CC MINS 19791016 MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING OCTOBER 16, 1979 The meeting was called to order at 7:31 P.M. by Mayor Ann Shaw at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. After the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: RYAN, HEIN, DYDA & MAYOR SHAW ABSENT: BUERK Also present were City Attorney Patrick Coughlan, City Manager Leonard G. Wood, Director of Planning Sharon Hightower, Director of Public Works Dennis Pikus, Community Services Officer Tom Bandy, Administrative Services Officer George Wunderlin and Deputy City Clerk Mary Jo Lofthus. APPROVAL OF AGENDA The following items were added to the agenda: School Closings (Ryan) , Seacove Drain (Ryan) , Housing and Community Development Status (Ryan) , Storm Drains (Ryan) , SCAG (Hein), Ordinance Subcommittee Report (Hein) , Landslide Subcommittee Report (Dyda) , Letter from the County Board of Supervisors regarding the transit strike (Shaw) , and Letter from the Committee for Proposition "A" (Shaw). The amended agenda was approved on motion of Councilwoman Hein, seconded by Councilman Dyda and unanimously carried. CEREMONIAL MATTER Mayor Shaw presented proclamations to Bruce and Ken Finwall in recognition of their outstanding performance during the running of the 1979 Southern California Soap Box Derby Championships. Mayor Shaw also presented a proclamation to Dennis Pikus in recognition of his employment as Director of Public Works from November 20, 1974 to October 19, 1979. WAIVER OF FULL READING OF Councilman Dyda moved, seconded by Councilman Ryan RESOLUTIONS & ORDINANCES and unanimously carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading to be deemed to be given by all members of Council after the reading of title unless specific request was made at that time for the reading of such ordinance or resolution. The motion carried on a three - one vote, with Mayor Shaw voting in opposition. Mr. Jack Jacobs, 3570 Heroic Drive, urged the Council to support this proposition. RECESS At 9:06 P.M. Mayor Shaw declared a brief recess. At 9:18 P.M. the meeting reconvened. DAVID ENGLISH LANDSLIDE After reading the correspondence submitted by (1801) Mr. English, it was the consensus of Council that no further discussion of this matter was necessary. COUNCIL RETREAT Councilwoman Hein distributed a proposed agenda for the Council retreat. In checking for available facilities for this retreat, staff has found that Marymount College will be available on December 1. During Council discussion the suggestion was made that consideration be given to the use of a moderator for this retreat. Council agreed to put this matter on the agenda for the November 6 Council Meeting and decide on a date for the retreat at that time. COASTAL COMMISSION PLAN Mayor Shaw reported on the Commission's visit (701) to the City to view the coastal area. City Manager Wood requested Council's authorization to enter into an agreement with a consultant for the preparation of a review of the traffic analysis in the Rancho Palos Verdes' Coastal Specific Plan and for the preparation of a traffic study which evaluates the impact of land use density changes to said Plan as required by the Coastal Commission. The cost of this review is not to exceed $3,800. Councilman Ryan moved, seconded by Councilwoman Hein to authorize the City Attorney to meet with the Attorney General for a clarification of the State's mandatory housing elements and the Coastal Commission's authority to impose those elements. The motion carried unanimously. Councilman Dyda moved, seconded by Councilman Ryan to authorize the staff to enter into an agreement not to exceed $3,800 for the traffic review study. The motion carried on the following roll call vote: AYES: RYAN, HEIN, DYDA & MAYOR SHAW NOES: NONE SCHOOL CLOSINGS Since the School Board is considering the closure (1502 x 1401) of three schools located within the City, Council- man Ryan said he felt the Traffic Committee should be involved in the studies insofar as determining safe routes to school is concerned. Councilman Ryan moved, seconded by Councilwoman Hein to endorse the Mayor's September 27 letter to the .School Board and to inform the Board of this endorse- ment. Also, that the School Committee be informed on this action. The motion carried unanimously. SEACOVE DRAIN In response to Council's inquiry, Director Pikus (604) said that the Seacove drain project would be completed in 30 days. Staff was requested to check the area for debris. HCD HOUSING GUIDELINES Councilman Ryan reported that a hearing would be (1203) held on the housing guidelines on October 29, 1979. It was the consensus of Council that a representative from Council and/or staff should attend this meeting. CITY COUNCIL -4- OCTOBER 16, 1979 STORM DRAINS In response to Council's inquiry, Director Pikus said that the storm drains in the City are routinely inspected and cleaned out during the summer months. Presently, the crew is at the north end of the City and should be finished inspecting all of the drains within two weeks. SCAG - HCDA FUNDS Councilwoman Hein reported that the request from (1203) the City of Lomita for HCDA funds is twelfth on a list of fifteen such requests. ORDINANCE