CC MINS 19820118 ADJ MINUTES RANCHO PALOS VERDES CITY COUNCIL ADJOURNED REGULAR MEETING JANUARY 18, 1982 The meeting was called to order at 7:30 P.M. by Mayor Jacki Bacharach at the Palos Verdes Peninsula School District Building, 30942 Hawthorne Boulevard, notice having been given with affidavit thereto on file. After the Pledge of Allegiance to the flag which was led by members of Brownie Troop 667, roll call was answered as follows: II/ AYES: HEIN, RYAN, SHAW, DYDA & MAYOR BACHARACH ABSENT: NONE Also present were City Manager Donald Guluzzy, City Attorney Patrick Coughlan, Director of Public Works Carl Abel, Associate Planner Sandi Lavitt, Director of Parks & Recreation Maynard Law, Director of Administrative Services Kiti Laisure and Deputy City Clerk Mary Jo Lofthus. APPROVAL OF AGENDA After addition of Bikepaths (Mayor Bacharach) the amended agenda was approved on motion of Councilman Dyda, seconded by Councilwoman Hein and carried. WAIVER OF FULL READING OF Councilwoman Shaw moved, seconded by ORDINANCES & RESOLUTIONS Councilman Dyda and carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all members of Council after the reading of the title unless specific request was made at that time for reading of such ordinance or resolution. RESOLUTION NO. 82-3 - ADOPTED RESOLUTION NO. 82-3 OF THE CITY REGISTER OF DEMANDS COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $160,672.63, DEMAND NUMBERS 10810 THROUGH 10885. RESOLUTION NO. 82-4 - ADOPTED RESOLUTION NO. 82-4 OF THE CITY SUPPLEMENTAL REGISTER COUNCIL OF THE CITY OF RANCHO PALOS VERDES OF DEMANDS ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $16,123.33, DEMAND NUMBERS 10886 THROUGH 10892. RESOLUTION NO. 82-5 - ADOPTED RESOLUTION NO. 82-5 OF THE CITY ESTABLISHING SPEED LIMITS COUNCIL OF THE CITY OF RANCHO PALOS VERDES ON VARIOUS STREETS (1502) ESTABLISHING SPEED LIMITS ON VARIOUS STREETS WITHIN THE CITY. TRACT NO. 36301 - Approved the work, released the sanitary ACCEPTANCE OF SANITARY sewer agreement between the City and the SEWERS subdivider, released the $12,400 faithful (1411) performance portion of the $210,363 Certificate of Deposit for guarantee of construction of various subdivision improvements and instructed the City Clerk to release the $12,400 of the Certificate of Deposit to WSM Development Company, Inc. City Council -1- 1/18/82 ACCEPTANCE OF IMPROVEMENTS - OFFICE BUILDING LOCATED AT 5620 RAVENSPUR DRIVE (1503) TRACT NO. 37205 - ACCEPTANCE OF BONDS & APPROVAL OF MAP (1411) Accepted the work done at 5620 Raven - spur Drive and retained the bond for median construction until it is built or released by the City Council. Council approved the Map; accepted the streets, easements and abandon- ment of vehicular access rights; approved and accepted the Faithful Performance Bond in the amount of $335,203, and the Labor and Materials Bond in the amount of $167,602; made the appro- priate findings as outlined in the Special City Engineer's letter of January 13, 1982 and instructed the City Clerk to endorse on the face of the map of Tract No. 37205 the certificate which embodies the approval of said tract map and the acceptance of the dedications shown thereon. PARCEL MAP NO. 14369 - Council found that all work had been RELEASE OF WATER SYSTEM completed, released the subdivision (1410) water system agreement between the City and the subdivider, released Surety Bond No. 103681 in the amount of $56,000 and instructed the City Clerk to noti.fy the City Engineer, Developers Insurance Company as the Surety and S. P. Devco as the principal of Council's action. BALANCE REPORTING CUSTOMER SERVICE AGREEMENT WITH BANK OF AMERICA (BAMTRAC) (1405) Authorized the Mayor and City Clerk to sign the agreement as amended. