REGULAR ADJOURNED MEETING
MAY 9, 1978
The meeting was called to order at 7:35 P.M. in the Community Room, 30942 Hawthorne
Boulevard. Roll call was answered as follows:
PRESENT: BUERK, RYAN, SHAW, AND MAYOR DYDA
ABSENT: HEIN (ARRIVED 7:38 P.M.)
ALSO PRESENT: DIRECTOR OF PLANNING HIGHTOWER
Councilman Buerk requested to add the Panorama Ad to the agenda.
WORK SESSION: Council reviewed the draft minutes of the work
TREE TRIMMING AMENDMENT session of April 24, 1978.

Testing Period on City Trees
a. It was agreed to establish a test period
beginning July 1, for six months, using the Environmental Committee to act as an
"Arbitration Committee."
b. Charge to Environmental Committee
The basic charge to the Committee
is to conduct the test period, testing
the approach of the draft ordinance and reporting back to Council on changes needed.
(1) Use of draft ordinance
It was agreed to use the draft
ordinance (Planning Commission
draft dated January 19, 1978) with one change to Section 9697, Appeals. Appeals
can be made only on basis of procedural flaw or that the criteria was inappropriate,
inadequate, or unworkable, and the appellant must indicate how and why. It was also
agreed that the Staff would incorporate the applicable parts of the draft into the
charge to the Committee to be approved by Council.
(2) Use of Staff
Staff will provide the required
clerical assistance such as set-
ting up files, agendas, etc. and supply public information but not do any investigation
work, write Staff reports, etc. The Committee is to do the field inspection,
analysis of the complaint, and decision-making.
(3) Meetings
Committee would use its regular
meeting schedule, as necessary.
II/ (4) Notification
Notice of hearing should be sent
to complainant, first and second
adjacent property owners, homeowners association of complainant and where tree(s)
located.
(5) Authority
Committee should make decisions with
appeal to Council.
(6) Trimming
Section 9696, B applies with
complainant reviewing the three bids, giving check to City to cover low bid amount,
and City controlling contract.

(7) Feedback
Committee should provide feed-
back to Council at any time and Council can make changes in the charge to the
Committee.
(8) Criteria for accepting complaints
It was agreed to leave complaints
open to any number, type, etc. to see how ordinance works.
(9) Fees
A nominal fee of $15 will be
charged for processing during test period. This will provide time to determine
future fee.
(10) Orientation
Mayor Dyda will talk to Committee
Chairman to discuss how the test will proceed.
The meeting was recessed at 9:40 P.M. and reconvened at 9:45 P.M. with the same
members present.
Continued Discussion of Draft Ordinance
It was moved by Councilwoman Hein, seconded
by Councilman Ryan, and passed to defer con-
tinued discussion of existing areas of private trees for three months (to Oct. 1)
and to meet with City Attorney at that time.
PANORAMA AD Councilman Buerk moved, seconded by Council-
woman Hein, and passed to adopt ad concept
#1 (drafted by Tom Bandy) with some editing, adding ideas of citizen involvement
and concern with entire Peninsula, and deleting antenna height regulations from
listing.
ADJOURNMENT The meeting was adjourned at 10:15 P.M. to
Monday, May 15, 1978 for a work session on
the antenna height amendment.
