CC MINS 19810203M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING FEBRUARY 3, 1981 The meeting was called to order at 7:35 P.M. by Mayor Barbara Hein at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. After the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: ABSENT: SHAW, BACHARACH, DYDA & MAYOR HEIN RYAN Also present were City Attorney Patrick Coughlan, City Manager Donald Guluzzy, Director of Planning Sharon W. Hightower, Director of Public Works Charles Abbott, Associate Planner Gary Weber, Director of Parks & Recreation Maynard Law, Administrative Assist- ant Julie Christensen, Director of Community Services Tom Bandy, Administrative Ser- vices Officer George Wunderlin, and Deputy City Clerk Mary Jo Lofthus. APPROVAL OF AGENDA Councilwoman Bacharach moved, seconded by Councilwoman Shaw and carried 4 - 0 to move the items under the New Business portion of the agenda after discussion of B -1 (Ladera Linda School Site). Councilwoman Shaw added discussion of AB115 under Council Committee; item D -2 (Coastal Commission Future Organization was deleted). The agenda as amended was approved on motion of Councilwoman Shaw, seconded by Councilman Dyda and carried 4 - 0. WAIVER OF FULL READING OF ORDINANCES Councilman Dyda moved, seconded by & RESOLUTIONS Councilwoman Bacharach to waive reading in full or all ordinances and resolu- tions adopted at this meeting with consent to the waiver of reading deemed to be given by all members of Council after reading of the title unless specific request was made at that time for reading of such ordinance or resolution. The motion carried 4 - 0. # # # It # # # 11 CONSENT CALENDAR The Consent Calendar was approved as follows on motion of Councilwoman Shaw, seconded by Councilman Dyda. MINUTES Approved as presented the minutes of the adjourned regular meetings of January 14, 15 and 19, 1981. RESOL. NO. 81 -11 REGISTER OF DEMANDS RESOL. NO. 81 -12 ADOPTED RESOL. NO. 81 -12 OF THE CITY DEFERRED COMPENSATION COUNCIL OF THE CITY OF RANCHO PALOS VERDES (1202) ESTABLISHING A DEFERRED COMPENSATION PROGRAM WITH THE INTERNATIONAL CITY MANAGEMENT RETIREMENT CORPORATION. ADOPTED RESOL. NO. 81 -11 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $180,876.23, DEMAND NUMBER 9076 THROUGH 9152. RECREATION PROGRAM AGREEMENT WITH THE PALOS VERDES UNIFIED SCHOOL DISTRICT (1201) POINT VICENTE WALKWAY (1404) Approved the Community Recreation Pro- gram Agreement with the Palos Verdes Unified School District for the period beginning July 1, 1981 and ending June 30, 1982. Accepted the Pt. Vicente Walkway, released retention of $3,471.60, released the agree- ment between the City and Granstrom Con- struction, Inc., and released Bond No. 5240- 69 -06. ACCEPTANCE OF SANITARY SEWERS - Approved the work, released the sanitary TRACT NO. 33034 sewer agreement between the City and the (1411) sub - divider, and exonerated faithful performance Bond No. 9ST 34297. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: SHAW, BACHARACH, DYDA & MAYOR HEIN NOES: NONE ABSENT: RYAN LADERA LINDA SCHOOL SITE Director Law made a slide presentation (1401) of the Ladera Linda School Site which showed the facilities at this location and the condition of the buildings and grounds. He then referred to his February 3, 1981 memorandum which summarized that the yearly costs for personnel, operation and maintenance for Ladera Linda would be $47,172; the cost to develop similar facilities would be $1,750,000. Speaking on behalf of the AYSO were Sharon Hiatt, 28666 Crestridge Road, and Jim Kelly, 3550 Heroic Dr., who told the Council about the need for more playing fields especially those with restroom and classroom facilities. Mary Foster, 32451 Searaven, told the Council about the potential users for these facilties and referred to the report that she presented to Council in November, 1980. Citing the fact that she felt it was Council's intention not to add or program this site at any cost to the City until it was considered in the overall long range capital im- provement budget, Councilwoman Bacharach moved, seconded by Councilwoman Shaw and car- ried to support the concept of the exchange of the Loma del Mar for the Ladera Linda School site and send a letter to the School District indicating the City's intention to enter into serious negotiations. Further, that the staff be designated to conduct these negotiations. With the permission of the maker, Councilman Dyda requested that the staff explore specific commitments to the City from the organizations that have expressed