CC MINS 19811117 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL ADJOURNED REGULAR MEETING NOVEMBER 17, 1981 The meeting was called to order at 7:40 P.M. by Mayor Jacki Bacharach at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. After the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: SHAW, DYDA & MAYOR BACHARACH LATE ARRIVAL: RYAN AT 7:43 P.M. ABSENT: HEIN Also present were City Manager Donald Guluzzy, City Attorney Patrick Coughlan, Director of Public Works Carl Abel, Director of Planning Sharon W. Hightower, Associate Civil Engineer Gordon Siebert, Assistant Planner Alice Angus, Director of Community Services Tom Bandy, Director of Parks & Recreation Maynard Law, Director of Administrative Services Kiti Laisure, and Deputy City Clerk Mary Jo Lof thus. APPROVAL OF AGENDA The City Manager requested that the follow- ing items be added to the agenda: PEMS work- shop, Election Consolidation, and TM Ladera Linda Agreement. The agenda as amended was approved on motion of Councilman Dyda, seconded by Councilwoman Shaw and carried. WAIVER OF FULL READING OF Councilman Dyda moved, seconded by Council- ORDINANCES & RESOLUTIONS woman Shaw and carried to waive reading in full of all ordinances & resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all members of Council after reading of the title unless specific request was made at that time for reading of such ordinance or resolution. 1/ 11 # If 11 /1 # # CONSENT CALENDAR The Consent Calendar was approved as follows on motion of Councilwoman Shaw, seconded by Councilman Dyda. MINUTES Approved as presented the minutes of November 4, 1981. (Councilman Dyda abstained from voting on the minutes because he was not present at that meeting.) RESOLUTION NO. 81-82 ADOPTED RESOLUTION NO. 81-82 OF THE CITY REGISTER OF DEMANDS COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $386,403.79, DEMAND NUMBERS 10508 THROUGH 10566. RESOLUTION NO. 81-83 ADOPTED RESOLUTION NO. 81-83 OF THE CITY SUPPLEMENTAL REGISTER OF DEMANDS COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $12,278.71, DEMAND NUMBERS 10567 THROUGH 10570. SALE OF SURPLUS EQUIPMENT Authorized staff to sell the surplus (302) equipment as listed in the staff memorandum of November 9th. TRACT NO. 34834 - EXONERATION Accepted the sanitary sewer improvements OF PERFORMANCE BOND and exonerated the faithful performance bond. (1411) TRACT NO. 32991 - EXONERATION Accepted the sanitary sewer improvements OF FAITHFUL PERFORMANCE BOND and exonerated the faithful performance (1411) bond. TRACT NO. 32614 - RELEASE OF Released fifty percent of the bond amount LANDSCAPE BOND until such time that the remainder is (1411) acceptable to the City, the remaining fifty percent will be retained. PARCEL MAP NO. 14369 - Approved Parcel Map No. 14369 and accepted ACCEPTANCE OF DEDICATION RIGHTS TO dedication of access rights to the City. THE CITY (1408 x 1410) SATTES DRIVE STORM CULVERT Authorized repair of storm culvert REPAIR at 6304 Sattes Drive at an estimated (604) cost of $1,100. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: RYAN, SHAW, DYDA & MAYOR BACHARACH NOES: NONE ABSENT: HEIN # II # 1/ II # 11 11 11 GRADING APPLICATION NO. 528 - Director Hightower presented the staff APPEAL OF PLANNING COMMISSION'S memorandum of November 17th which re- APPROVAL commended continuing this matter for an (1801) additional 30 days to allow the applicant to submit the title policy to the City Attorney for review. The appellant in this matter Mrs Stella Real requested Council continue it until some- time in January, 1982. Representing the applicant in this matter was attorney Karen Rothberg, 21515 Hawthorne Boulevard, Torrance, who agreed with this continuance. Councilwoman Shaw moved, seconded by Councilman Dyda and carried to continue this matter until the first meeting in January, 1982. LANDSCAPING AT VARIOUS Public Works Director Carl Abel present- LOCATIONS - PROJECT NO. 81-45 ed the staff memorandum of November 17th (1405) which listed the bids received for land- scaping certain sections of Montemalaga Drive, Highridge Road and Hawthorne Blvd./ Whitley Collins. Staff recommended the following: (1) Council reject the qualifying statement by Environment Planning, Inc. (2) Reject all individual bids and award Project No. 81-45, the combined project, to Environment Planning, Inc. , the lowest and most reasonable bidder. (3) Authorize transfer of $10,000 from sprinkler repair (01-4404-491) to Hawthorne Boulevard/Whitley Collins (30-4901-458), (4) Appropriate $11,612 from Capital Reserve