CC MINS 19810303M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING MARCH 3, 1981 This meeting was called to order at 7:35 P.M. by Mayor Barbara Hein at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. After the Pledge of Allegiance to the Flag, which was led by a member of Girl Scout Troop 1449, roll call was answered as follows: PRESENT: SHAW, DYDA, BACHARACH & MAYOR HEIN ABSENT: RYAN Also present were City Manager Donald Guluzzy, City Attorney Patrick Coughlan, Director of Public Works Charles Abbott, Director of Planning Sharon Hightower, Director of Parks & Recreation Maynard Law, Director of Community Services Tom Bandy, Administrative Services Officer George Wunderlin, and Deputy City Clerk Mary Jo Lof thus . CEREMONIAL MATTER Mayor Hein presented to Gordona Swanson a proclamation in recogni- tion of her being named the 1980 Citizen of the Year by the Palos Verdes Peninsula Chamber of Commerce and Rotary Club of Palos Verdes for her leadership in the com- munity for the past eleven years. APPROVAL OF AGENDA After Councilwoman Bacharach added discussion of the 91/1 -110 Gap Closure the amended agenda was approved on motion of Councilwoman Bacharach seconded by Councilman Dyda and carried 4 - 0. WAIVER OF FULL READING OF ORDINANCES Councilwoman Shaw moved, seconded by & RESOLUTIONS Councilman Dyda to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all members of Council after reading of the title unless specific request was made at that time for reading of such ordinance or resolution. The motion carried 4 - 0. CONSENT CALENDAR Because she was absent from the February 17th Council meeting, Councilwoman Bacharach abstained from voting on the Minutes of February 17, the remainder of the Consent Calendar was approved as follows on motion of Councilwoman Shaw, seconded by Councilman Dyda. Rolling Hills Estates will be the lead agency again for this program. After Council discussion, Councilwoman Shaw moved, seconded by Councilwoman Bacharach to send a letter to the City of Rolling Hills Estates reaffirming the City's sup- port for the Dial -A -Ride Program under similar conditions approved by the Council last year. The motion carried 4 - 0. Council requested a report on the evaluation and effects of this program at the end of June. ANIMAL CONTROL - "SCOOP" LAW (104) Mrs. Lillian Gafne, 6402 Ridgebyrne Court, requested that the Council consider adopting a "scoop" law similar to the one adopted by the beach cities. After Council discussion , Councilman Dyda moved, seconded by Councilwoman Shaw that staff bring back recommendations showing the pros and cons of the proposed ordinance. The motion carried 4 - 0. STUDENT & THE LAW PROGRAM (1705) Mayor Hein noted receipt of a letter from Jim Ryan, Assistant Principal of Miraleste High School requesting that the City pay for the text books to be used in conjunction with this program. After Council discussion, Councilman Dyda moved, seconded by Councilwoman Bacharach to write Mr. Ryan thanking him for his letter but deny the request for $170 to pay for these books. The motion carried 3 1 with Councilwoman Shaw voting in opposition. ROUTE 91/1 -110 GAP CLOSURE (310) Councilwoman Bacharach reported that as a result of sanctions being imposed on the State of California for failure to adopt a vehicle inspection and maintenance program, the Environmental Protection Agency is now considering freezing funds to complete the 1/2 mile gap between the Artesia Freeway and the Harbor Freeway. She then moved, seconded by Councilwoman Shaw to send a letter to the EPA encouraging them not to freeze funds on this gap closure project. The motion failed on a 2 - 2 vote with Councilmembers Dyda and Mayor Hein voting in opposition. Councilman Dyda moved, seconded by Mayor Hein to draft a letter to the EPA re- iterating our position with regard to the appropriateness of them creating such sanctions and reiterating the fact that this, along with other sanctions, are totally inappropriate. The motion carried 4 - 0. Council requested that a copy of this letter be sent to our U. S. Congressman and the chairman of the subcommittee that has jurisdiction over the functions of the EPA. RESOL. NO. 81 -17 - AUTHORIZING APPLICATION FOR DRIVING UNDER THE INFLUENCE PROGRAM GRANT (1206) The City Manager summarized this grant as described in the February 20 letter from the L. A. County Sheriff's Office. Councilwoman Shaw moved, seconded by Councilwoman Bacharach to adopt RESOLUTION NO. 81 -18 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING THE CITY MANAGER OF RANCHO PALOS VERDES TO MAKE APPLICATION FOR A DRIVING UNDER THE INFLUENCE ENFORCEMENT PROGRAM GRANT FOR FISCAL YEAR 1981 -1982. With the permission of the maker and the second, Councilman Dyda requested an amendment to adopt the resolution but instruct staff to obtain Council approval of the program before acceptance of the grant. The motion as amended carried 4 - 0. RESOL. NO. 81 -18 SUMMARILY VACATING Director Abbott presented the staff AN EXCESS RIGHT -OF -WAY ON PALOS memorandum of March 3 which sum - VERDES DRIVE EAST (1408) marized this matter of vacation of a portion of a right -of -way which was declared excess by the Alderman, Swift & Lewis Right of Way Study and identified in Exhibit "A" to the proposed resolution. (At 11:00 P.M. Mayor Hein was excused.) At 11:01 Mayor Pro Tem adjourned to work session to discuss the in- house maintenance crew. The motion was made by Councilwoman Shaw, seconded by Councilman Dyda and carried. WORK SESSION REGARDING At 11:10 P.M. Mayor Pro Tem Bacharach IN -HOUSE MAINTENANCE WORK CREW called the work session to order (302) and Council proceeded to discuss the proposal of an in -house city miscellaneous maintenance crew as outlined in the memorandum of February 12, 1981 from the Director of Public Works. At 11:25 P.M. Council reconvened with no action taken. It was the consensus of Council to cancel the current contract with BMC Land- scaping covering median maintenance and tree maintenance as of May 30, 1981 and re- quest that .RJA negotiate a contract with J.T.
