CC MINS 19790629 ADJ M I NUT E S RANCHO PALOS VERDES CITY COUNCIL REGULAR ADJOURNED MEETING JUNE 29, 1979 The meeting was called to order at 7:48 P.M. by Mayor Ann Shaw at the Palos Verdes Peninsula Unified School District Building, 30942 Hawthorne Boulevard, notice having been given with affidavit thereto on file. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: RYAN, BUERK, HEIN, DYDA AND MAYOR SHAW ABSENT: NONE Also present were Acting City Attorney Rochelle Browne, City Manager Leonard G. Wood, Administrative Assistant Trish Hanelin, Administrative Services Officer George Wunderlin, and Deputy City Clerk Mary Jo Lofthus. Mayor Shaw explained that this meeting would be conducted like a regular public hearing. EASTVIEW ANNEXATION Mayor Shaw declared the hearing open (105) and the Clerk reported that notice has been published and posted pursuant to the Municipal Organization Act ("MORGA") , Government Code Sections 35055, 35222 and 35223. City Manager Wood stated that letters of protest had been received by the City and were posted at the entrance to Council Chambers. Additionally, letters had been re- ceived from Homeowners' Associations within the City of Rancho Palos Verdes; only protests received from the Eastview area would have any bearing on the annexation. Mr. Wood further explained the process to be followed should written protests be in excess of 50% or less than 25% of the registered voters and property owners in the area; the effect of continuing this hearing in terms of placing the issue on the November, 1979 ballot or the April, 1980 ballot, and the cost to the City of conducting such an election. Commenting that this matter had already been discussed by Council at one public meeting and had been heard by LAFCO at two formal public hearing, he recommended that comments at this meeting be directed toward protest, continuance to a later date, or the stoppage of all annexation proceedings. It was the consensus of Council that this hearing should deal with the protests from the residents of the Eastview area. Mr. Ray Wakeland, 28605 Gunter Road, presented a total of 136 pages of signed petitions by registered voters and property owners protesting this annexation. Speaking in opposition to the annexation were the following residents of the Eastview area: Douglas Crandall, 2010 MacArthur Street, Homer R. Pountious, 1982 General Street, and Nettie Prager, 29318 Highmore. Representing the Citizens Against Forced Annexation, Tony Camino, 3719 Vigilance Drive, Rancho Palos Verdes, told the Council that his organization had filed a suit against LAFCO and that a temporary restraining order and a preliminary injunction had been issued which prevents LAFCO from executing a certificate of completion on the annexation. He said his group was requesting the right to vote either for or against this annexation and requested that the City join in this law suit as an interested party. It was the consensus of the Council that since this hearing was to deal only with protests or postponement of a decision on the annexation, this was not the appropriate time to discuss the law suit. -1- City Attorney Browne commented that the Restraining Order had been issued against LAFCO and that it would have no bearing on any decision made by the Council at this meeting. Councilman Buerk moved, seconded by Councilman Dyda, to request the City Attorney to review this law suit and restraining order and report back to the Council at the next meeting. The motion carried unanimously. Representing Los Angeles County Supervisor Yvonne Burke, was Julie Frederick who said that Mrs. Burke opposed forced annexation of, or into any area. Mr. H. Champlin, 1600 N. Broadway, Santa Ana, representing the San Pedro Homeowners Coalition, stated that the scope of the meeting had been correctly stated; the only question that remained now was the qualification of the signatures submitted by those protesting the annexation. Speaking in favor of the annexation were the following residents of the Eastview area: Donald Seal, 4883 Blackhorse Road, Carrick E. Wildon, 1923 Valletta Drive, Richard Brunner, 1926 Peninsula Verde Drive, David Roche, 1884 Peninsula Verde Drive, John Siebold, 1601 W. Caddington, Larry H. Jonnson, 1830 Avenida Feliciano, Van Ho, 1621 W. Caddington Drive, Edward A. Orzechowski, 1815 Toscanini Drive, Linda West 2037 Avenida Aprenda, and Booth Tarkington, 1902 Peninsula Verde Drive. RECESS At 9:15 P.M. Mayor Shaw declared a brief recess. At 9:25 P.M. the meeting reconvened. There was no response to the Mayor's call for additional public participation in the hearing. Council discussion then followed on how long it would take to verify the protest signatures; the date the hearing could be continued to, and if the petition was worded correctly since concern was expressed that perhaps it called for an election on the matter instead of protesting the annexation. Suggesting that the petitions be checked by the City Attorney and Registrar of Voters as to their correct form, Councilman Ryan moved, seconded by Councilman Dyda to continue the public hearing until the July 3rd meeting. Referring to the Time Schedule Governing an Annexation Vote which accompanied Council's agenda package, further discussion ensued regarding continuance of this matter in order to validate the signatures and placing the issue on the November, 1979 ballot. Councilman Buerk moved, seconded by Councilwoman Hein, to amend Councilman Ryan's motion and continue the matter until July 24th. (With the consent of the second, Councilman Buerk later withdrew this amendment.) With the consent of the second, Councilman Ryan withdrew his motion to continue to July 3rd. The motion carried unanimously. Councilman Dyda moved, seconded by Councilman Buerk to continue the hearing for the purpose of accepting additional protest petitions but not additional testimony until July 17th.