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: HEIN, RYAN, SHAW, DYDA & MAYOR BACHARACH NOES: NONE ABSENT: NONE PUBLIC HEARING - BERRY HILL UNDERGROUNDING DISTRICT NO. 3 - FINAL HEARING (901) The Mayor opened this public hearing for the assessment of the under - grounding district. Staff recommend- ed that the hearing be continued to 7:30 P.M. February 2, 1982. Councilwoman Hein so moved, seconded by Councilman Dyda and carried. ORDINANCE NO. 145 - ORDINANCE NO. 145 was presented for RATIFYING ORDINANCE NO. 144 a second reading and adoption, first (501) reading having taken place on January 5, 1982. ORDINANCE NO. 145 OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING A GENERAL MUNICIPAL ELECTION DATE AND RATIFYING AND CONFIRMING ORDINANCE NO. 144 was read by title and ADOPTED on motion of Councilwoman Shaw, seconded by Councilman Ryan and carried on the following roll call vote: AYES: RYAN, SHAW, DYDA & MAYOR BACHARACH NOES: HEIN ABSENT: NONE SCAG REGIONAL HOUSING Associate Planner Lavitt presented ALLOCATION MODEL (RHAM) the staff memorandum of January 19, (701) 1982 which outlined the replacement, construction, and current housing needs of the City. Staff recommended that Council request staff initiate revision discussions with SCAG. Councilwoman Shaw so moved, seconded by Councilwoman Hein and carried. City Council -2- 1/18/82 REAL ESTATE LEAD-IN SIGNS - Associate Planner Lavitt presented EXPERIMENTAL PROGRAM the staff memorandum of January 19, (1801) 1982 which outlined this program to allow for placement of real estate directional signs within the public right-of-way. Staff recommended that Council allow for placement of these signs subject to certain criteria for a trial period of four months: (1) All signs are to be no larger than 1 foot x 3 feet. (2) Signs are to be red and white in color. (3) Signs may be placed between the hours of 1:00 P.M. and 5:00 P.M. on Saturday and Sunday only. (4) All signs shall be placed within the public right-of-way only. (5) One sign may be placed per direction with a maximum number of signs not to exceed three signs per intersection. Council discussion included comments on how staff will provide for the removal of these signs, how much time will be spent monitoring this program, if the program should be extended longer than four months, and if other Peninsula cities had a similar program. Speaking in favor of this program were the following members of the Rolling Hills Board of Realtors: Mardi Hallett, Bob Randall, and Jacqueline Crowley. Each of them expressed appreciation for this trial program and explained the difficulties in advertising open houses not located on main streets. They requested however that for the immediate future they be allowed to use the present signs and not the red and white signs indicated in the staff report. Councilman Dyda moved, seconded by Councilman Ryan and carried to adopt number 1 through 5 of the recommended policy statement; modify No. 2 by allowing use of the present signs, however the name of the realty company must be blocked out; additionally, this program should start February 1st and end October 1st. Councilman Dyda moved, seconded by Councilman Ryan and carried to waive further reading and INTRODUCE ORDINANCE NO. 146. Council requested the City Attorney verify the County roofing code that would be adopted under this ordinance. City Council -3- 1/18/82 ORDINANCE NO. 147 - ORDINANCE NO. 147 OF THE CITY OF MOTION PICTURE AND FILM RANCHO PALOS VERDES PROVIDING FOR PERMITS (2 0 2 x 110 3) STILL PHOTOGRAPHY, MOTION PICTURES AND TELEVISION PRODUCTIONS IN THE CITY OF RANCHO PALOS VERDES was pre- sented by title. The City Attorney corrected the proposed ordinance to reflect proper codification in accordance with the City's Municipal Code and requested that this ordinance by pre- sented for second reading and adoption after adoption of Ordinance No. 146. Mayor Bacharach moved, seconded by Councilwoman Shaw and carried to modify the fifth line of Section 4 (Permit Application) by adding after the word "required" the follow- ing; "If such activity interfers with traffic, application should be made two weeks in advance." Councilman Dyda moved, seconded by Councilman Ryan and carried to waive further reading and INTRODUCE ORDINANCE NO. 147. (At 8:30 P.M. the City Attorney was excused from the meeting.) LEGISLATION AB321 - Omnibus Coastal Legislation. (306) Councilwoman Hein moved, seconded by Councilwoman Shaw to support this legislation. It was the concensus of Council that if the bill is different than the summary as Council now understands it, then the Mayor should determine whether or