CC MINS 19820615 MINUTES RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING JUNE 15, 1982 The meeting was called to order at 7: 35 P.M. by Mayor Jacki Bacharach at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. Following the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: HEIN, RYAN, SHAW, DYDA, & MAYOR BACHARACH ABSENT: NONE Also present were City Manager Donald Guluzzy, City Attorney Steve Dorsey, Director of Planning Sharon W. Hightower, Director of Public Works Carl Abel, Associate Civil Engineer Gordon Siebert, Director of Parks & Recreation Maynard Law, Director of Community Services Tom Bandy, Administrative Assistant Julie Christensen, Administrative Services Director Kiti Laisure, and City Clerk Mary Jo Lofthus. CEREMONIAL MATTER Mayor Bacharach presented a proclamation to Dr. Donald Baer for his commitment and civic dedication as a member of the Planning Commission from July 8, 1980 to June 1, 1982 . Also, a proclamation was presented to Ray Mathys for his leadership, commitment and civic dedication as a member of the Traffic Com- mitee from November 18 , 1975 to June 1, 1982 . APPROVAL OF AGENDA It was the consensus of Council to discuss A-7 (Gifts for Parks Catalogue) after C-2 (Recommendations regarding Public/ Private Recreation Development) . After addition of Van Bids (City Manager) and the June 21 meeting (Councilwoman Shaw) the amended • agenda was unanimously approved on motion of Councilman Dyda, seconded by Councilman Ryan. WAIVER OF FULL READING OF ORDINANCES & RFSOLTTTI OMS Councilman Dyda moved, seconded by Councilwoman Hein and carried to waive reading in full of all ordinances and resolutions at this meeting with consent to the waiver of reading of the title unless specific request was made at that time for reading of such ordinance or resolution. CONSENT CALENDAR After removal of Item Nos. A-2 (Register of Demands) , A,-6 (Tract No. 31617) , and A-7 (Parks Catalogue) , the remainder of the Consent Calendar was approved as follows on motion of Councilwoman Shaw, seconded by Councilman Dyda. MINUTES Approved as presented the minutes of May 18 , and May 24 , 1982 . CLASS ACTION SUIT - PETROLEUM Authorized sending a PRODUCTS ANTI-TRUST (303) letter to the Attorney General prior to June 30 , 1982 requesting exclusion to insure the City against any possible adverse decision by the Court . • • TRACT NO. 32614. - APPROVAL OF (1) Approved the work. (2) STREET IMPROVEMENTS (1411) Exonerated Faithful Performance Bond No. SC70.8-70-70 . (3) Direc- ted the City Clerk to notify the principals. TRACT NO. 32614 - RELEASE OF Approved release of Bond Nos . LANDSCAPE & IRRIGATION BONDS SC708 70 69 and SC708 70 69A. (1411) ACCEPTANCE OF WORK FOR (1) Waived the liquidated LANDSCAPING AT VARIOUS damages . (2) Accepted the LOCATIONS (1405) work as completed. (3) Exon- erated Faithful Performance Bond No. 73SB023209BCA in the amount of $219,000. (4) Directed the City Clerk to issue a Notice of Completion. (5) Withheld $5,690 from the f inal' payment until plantings take root. (6) Authorized the Director of Finance to issue a warrant to the contractor in the amount of $15,834 on June 17, 1982 . (7) Directed staff to inspect the aforementioned plantings and, if satisfactory, on July 15, 1982 the Director of Finance shall be authorized to issue to the contractor a warrant in the amount of $5,690 as the final pay- ment. PURCHASE OF POLICE RADAR Authorized purchase of radar. UNIT (1206) unit in conjunction with the other regional police cities for a not to exceed amount of $4,712. LADERA LINDA COMMUNITY Approved an addendum to the CENTER - ADDENDUM TO PALOS existing agreement allowing VERDES CABLE COMMUNICATIONS the Palos Verdes Cable Com- CO. AGREEMENT (605 x 1201) munications Company, Inc. to lease one additional class- room at Ladera Linda Community Center at a rental rate of $450 per month from June 15, 1982 through December 15 , 1983 and authorized . the Mayor and City Clerk to sign same. Mayor Bacharach moved, seconded by Councilwoman Shaw to referthe matter of donor recognition back to the Parks and Recreation Committee . The motion carried on a four - one vote with Councilman Ryan voting in opposition. ORDINANCE NO. 155U - Director Hightower presented ABANDONMENT IN THE MORATORIUM the staff memorandum on this AREA (1801) ordinance which clarifies the terms of replacement and abandonment of property in the moratorium area. Staff recommended that that Council adopt this proposed ordinance on an urgency basis and authorize staff to send letters to property owners and home- owners associations in the area. Council discussion then centered around whether it was necessary to adopt this ordinance on an utgency basis . Councilwoman Shaw moved, seconded by Mayor Bacharach to modify the title of the ordinance and strike Section 4 declaring this an urgency ordinance . The motion failed on a two - three vote with Councilmembers Dyda, Ryan and Hein voting in opposition. Councilman Dyda moved, seconded by Councilwoman Hein to ADOPT ORDINANCE NO. 155U OF THE CITY OF RANCHO PALOS VERDES AMENDING ORDINANCE NO. 108U, AS AMENDED BY ORDINANCE NOS. 118U, 120U, 123U, 130U, 131U, 