cooper if he had any new evidence to present to Council sup- porting his appeal for this variance. Mr. Cooper responded in the negative. Councilman Buerk moved,that in view of the fact that no additional information had been presented that could reverse the Planning Commission's decision, that the appeal be dismissed and the decision of the Planning Commission affirmed. The motion was seconded by Councilman Ryan and carried unanimously. ADOPTION OF UNIFORM SOLAR Planning Director Hightower told the Council ENERGY CODE that in response to their request, she had (201) reviewed the Uniform Solar Energy Code which was adopted by Los Angeles County on March 30, 1978. It was staff's recommendation that the Council request the City Attorney to draft an ordinance adopting a similar code. Councilwoman Shaw so moved. The motion was seconded by Councilman Ryan and carried unanimously. # # # # # On motion of Councilman Buerk, seconded by Councilman Ryan, the Consent Calendar was approved as follows: MINUTES Approved as presented the minutes of April 17, May 9, and May 16, 1978. RESOLUTION NO. 78-34 ADOPTED RESOLUTION NO. 78-34 OF THE CITY REGISTER OF DEMANDS OF RANCHO PALOS VERDES ALLOWING CERTAIN (1504) CLAIMS AND DEMANDS IN THE SUM OF $824,963.83, DEMAND NUMBERS 4918 THROUGH 4994. THOMAS J. POWER Db iied the claim from Thomas J. Power for CLAIM FOR DAMAGES damage to personal property. (303) TENTATIVE TRACT NO. 33034- Approved Extension of Tentative Tract No. REQUEST FOR EXTENSION 33034 (south of terminus of Calle de Suenos) . (1411) RESOLUTION NO. 78-35 ADOPTED RESOLUTION NO. 78-35 OF THE CITY TEMPORARILY CLOSING COUNCIL OF THE CITY OF RANCHO PALOS VERDES INDIAN PEAK ROAD TEMPORARILY CLOSING A PORTION OF INDIAN PEAK (305) ROAD ON SATURDAY, JULY 15, 1978. ANIMAL SERVICES AGREEMENT Approved Amendment to the Animal Services (104) Agreement with the Southern California Humane Society. RESOLUTION NO. 78-39 ADOPTED RESOLUTION NO. 78-39 OF THE CITY ANIMAL CONTROL FEES COUNCIL OF THE CITY OF RANCHO PALOS VERDES (104) ESTABLISHING FEES TO BE CHARGED AND BAIL TO BE SET UNDER THE ANIMAL CONTROL ORDINANCE. Council 872 June 7, 1978 STREET SWEEPING- Approved staff recommendation that this DEL CERRO AREA area be added to the regular street sweeping (1405) schedule. RESOLUTION NO. 78-40 ADOPTED RESOLUTION NO. 78-40 OF THE CITY PARCEL MAP 2373 AND COUNCIL OF THE CITY OF RANCHO PALOS VERDES VARIANCE NO. 20 APPROVING TENTATIVE PARCEL MAP NO. 2373 (1804 x 1410) AND VARIANCE NO. 20. # # # # # PARKING AT ABALONE COVE- Councilman Ryan briefed the Council on COASTAL COMMISSION MEETING the status of the parking situation at III (109) Abalone Cove. It was his intention to meet with members of the County Department of Beaches, and the Coastal Commission and con- sider the possibility of a permit system for parking at Abalone Cove. SCAG Councilwoman Hein told the Council that she would be attending a meeting of SCAG and it was her intention to raise the issue of expenditure of local funds on SCAG mandated programs. It was the consensus of Council that any time legislation is passed that would affect the City's budget or General Plan Council Members should state their opposition. (At 10:15 P.M. the City Attorney left the meeting.) ADJOURNMENT: At 10:30 P.M. Councilman Ryan moved, seconded by Councilwoman Shaw, to adjourn to Tuesday, June 13, 1978 in Council Chambers for a review of revenue expenditures for fiscal 1978-79.
