CC MINS 19810923 ADJ M I N U T E S RANCHO PALOS VERDES CITY COUNCIL ADJOURNED REGULAR MEETING SEPTEMBER 23, 1981 The meeting was called to order at 7:30 P.M. by Mayor Bacharach, notice having been given with affidavit thereto on file. Roll call was answered as follows: PRESENT: DYDA, SHAW, RYAN, HEIN & MAYOR BACHARACH ABSENT: NONE Also present were City Attorney Pat Coughlan, Director of Planning Sharon Hightower, Associate Planner Ann Negendank and Acting Deputy City Clerk Marilyn Smith. The Pledge of Allegiance was then led by Mayor Bacharach. APPROVAL OF THE AGENDA On motion of Councilman Ryan, seconded by Councilwoman Shaw, the Agenda was approved as proposed. CONTINUED PUBLIC HEARING - GENERAL Mrs. Negendank reviewed the memorandum to PLAN AMENDMENT NO. 9 - HOUSING ELEMENT City Council of September 23, 1981 in which RESOL. NO. 81-71 (701) the Staff recommended that City Council approve the General Plan Amendment No. 9 as revised September 23, 1981 by adopting Resolution No. 81-71. Mr. Coughlan reviewed some of the legal ramifications affecting the General Plan revision. The meeting was then opened to the public for their comments. Tim Burrell, 4038 Exultant Drive, Rancho Palos Verdes stated that Item #2-D was not appropriate and should be eliminated. John Arand, representing the Council of Homeowners Association, 5731 Mistridge Drive, Rancho Palos Verdes, suggested that Program "L" under Goal IV be removed from the housing element. Councilman Ryan told Mr. Arand that Program "L" was not a commitment but merely a study the Council was going to look into. Mrs. Hightower stated that some elements of an EIR did not have to be duplicated when a master EIR is adopted and that the City was only concerned with specific environmental concerns on a project-by-project basis. Jeanette G. Mucha, 5538 Littlebow Road, Rancho Palos Verdes was concerned with Proposed Program "P". She felt it was very sensitive to developers' needs at the expense of the major goal of the General Plan which is local control over zoning. Philip Doppelt, 29535 Ocean Port Road, Rancho Palos Verdes was concerned with Item "T" under Goal IV. He would like it removed or at least modified to read as follows: "Identify selected sites throughout the City as to feasibility for affordable housing development, preliminary designations to be determined." Elza Cortes, 29681 Highpoint Road, Rancho Palos Verdes spoke in opposition to proposed Program "V" because it went against the basic goal of why the City was formed. She asked City Council to protect the General Plan from the erosion of the philosophy embodied in proposed Program "V". Louella Wike, spokesperson for Mesa Palos Verdes area, 29172 Oceanridge, Rancho Palos Verdes, was concerned with four major points concerning Crestridge and the Institutional Zoning: Does the City have plans for public housing at that site? A plan in for mixed use commer- cialization? High density permitted? Any change in height ordinance? Mayor Bacharach replied no to all questions. Emily Culp, representing the Sunnyside Community Association, 2321 Sunnyside, Rancho Palos Verdes, asked the Council to keep down the density. Bill Brandlin, 5201 Middlecrest Road, Rancho Palos Verdes, felt that. Programs "P" and "V" were not necessary in the proposed amendment because they were already provided in the General Plan. He interpreted those programs to mean that the City was going to provide help through direct involvement of financing and reducing the processing time. He could live with Program "P" if the word "financing" was eliminated. Nels Nelson, 5464 Middlecrest Road, Rancho Palos Verdes wanted clarification from the Council on how affordable housing would be financed. Councilman Dyda explained that when taxpayers finance such ventures--be it local, State, or Federal funds, the more local control the taxpayer had, the better off he would be. Jan Thielman, President of the Ridgecrest Homeowners Association, 28955 Crestridge Road, Rancho Palos Verdes, urged the Council to delete Items "P", "T", "V" and "L" if they were not specifically required by law. The Association was against development of low income-high density housing because it would have an adverse impact on property values and traffic conditions and would give need for emergency and other municipal services as well as lowering the high standards of the neighborhood and the community. Fern Jones, 28950 Crestridge Road, Rancho Palos Verdes, asked if, in fact, the RPV housing element was in violation of the current law, and if it was necessary for the City to make zoning changes. She reminded the Council that Crestridge was being used for affordable housing through the