139U, 140U, 143U, 148U, AND DECLARING THE URGENCY THEREOF. The motion carried on the following roll call vote: AYES: HEIN, RYAN, SHAW, & DYDA NOES: MAYOR BACHARACH ABSENT: NONE Councilwoman Hein moved, seconded by Councilman Ryan to authorize the staff to send letters to property owners and homeowners associations in the area. The motion carried on the following roll call vote: AYES: HEIN, RYAN, SHAW, DYDA, & MAYOR BACHARACH NOES: NONE ABSENT: NONE STREET NAME SIGN REPLACEMENT Director Abel presented the POLICY (1404) staff report of June 16, 1982 and reviewed the recommendations made by staff in their May 24, 1982 .memorandum: (1) Continue the use of porcelainized signs due to longevity. (2) Fabricate signs in two colors only. If green in the logo is desired, apply a die-cut decal. (3) Accept orders for custom signs at cost plus 20%. (4) Replace legible signs only if 90% Federally funded. (5) Continue to replace illegible, damaged or rusted signs only. (6) Sell salvaged surplus signs, if any, for $20.00 each. COUNCIL . -4- . JUNE 15 , 1982 Councilman Dyda moved, seconded by Councilwoman Hein to accept staff recommendations with the exception that No. 2 should be changed to three colors. The motion carried. Mayor Bacharach moved, seconded by Councilwoman Shaw to change recommendation No. 3 to provide for acceptance of orders for custom street signs for private streets at cost plus 20%. - The motion carried on a three - two vote with Councilmembers Dyda and Ryan voting in opposition. Councilwoman Shaw moved, seconded by Councilman Ryan to add a recommendation No. 7 to provide for the sale of current street signs to anyone for full replacement cost plus 20%. The motion carried. Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to run an article in the City' s NEWSLETTER publicizing the fact that individuals or neighborhood groups may buy street signs at replacement cost plus 20%; the City will then put up a new sign- Mayor Bacharach moved, seconded by Councilwoman Shaw and carried to run an article in the City's NEWSLETTER publicizing the fact that theft of City signs is an added expense to the City. ' M The main motion to adopt staff recommendations as amended carried. PALOS VERDES DR. SOUTH - ABALONE Director Abel presented the COVE RECONSTRUCTION (1403 x 1404) staff memorandum of June 15, 1982 which reviewed Council 's authorization to fund the design of Palos Verdes Drive South in Abalone Cove from Crenshaw Boulevard to Forrestal Drive. Staff recommended that the City Council change the Street Standards Study Guidelines to reflect design for one lane in each direction on Palos Verdes Dr. South from Wayfarer's Chapel to Narcissa Drive. Council then discussed their concerns about the adequacy of one lane and whether it could accommodate access. to Abalone Cove Beach Park and tie.Wayfarpr's Chapel._. Former Traffic Committee member Ray Mathys explained how the speed limit was reduced in that area and how this proposed design would be adequate. Also, he pointed out that this design would allow for later modification of the road if it was so desired. Councilman Dyda moved, seconded by Mayor Bacharach to authorize the staff to design, within the guidelines of the Street Standards Study, the initial construction of a two-lane highway in the area between the Wayfarer' s Chapel and Narcissa Drive and bring back the answers to the questions of turning pockets and access to Abalone Cove Beach and the differential costs of a two lane versus four lane highway. The motion carried. REQUEST FOR TEMPORARY - Director Hightower presented WAIVER OF UNDERGROUND UTILITY the staff memorandum on this ENT (1801) request for a temporary waiver REQUIREM of the underground utility requirement for #1 Roseapple. AUDIENCE QUESTIONS Responding to the Mayor 's call PALOS VERDES AMATEUR RADIO for questions from the audience CLUB (310 x 1206) on items not appearing on the agenda was Melvin W. Hughes , 28017 San Nicolas Drive , who told the Council that the Amateur Radio Club provided the communication facilities for the Palos Verdes Marathon Run and successfully demons't rate d their ability to provide communications between the Sheriff ' s department , fire department and the Palos Verdes Estates Police Department . Councilwoman Hein moved, seconded by Councilman Dyda and carried to send a letter to the Palos Verdes Amateur Radio Club thanking them for providing the communications for this event . REOPEN AGENDA It was the consensus of the Council to discuss Item A-6 •• (Tract No. 31617) as the next item of business . TRACT NO. 31617 - RELEASE OF After clarification of the bond SURETY BOND (1411) to be released, Councilman Dyda moved, seconded by Councilwoman Hein and carried to release Bond No. 6322726 in the amount of $46,400 for the Signalization at this tract. COMMITTEE & COMMISSION CHAIRMEN Planning Commission - Councilman (106) Ryan moved, seconded by Council- woman Hein and carried to appoint . Douglas Hinchliffe as Chairman of the Planning Commission for the next year. Traffic Committee - Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to appoint Arline Grotz as the Chairwoman of the Traffic Committee for