a desire to use the facility. The amended motion carried 4 - 0. ORDINANCE NO. 138 (1202) ORDINANCE NO. 138 OF THE CITY OF RANCHO PALOS VERDES REPEALING CERTAIN CONFLICT OF INTEREST PROVISIONS AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was read by title and INTRODUCED on motion of Councilman Dyda, seconded by Councilwoman Bacharach and carried 4 - 0. RECESS TO CLOSED SESSION At 8:40 P.M. Council recessed to a closed session to discuss pending liti- gation on motion of Councilwoman Bacharach, seconded by Councilwoman Shaw and carried 4 - 0. At 9:15 P.M. the meeting reconvened with the same members present. Mayor Hein reported that no action had been taken by the Council. REOPEN AGENDA Councilman Dyda moved, seconded by Councilwoman Bacharach and carried 4 - 0 to reopen the agenda. Councilman Dyda moved, seconded by Councilwoman Bacharach to consider Item C -1 (playing field at Del Cerro Park) as the next item of business. The motion carried 4 - 0. DEL CERRO PARK - PLAYING FIELD Referring to the letter of January 28 (1201) from Mr. R. L. Allen regarding the pos- sible establishment of a soccer, football, and softball facility at Del Cerro Park, Councilman Dyda moved, seconded by Councilwoman Bacharach and carried 4 - 0 to refer this letter to the Parks & Recreation Committee for recommendation to the Council. ORDINANCE NO. 139U - ESTABLISHING Director Hightower summarized the back - MORATORIUM IN THE KLONDIKE CANYON ground on this proposed moratorium and re- AREA (1801) f err ed to the map mounted for viewing which outlined its boundaries. The bound- aries were drawn based upon the recommendation of Dr. Ehlig after considering the infor- mation gathered to date. CITY COUNCIL -2- FEBRUARY 3, 1981 Project Engineer Kenneth Marks of Sikand Engineering & Associates, 15230 Burbank Blvd. representing Palos Verdes Properties, told the Council that a report by Moore & Taber on this area would be available later in the week; he felt that the results would show that the Palos Verdes Properties land should be excluded from the moratorium. He re- quested that Council hold up on establishing the moratorium until after the report was released. Mr. Jack Eagen, a geologist with the firm of Moore & Taber representing Palos Verdes Properties, told the Council that his firm has established the eastern boundaries of the Klondike slide within Portuguese Bend Club area and although there is no evidence of any movement south of Palos Verdes Drive, suggested deferring a decision until Dr. Ehlig has had an opportunity to review their report. The following residents of the area then spoke to the Council: Charles Fenton, 4222 Stalward Drive; Beverly Hallahan, 4304 Exultant Drive; John Vanderlip, 99 Vanderlip Drive; Mag Allerdice, 4235 Admirable Dr. ; Ken Miller, 4370 Admirable Dr..; Judy Jorgensen, 4321 Exultant Dr.; & Alma Bergman, 4031 Stalwart Dr. Their concerns dealt mainly with further investigation of the slide, if Council should wait until-receipt of the report from Moore & Taber before imposing the moratorium, if it would be possible for a home- owner to get permission to make an addition to his home, and when the Yratorium will be lifted. Councilwoman Bacharach moved, seconded by Councilman Dyda and carried 4 - 0 that the City request Dr. Ehlig to review the Moore & Taber report and prepare a report and recommendations at the earliest possible date. ORDINANCE NO. 139U OF THE CITY OF RANCHO PALOS VERDES AMENDING ORDINANCE NO. 108U, AS AMENDED BY ORDINANCE NOS. 118U, 120U, 123U, 128U, 130U, and 131U, AND DECLARING THE URGENCY THEREOF was read by title and ADOPTED on motion of Councilman Dyda, seconded by Mayor Hein and carried on the following roll call vote: RECESS AYES : SHAW, BACHARACH , DYDA & MAYOR HEIN NOES: NONE ABSENT: RYAN At 10:30 P.M. Mayor Hein declared a recess. The meeting reconvened at 10:40 P.M. APPEAL OF NEGATIVE DECLARATION FOR Associate Planner Weber presented the ENVIRONMENTAL ASSESSMENT NO. 395 staff report of February 3, 1981 which (1803) detailed the appellant's reasons for requesting an Environmental Impact Study and the staff's response to each of those concerns. Following careful review of the com- ments from the Ocean Terrace Homeowners' Association the decision was made to grant a Final Negative Declaration. This was granted by the Director of Planning on December 23, 1980 for the following reasons: (1) no new environmental issues were raised; (2) the information used to evaluate the proposed project was reasonably adequate and accurate; and (3) the