church related housing units. Glenn Arbuthnot, 28856 Crestridge Road, Rancho Palos Verdes, was concerned that property values would plummet if the City was not careful with the housing element wording. He also suggested initiative action be taken by the voters to wrest control from the State back to Local Government. Earl G. Kunz, 28954 Crestridge Road, Rancho Palos Verdes, asked Council what other communities were doing about affordable housing and responding to the legislation. Mrs. Negendank identified other Southern California cities that were preparing housing elements under the provisions of AB2853. The Council had no specific comments to make, stating that the other cities were just now forming their recommendations and grappling with this situation like Rancho Palos Verdes. Margaret Flynn, 6733 Vallon Drive, Rancho Palos Verdes wanted to know what could happen if the City failed to comply. Mr. Coughlan stated there were various actions the State could take. He felt the risk was greater not to comply than to comply. On motion of Councilwoman Shaw, seconded by Councilman Ryan, the Public Hearing was then closed. The motion carried unanimously. RECESS A recess was called at 9:30 P.M. RECONVENE At 9:50 P.M. the meeting was called to order with the same members present. Mayor Bacharach moved, seconded by Councilman Dyda, that the wording in Program "P" be changed to read: "That the City study methods of reducing costs to developers of affordable housing such as financing alternatives, fee reduction and reduced processing time." In response to a question by Councilwoman Shaw, Mrs. Negendank gave examples of financing alternatives that have been used by other cities and that may be used here. Councilman Dyda explained how the City could help unsophisticated developers by compiling a list of financing alternatives. The above motion was unanimously passed. Councilman Ryan then moved, seconded by Councilwoman Hein, that Program "T" end with the words ". . . .housing development." Council discussion ensued. Councilman Dyda then moved, seconded by Mayor Bacharach, that Councilman Ryan's motion be amended to read ". . . . housing development such as Crestridge and Marineland areas as identified in our General Plan and Coastal Specific Plan." City Council -2- 9/23/81 The motion to amend Councilman Ryan's motion was passed on a vote of 3-2, with Councilman Ryan and Councilwoman Hein voting in opposition. Councilman Ryan's original motion, as amended, was then voted upon and passed on a 3-2 vote, with Councilman Ryan and Councilwoman Hein voting in opposition. It was then moved by Councilman Dyda, seconded by Councilwoman Shaw and unanimously passed that the following paragraph be added on page N-8, following the fourth paragraph: "Changes to SCAG policies or RHAM values that may occur in the future are to be considered for inclusion in this and other City documents where applicable or appropriate." The bar charts submitted by Councilman Dyda and included in the agenda package were discussed. It was moved by Councilman Dyda, seconded by Councilwoman Hein, and unanimously passed to include the bar charts, as amended with proper title changes, as part of the amendment. It was moved by Councilman Ryan, seconded by Councilman Dyda, and unanimously passed that the text amended to indicate "greater than" and/or "less than", as appropriate, be included as part of the amendment. It was moved by Councilwoman Shaw, seconded by Councilman Dyda and unanimously passed to approve the proposed staff revisions to the amendment. City Attorney Pat Coughlan read RESOLUTION NO. 81-71 and with the waiving of further reading of the Resolution, Councilwoman Shaw moved, seconded by Councilman Ryan to ADOPT RESOLUTION NO. 81-71 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, ADOPTING GENERAL PLAN AMENDMENT NO. 9 OF THE CITY OF RANCHO PALOS VERDES as corrected and amended this evening. It was moved by Councilman Dyda, seconded by Councilwoman Shaw and unanimously passed that section 4, line 5 of the Resolution be changed to read ". . . . in compliance with State law." The above motion, ADOPTING RESOLUTION NO. 81-71, -.as amended above, was unanimously passed. Mr. Coughlan was excused at 10:30 P.M. 1/ # # # # If # 11 II WORK SESSION ENVIRONMENTAL SERVICES Director Hightower explained briefly why DEPARTMENT STAFFING (1202 x 120 3) Environmental Services needed to retain the present staffing positions as proposed in the 1981-82 Budget. It was then moved by Councilwoman Hein, seconded by Councilman Dyda and carried that the City retain the present staffing positions of the Environmental Services Department as proposed in the 1981-82 Budget.
