CC MINS 19820706 M I ,N U T E S REGULAR MEETING RANCHO PALOS VERDES CITY COUNCIL JULY 6, 1982 The meeting was called to order at 7:30 P.M. by Mayor Jacki Bacharach at the II Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: RYAN, HEIN, SHAW, DYDA, & MAYOR BACHARACH ABSENT: NONE Also present were City Manager .Donald Guluzzy, City Attorney Steve Dorsey, Director of Public Works Carl Abel, Associate Civil Engineer Tony Antich, County Engineer Mike Nageo, Director of Community Services Tom Bandy, Director of Planning Sharon W. Hightower, Director of Administrative Services Kiti Laisure, and City Clerk Mary Jo Lofthus. CEREMONIAL MATTER Mayor Bacharach presented a commemorative proclamation to outgoing Traffic Committee Member Dave Diestel for his leadership, commitment and civic dedication as a member of that committee from December 17, 1975 to June 1, 1982. Additionally, she presented a gavel to Planning Commissioner Mel Hughes and Parks & Recreation Committee Member Larry Zamos in recognition for their tenures as Commission and- Committee chairmen. APPROVAL OF AGENDA Item D-1 (Tract No. 33206) was continued to July 20, 1982. Councilman Ryan added Palos Verdes Dr. So. at La Rotonda Drive, Council- woman Hein -added NEWSLETTER article, Mayor Bacharach added "scheduling a meeting with Assemblyman Felando, and D-I (County Ordinance) was removed. Mayor Bacharch declared a recess. The meeting reconvened at 9:15 with the same members present. RESOL. NO. 82-44 - APPOINTING It was the consensus of Council THE DIRECTOR OF PUBLIC WORKS to amend the proposed resolution AS SPECIAL SUPERINTENDENT OF to include the words "telephone STREETS - UNDERGROUNDING DISTRICT and future cable TV. . . ." NO. 4. (901) RESOLUTION NO. 82-44 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPOINTING THE DIRECTOR OF PUBLIC WORKS AS SPECIAL SUPERINTENDENT OF STREETS FOR IMPROVEMENT DISTRICT NO. 4 - ALSO KNOWN AS DALADIER DRIVE, ET AL UNDERGROUNDING DISTRICT was read by title and ADOPTED as amended on motion of Councilman Dyda, seconded by Councilwoman Shaw and carried. Council then discussed if there was some way these improvement district petitions could be expedited so there wouldn't be so much time elapsed between its circulation and the public hearing on its. feasibility. TENTATIVE TRACT MAP NO. 38848 Mayor Bacharach opened the RESOL. NO. 82-45 (1411) public hearing on this sub- division which had been previously reviewed by Council in May 1981. At that time the Council approved the tentative map. The developer allowed the one-year approval to expire by not requesting an extension. The City Clerk reported that no written protests had been received. Associate Planner Sandi Lavitt presented the staff memo of July 6, 1982 which reported that no changes had been made in this project and a walkover of the site indicated substantial compliance with the grading plan approved for the tract. The Planning Commission reviewed the map and approved the Conditional Use Permit No. 82 and recommended approval of the tentative tract map. Referring the changes listed on page two of the staff report, Ms. Lavitt also listed changes to Condition Nos. 1, 19, 27e, 35 of Exhibit "A" to the proposed resolution and corrections to Condition Nos. 4 and 7 of C.U.P. No. 82. Clark Leonard, Lanco Engineering, said he agreed with the staff report, however objected to the changes to Condition No. 13 and requested that he be granted permission to install the water main and sewer lines. Additionally, he objected to the change made in Condition No. 26 and requested that the deposit be returned to the applicant. After Council discussion of whether a bond should be submitted prior to installation of the sewers and water,and grading prior to the approval of the final map, Mr. Leonard withdrew his request for installation of these items. Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to change Condition No. 26 and extend the deposit period to 10 years. Mr. John Garza, 29609 Whitley Collins, requested that Council consider installing a traffic signal on his street where it intersects with Crest Rd. He cited the increase in traffic because of this project and said that a light would be needed. There being no response to the Mayor's call for additional public testimony, she then declared the hearing closed. Mayor Bacharach moved, seconded by Councilwoman Shaw and carried to amend Condition No. 27(e) as follows: "The only private road will provide. . . ." COUNCIL -3- JULY 6, 1982 In response to Council's inquiry, staff commented that the warrants at this intersection did not justify installation of a traffic signal. Councilwoman Shaw moved, seconded by Councilman Dyda and carried to ADOPT RESOLUTION NO. 82-45 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING TENTATIVE TRACT NO. 38848 as amended. Mr. Leonard said he would submit his request for installation of the water main and sewers at a later date. CODE AMENDMENT NO. 14 - MISCELLANEOUS Mayor Bacharach opened this REVISIONS TO THE DEVELOPMENT CODE - public hearing on making MINOR NONCONFORMING STRUCTURES miscellaneous revisions to the (1103 x 1801) Development Code. The Clerk reported that publication had been duly made and that no written protests had been received by the City. Director Hightower presented the staff report of July 6, 1982 which indicated the Planning Commission's adoption of their Resolution No. 82-12 thereby recommending approval-of this Code Amendment No. 14. There being no response to the Mayor's call for public testimony, she then declared the hearing closed. ORDINANCE NO. 158 OF THE CITY OF RANCHO PALOS VERDES MAKING MISCELLANEOUS REVISIONS TO THE TEXT OF THE DEVELOPMENT CODE AS CODE AMENDMENT NO. 14 AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented for a first reading. Councilman Dyda moved, seconded by Councilwoman Shaw, and carried to INTRODUCE ORDINANCE NO. 158. ORDINANCE NO. 156 - RELATING TO POWERS ORDINANCE NO. 156 OF THE CITY & DUTIES OF THE CITY MANAGER (1101 x OF RANCHO PALOS VERDES RELATING 1103 x 1202) TO THE POWERS AND DUTIES OF THE CITY MANAGER AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented for a second reading and adoption, first reading having taken place at the June 15, 1982 meeting. Councilwoman Hein moved, seconded by Councilwoman Shaw to ADOPT ORDINANCE NO. 156. LOCATION: 2408 RUE LE CHARLENE - presented the staff report of REQUEST TO INSTALL DECK (1804) June 15, 1982 on this request to allow a deck 20 ft. 7-1/2" in height and encroaching into the east side and rear yard setbacks on a slope of approximately sixty-six percent. The applicant in this matter, Mrs. Helen Akemon, told the Council that she felt it was unfair for the City to have her remove this deck, that it could be seen by only four homes, and that it was built of redwood. MIRALESTE DRAIN (604) Councilwoman Shaw moved, seconded by Councilman Dyda and carried to approve the staff recommendation that the work on Miraleste Drive be done in accordance with drawings and specifications and the system be constructed and maintained by the County Flood Control District in accordance with City ordinances and regulations. No action was • taken. # # # # ITEMS REMOVED FROM THE STATUS REPORT STREET SWEEPING CONTRACT FOR FY82-83 (1405) Mel Hughes, 28017 San Nicolas Drive, requested that Council reconsider its current schedule of sweeping just arterials and cited the problem of mud and debris collecting on residential streets. Councilwoman Shaw moved, seconded by Councilman Ryan and carried that the current contract be extended until July 20 and that staff make recommendations on monthly sweeping of arterials plus quarterly sweeping of residential streets.