mitigation measures were specific and sufficient to eliminate all identified significant environmental effects. Representing the Ocean Terrace Homeowners Association was Josephine Chapman, 3200 La Rotonda Drive, #313, who questioned what the final design of this project would be and asked if additional geologic surveys would be done in light of the Klondike Canyon sit- uation. Should movement occur, she wanted to know who would be responsible for stopping it. Additionally, she requested that Council not approve this project prior to seeing the final design plan. Also representing the Homeowners Association was Elaine Fitz, 3200 La Rotonda Drive, who also questioned the design of this project and inquired if it conformed with the LCP. Kathy Peele, 3200 La Rotonda Drive, asked if a full geology report had been prepared for the proposed development. Representing the property owner was Clark Leonard, 17430 So. Prairie Avenue, who told the Council that he will give the geology reports being prepared to the Homes Association, and said he felt the Association was mainly concerned with the design aspects of the pro- ject and not environmental problems. Representing the Rancho Palos Verdes Council of Homeowners was Ray Seager, 2 Oceanaire Drive, who read a resolution adopted by that organization requesting an Environmental Impact report on this project. Citing the Planning Commission's thoroughness in studying all aspects of tentative tracts prior to approval, including geology and design, Councilwoman Shaw moved, seconded by Councilwoman Bacharach and carried 4 - 0 to deny the appeal of the Negative Declaration for Environmental Assessment No. 395. CITY COUNCIL -3- FEBRUARY 3, 1981 RECESS At 11:24 P.M. the Mayor declared a recess. The meeting reconvened at 11:30 with the same members present except the City Attorney who had been excused for the rest of the meeting. SB 33 - MOTOR VEHICLE INSPECTION (306) Councilwoman Shaw referred to the infor- mation contained in the agenda package and recommended support of this vehicle inspection bill. She so moved, seconded by Council- woman Bacharach and carried 4 - 0. Referring to a letter from Assemblywoman Ryan requesting City support of this Bill, Councilwoman Shaw moved, seconded by Mayor Hein and carried 4 - 0 to support AB 115 and contact Assemblywoman Ryan's office to find out if there is any other way we can show our support for this bill. AB 115 - ELIMINATING REQUIREMENT FOR LOW INCOME HOUSING IN COASTAL PLANS (306 X 1203) TRAFFIC SAFETY FILM (1502) Noting that the Traffic Committe had reviewed this traffic safety film Mayor Hein asked if the Council was in favor of purchasing it so it could be shown at schools in the City. Representing the Traffic Committee was Chairman Arline Grotz who told the Council that the Committee felt this could be done as a coordinated effort with the PTA. After Council discussion it was the consensus that showing this film would probably require permission of the School District. SOUTH BAY CITIES (306) Councilman Dyda referred to the report distributed to Council which noted that the South Bay Corridor Committee Joint Powers agreement is near termination. He recommended supporting the extension of the Joint Powers Committee and so moved. The motion was seconded by Councilwoman Shaw and carried 4 - 0. REVISION TO VEHICLE CODE SECTION Councilman Dyda noted that the legislature REGARDING FINES FOR DRUNK DRIVING had added a $50.00 fine to drunk driving (306) charges but that these charges are usually reduced to reckless driving, which has a lower fine, he then moved, seconded by Councilwoman Bacharach and carried 4 - 0 that we send a letter to our legislators supporting an increase in the fines charged for reckless driving. USE OF POINT VICENTE PARK BY City Manager Guluzzy referred to the HIGH SCHOOLS TRI- COUNCIL (1201) staff memorandum of January 28, 1981 which summarized the request for use of Point Vicente Park by the Peninsula's three high schools on March 7. Councilwoman Shaw moved, seconded by Councilman Dyda and carried 4 - 0 to approve this re- quest subject to the recommendations contained in the staff memorandum. HORIZONTAL DRAINS AT KLONDIKE Councilman Dyda moved, seconded by CANYON (1801) Councilwoman Bacharach to authorize the staff to get the services of Art Keene (County Geologist) to walk the Klondike Canyon site and -make the necessary drillings to determine the extent of the geologic problems in the area for a sum not to exceed $11,000. This money is to come from General Fund Contingency.
