CC MINS 19791218 M I NUT E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING DECEMBER 18, 1979 The meeting was called to order at 7:35 P.M. by Mayor Pro Tem Barbara Hein at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: II/ AYES: RYAN, BUERK, & MAYOR PRO TEM HEIN LATE ARRIVAL: DYDA AT 9:40 P.M. ABSENT: MAYOR SHAW Also present were City Attorney Patrick Coughlan, City Manager Leonard Wood, Director of Planning Sharon Hightower, Acting Director of Public Works Maynard Crowther, Director of Parks and Recreation Maynard Law, Administrative Services Officer George Wunderlin, and Deputy City Clerk Mary Jo Lof thus. APPROVAL OF AGENDA Mayor Pro Tem Hein added Traffic Committee consideration of lowering the speed limit on Palos Verdes Drive South. Councilman Ryan moved, seconded by Councilman Buerk to approve the agenda as amended. The motion carried unanimously. • Councilman Buerk moved, seconded by Councilman Ryan to set a time to adjourn at 11:00 P.M. The motion carried unanimously. Since Councilman Dyda could not be in attendance at the meeting until 9:30 P.M. Councilman Ryan moved, seconded by Mayor Pro Tem Hein to discuss Item Nos. 12 and 22 at 9:40 P.M. The motion carried on a two - one vote with Councilman Buerk voting in opposition. The motion carried unanimously. It was the consensus of Council that this was an urgent matter and should be acted on accordingly by the Traffic Committee. RECESS At 9:00 P.M. Mayor Pro Tem Hein declared a recess. At 9:18 P.M. the meeting reconvened with the same members present. PUBLIC WORKS MANAGEMENT Referring to the material distributed to SERVICES Council regarding Roy Jorgensen Associates, City Manager Wood suggested that the Council hold a Work Session on January 14, to discuss this matter. TIME LINE FOR ASSESSMENT Community Services Officer Bandy summarized DISTRICT the staff report of December 12, 1979 and (1801) a time line for the formation of this district. He stated that a public hearing for its formation could be held as early as February 19, 1980. Councilman Buerk moved, seconded by Councilman Ryan and unanimously carried to adopt the proposed time line. APPEAL OF NEGATIVE DECLARATION City Attorney Coughlan explained the purpose LANDOWNER: ASCENSION LUTHERAN CHURCH of an Environmental Impact Report. With (1803) regard to this appeal, he said that the issue was whether the City should prepare an EIR on this lot split. The Council would have to determine the adequacy of the initial study dealing with the environmental impacts. If the Council determines that an EIR is required then the report would deal only with those matters that were significantly environmentally concerned and for which not mitigating measures could be proposed. He went on to say that an EIR does no approve or stop a project; it is an administrative procedure in the approval process of lot splits. The initial study is a summarized version of information contained in an EIR. When the City was incorporated an EIR was performed and that recommended low density for canyon and areas of extreme slope. Responding to Council's inquiry, Director Hightower stated that this area was zoned RS-A5 which allows for lots no smaller than five acres and that overlay controls and code standards would limit construction and grading thereby maintaining much of the natural character. City Attorney Coughlan said that if the project has the potential for significant environmental impacts that the conditions be approved with mitigating measures; development could be limited to lots where access is more readily available. Director Hightower then presented the staff memorandum of December 18, 1979 which recommended that the Council uphold the Final Negative Declaration since the impacts will not be significant and since the appellants have failed to provide evidence to the contrary. Speaking in favor of this negative declaration and representing Ascension Lutheran Church, was Jack Duston, 2905 Via Anacapa. He said that the church bought this canyon 13 years ago and needed this lot split to enlarge their parking facilities; the church could no longer afford the expense of maintaining the canyon. (At 9:50 P.M. Councilman Dyda arrived and was present for the remainder of the meeting.)