SUBCOMMITTEE Councilwoman Hein distributed copies of the sub- (306) committee's memorandum dealing with decorative wrought iron fences within the front yard setback. Council discussion indicated that consideration should be given to front yards on the corner of major arterials, but that each request should be treated on an individual basis. Also, that wrought iron fences and chain link fences should be treated separately. The suggestion was made that the subcommittee should meet with the Planning Commission's ordinance subcommittee. It was the consensus of Council that the subcommittee develop an ordinance dealing with wrought iron (non-block and non-chain link) fences on property lines. Council discussion concluded with the matter being remanded back to the subcommittee to consider fences that are open and decorative in nature and to make a recommendation on the height limitation for these fences. LANDSLIDE SUBCOMMITTEE Councilman Dyda reported that the subcommittee had REPORT held two meetings: one with the County Engineer (1801) Building Department to discuss the alternatives and procedures available and with the City's geologist to discuss the question of dirt being used as fill on Palos Verdes Drive South, as well as dirt that should be made available to use in the Portuguese Bend area for remedial crack repair. Since both of these issues are rather lengthy, it was the recommendation of the subcommittee that Council hold a work session to discuss these items. Council agreed to hold such a session on Wednesday, October 24 at 7:30 P.M. AUDIENCE QUESTIONS: REFUND POLICY ON FEES Mr. Jack Jacobs, 3570 Heroic Drive, requested (1203) that the Council review its policy regarding the refund of fees on appeals. Since the Council had granted his appeal which had been denied by the Planning Commission, he felt that the Planning Commission appeal fee should also be refunded. Councilwoman Hein moved, seconded by Councilman Ryan, to have staff examine the history of the City's refund policy. The motion carried unanimously. Council requested that this item be placed on the November 6 agenda. PARCEL MAP NO. 5649 - APPEAL Director Hightower reviewed the staff memorandum of OF PLANNING COMMISSION DECISION October 16, 1979 which reviewed the Planning (1410) Commission's denial of this appeal. The applicant's attorney, Owen Petersen, 21515 Hawthorne Boulevard, referred to the amendment of the Subdivision Map Act which excluded lot line adjustments of this type from any of the requirements of the Act, including the requirement that bonds be paid prior to the approval of the adjustment. Council then briefly discussed the new ordinance being drawn up by the City Attorney which encompasses this amendment of the Map Act; what the applicant would be required to submit to the City when he reapplies under this new ordinance. Councilman Dyda moved, seconded by Councilman Ryan that the City waive the lot line adjustment fee for this particular parcel when the applicant reapplies. The motion carried unanimously. The applicant's attorney withdrew his appeal. CITY COUNCIL -5- OCTOBER 16, 1979 (At 10:25 P.M. City Attorney Coughlan left the meeting.) RESOL. NO. 79-82 - Director Pikus reviewed the staff report of October STOP SIGN REGULATIONS 10 and the recommendation that Council authorize (1502) staff to install "No Beach Access" signs at Paseo del Mar and Palos Verdes Drive South. Also, that staff be instructed to include funds in the 1980-81 budget for the installation of a painted median with raised reflective markings on Paseo del Mar. Councilman Dyda moved, seconded by Councilman Ryan and unanimously carried to authorize staff to install the "No Beach Access" signs at Paseo del Mar and Palos Verdes Drive South. Councilman Ryan moved, seconded by Councilman Dyda, to allocate $1,500 for the installation of the recommended A.C. paving on the north side of Palos Verdes Drive South at Schooner Drive and Conqueror Drive to aid westbound right turn movements. The motion carried on the following roll call vote: AYES: RYAN, DYDA, HEIN & MAYOR SHAW NOES: NONE RESOLUTION NO. 79-82 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISH- ING STOP REGULATIONS AT CERTAIN INTERSECTIONS WITHIN THE CITY OF RANCHO PALOS VERDES was read by title and ADOPTED on motion of Councilman Dyda, seconded by Councilman Ryan and unanimously carried. Councilman Dyda moved, seconded by Councilwoman Hein to remand the recommendation on the painted median with raised reflective markings on Paseo del Mar back to the Traffic Committee with the suggestion that they install a more physical and effective barrier; the committee is to bring back a cost estimate. The motion carried unanimously. RECESS TO EXECUTIVE At 10:40 P.M. on motion of Councilman Dyda, SESSION seconded by Councilwoman Hein and unanimously carried, Council recessed to executive session for discussion of personnel matters. The meeting reconvened at 11:50 P.M. SALARY RANGES Councilman Dyda moved, seconded by Councilwoman Hein and unanimously carried to adopt the staff recommended salary ranges as amended. Council directed staff when providing survey information to provide only the beginning salaries for each range. ADJOURNMENT At 11:52 P.M.