not to support this legislation. The motion carried on a four - one vote with Mayor Bacharach abstaining. AB1543 - Hazardous Waste Siting Study Committee - Councilwoman Shaw moved, seconded by Councilman Dyda and carried to support this bill. SB999 - Fireworks: Councilman Dyda moved, seconded by Councilwoman Hein and carried to oppose this bill. AB6X - Accelerated Employer Withholding Payments: Councilman Dyda moved, seconded by Councilwoman Shaw and carried to oppose this bill. AB1197 - Weight Limits - Vehicles: Councilwoman Shaw moved, seconded by Councilman Dyda and carried to oppose this bill. AB1760 - Unemployment Insurance for Students: Council- man Dyda moved, seconded by Councilwoman Hein and carried to support this bill. AB1049 - Land use bill: Referred to staff for comments. BIKEPATHS Council discussed the January 13th (112) letter on bikepaths contained in the City Manager's Weekly Status Report. Council discussion included comments on what needs to be done to complete the bikepath system, how much of a financial commitment is still needed, the timeline for completion of the system, and if this memorandum had been presented to the Traffic Committee. Councilwoman Hein moved, seconded by Councilwoman Shaw and carried that this memo be presented to the Traffic Committee for their recommendations and a suggested timeline for Council's consideration. Council discussion then followed regarding the location of bikepaths, length, and estimated cost of construction. Councilman Dyda moved, seconded by Mayor Bacharach to delete the Bikepath at 25th Street, east of La Rotunda Drive. The motion failed on a three - two vote with Councilmembers Ryan, Hein and Shaw voting in opposition. REOPEN AGENDA Councilman Ryan moved, seconded by Councilwoman Hein and carried to reopen the agenda. Councilman Ryan moved, seconded by Councilwoman Hein and carried to discuss some of the items contained in the City Manager's Weekly Status Report dated January 15, 1982. Election Consolidation - Notice to Registered Voters - It was the consensus of Council to amend the wording in the 6th line of the proposed notice as follows: ". . . this change, City Council terms in office have been extended. Under the provisions of this legislation shortening of terms was prohibited." Planning Director's Monthly Report - Staff to indicate the volume of routine staff work on items such as tract maps. Follow-Up Meeting with Captain Emerson - The City Clerk was requested to schedule consideration of meeting with Captain Emerson on the February 16th agenda. City Council -4- 1/18/82 Town Hall Meeting (307) - Councilman Ryan moved, seconded by Councilwoman Hein to send a postcard invitation to all households in the city inviting them to the Town Hall meetings at a cost not to exceed $1,000; babysitting services will be provided at this meeting. The motion carried on the following roll call vote: AYES: HEIN, RYAN, SHAW, DYDA & MAYOR BACHARACH NOES: NONE Council requested that these cards be sent out approximately two weeks prior to the meeting. Councilwoman Hein moved, seconded by Councilman Ryan to provide coffee at these Town Hall Meetings. The motion carried on a three - two vote with Councilmembers Dyda and Shaw voting in opposition. Council requested that pertinent documents such as the Coastal Plan and Park Plan be displayed at these Town Hall Meetings. Also, the point should be stressed that no Council action will be taken at these meetings. Councilman Dyda moved, seconded by Councilwoman Hein and carried to provide for coffee for staff at a cost not to exceed $300 until June. The motion carried on the following roll call vote: AYES: HEIN, SHAW, DYDA, & MAYOR BACHARACH NOES: RYAN Meeting with Committee & Commission Members - Councilman Dyda moved, seconded by Councilman Ryan to provide refreshments at this March 30th meeting. The motion carried on a three - two vote with Councilmembers Hein and Mayor Bacharach voting in opposition. Parkway Trees - Noting receipt of a letter from a resident regarding the homeowner's responsibility for sidewalks and parkway trees, it was s the consensus of Council that items like this should be covered in the City's NEWSLETTER.