the next year. Parks & Recreation Committee - Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to appoint Fred Jackson as Chairman of the Parks & Recreation Committee for the next year. ORDINANCE NO. 156 - City Manager Guluzzy presented RELATING TO THE POWERS AND the staff memorandum of June DUTIES OF THE CITY MANAGER 10 , 1982 which summarized the (1101 x 1103) necessity of adopting this ordinance empowering the City Manager to appoint the City Clerk and the Treasurer. Presently the Code cites the City Council as the appointing authority for these two positions. ORDINANCE NO. 156 OF THE CITY OF RANCHO PALOS VERDES RELATING TO THE POWERS AND DUTIES OF THE CITY MANAGER AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented by title and INTRODUCED on motion of Councilman Ryan, seconded by Councilwoman Shaw and carried on a three - two vote with Councilmembers Dyda and Hein voting in opposition. COUNCIL -6- JUNE 15 , 1982 HOUSING PROGRAMS (701) Associate Planner Ann Negendank '' presented the June 15 staff memorandum which listed the description and process for the City's proposed housing programs . Staff recommended that Council determine program priority and authorize staff to prepare a work program for the next City Council meeting. Additionally, that staff bring back a progress report in May 1983 adding those programs not y et initiated. Goal 1 , G - Councilman Ryan moved, seconded by Councilman Dyda to delete the use of the City house concept from this goal . The motion carried. After Council discussion of the role new legislation would play in determining what these housing programs would be, the use of HCD funds, and if these goals . could be established prior to setting the priorities of the Planning Department, Councilman Dyda moved, seconded by Councilwoman Shaw and carried to continue this matter until such priorities had been set. ORDINANCE NO. 157 - AMENDING THE Associate Planner Lavitt SUBDIVISION ORDINANCE (1409) presented the staff memorandum of June 15 which recommended adoption of this proposed- ordinance to incorporate the changes made g in the City' s code. It was the consensus of Council that staff should indicate on future ordinances the -changes -being made. ORDINANCE NO. 157 OF THE CITY OF RANCHO PALOS VERDES AMENDING THE SUBDIVISION ORDINANCE AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title and INTRODUCED on motion of Councilman Dyda, seconded by Councilwoman Hein and carried. LEGISLATION (306) SB1785 and SB1786 - Parkland )Dedication Law and Subdivision Control - Councilwoman Hein moved, seconded by Councilwoman 'Shaw and carried to oppose these two bills . SB53 - Special Bill for one developer - Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to oppose this bill. RESOL. NO. 82-41 - REGISTER Councilman Dyda moved, seconded OF DEMANDS by Councilwoman Hein that Warrant No. 1592 be charged to the City Manager's budget. The motion carried. RESOL. NO. 82-41 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $296,140. 87, DEMAND NUMBERS 1535 THROUGH 1594, 11156 AND 11157 was presented by title. Council- man Ryan moved, seconded by Councilwoman Hein to ADOPT RESOL. NO. 82-41. The motion carried on the following roll call vote: AYES: RYAN, SHAW, DYDA, & MAYOR BACHARACH NOES: HEIN NONE II/ LEGISLATION (306) AB3800 - 1% Sales Tax - Council- woman Shaw moved, seconded by Mayor Bacharach to oppose this bill to eliminate the voter approved 1% sales tax for public transportation. REVERSE BAILOUT BUDGET Council discussed the budget PROPOSAL (310) cuts proposed in the State budget and the proposal to reduce the amount of subventions for cities specifically those derived from motor vehicle in-lieu and cigarette taxes . Councilman Ryan moved, seconded by Councilman Dyda and carried COUNCIL -7- JUNE 15 , 1982 to write a letter to the League of California Cities , independent Cities, Peninsula Cities , Board of Supervisors , School District , and Library District telling them that we would support an initiative to protect local revenue sources. It was the consensus of Council that a letter should also go to Governor Brown telling him not to take funds away from local governments. BID FOR PARKS & RECREATION Explaining that the Parks VAN (602 x 1201) & Recreation Department needed the van early in July for a City function, the City Manager requested that the bids be opened prior to the next Council meeting. Mayor Bacharach moved, seconded by Councilman Dyda and carried to open these bids prior to the next meeting and bring a proposal to the June 21 meeting. JUNE 21 WORK SESSION (602) Council discussed the tentative agenda for this work session: presentation by the Traffic Committee on the DUI grant, RJA evaluation, and the proposed budget. . Councilman Dyda moved, seconded by Council- woman Hein and carried that the City Manager should include in the June 21 agenda package a list of items which can be deferred without making a significant impact to the City's operation and hold further evaluation until such time as the Council can study the budget . It was the consensus of Council to add discussion of a volunteer program to this agenda. ADJOURN At 11: 00 P.M.