Fund balances for completion of these projects. After Council discussion of what project this transfer of funds would effect and the balance in the contingency reserve fund, Council requested that they be informed of the balance remaining in funds when money is being transferred. Councilman Dyda moved, seconded by Councilman Ryan and carried to adopt staff recom- mendations 1 through 4 and authorize the Mayor and City Clerk to sign a contract with Environment Planning, Inc. MONTEMALAGA/SILVER SPUR Director Abel presented the staff report TRAFFIC SIGNAL of November 17th which recommended that (1503) the City Council approve the City of Rolling Hills Estates installing a traffic signal at Montemalaga Drive and Silver Spur Road and contribute one-third of the cost with a maximum contribution of $7,000. Council then discussed the type of light that will be installed, whether it was electro mechanical or electronic. CITY COUNCIL -2- 11/17/81 Chuck Sanderson, 5400 Montemalaga Drive, said he was concerned about the type of light to be installed and the increase in traffic and noise on Montemalaga. Council discussion then followed on how this light would affect the flow of traffic, if the Council could see the final design before implementation and changes that might occur in the crosswalk striping. Councilwoman Shaw moved, seconded by Councilman Dyda and carried to table this item until the next meeting. HEIGHT VARIATION NO. 186 - Assistant Planner Alice Angus presented APPEAL OF PLANNING COMMISSION'S the staff report of November 17th which DENIAL described this addition above an existing (1804) garage. Staff denied this request and 11/ the applicants subsequently appealed that decision to the Planning Commission who also denied the project. Speaking against this addition were the following residents of the area: Mr. & Mrs. Ronald McDowell, 28925 Geronimo Drive, and Charles Plumley, 29005 Geronimo Drive. These residents questioned if the second story was the best design, how this project would effect their view and property value. Council then discussed the effects this addition would have on views, particularly that of the Plumley residence and how much of that view is already blocked by trees. Councilwoman Shaw moved, seconded by Mayor Bacharach to deny the appeal and uphold the Planning Commission's decision based upon the following findings: (1) It cannot be found that the proposed structure is designed and situated in such a manner as to minimize view obstruction. There are other alternatives for the addition; there is a large back yard which could accommodate the desired addition. (2) The view impairment for that portion over sixteen feet significantly impairs the primary view from a property or properties identified as having a view per Section 9113 of the Development Code. Also, that staff prepare an appropriate resolution for adoption at the next meeting. The motion carried on a three - one vote with Councilman Ryan voting in opposition. REQUEST FOR SUPPORT OF Community Services Director Bandy presented DOUG ECKERT MEMORIAL 10K RUN the staff report of November •10, 1981 which (306) outlined this request f dr financial support to offset cbsts involved with. route safety & traffic control for the second annual 10K run. s=.cheduled= for .December. 13. Staff recommended that based upon prior actions, the Council provide support in the form of traffic safety materials and labor not to exceed $400. Additionally, staff felt that the Council should reconsider its policy of support for these events because of restricted fiscal conditions. Council then discussed the past policy of support for such events, and if these requests should be made during the budget process. Representing the Doug Eckert Memorial Committee was Sara Bowlus, 28427 Quailhill Drive, who told the Council that the run would have the same route as last year's race. Also speaking in favor of this support was Joyce Watt, who told the Council that this is the same route as the Library Run and that they were not charged by the City of Rolling Hills Estates last year for police or traffic control. Councilman Ryan moved, seconded by Councilman Dyda and carried to table this item until the second meeting in December. It was the consensus of Council that staff should prepare a report identifying what was budgeted for such charitable functions in the past so a method for handling such requests in future budgets can be established. REOPEN AGENDA Councilwoman Shaw moved, seconded by Mayor Bacharach and carried to reopen the agenda.
