CC MINS 19801216M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING DECEMBER 16, 1980 The meeting was called to order at 7:35 P.M. by Mayor Pro Tem Jacki Bacharach at the Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard. After the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: SHAW, RYAN, & MAYOR PRO TEM BACHARACH ABSENT: DYDA & MAYOR HEIN Also present were City Attorney Patrick Coughlan, City Manager Donald F. Guluzzy, Director of Planning Sharon W. Hightower, Director of Public Works Charles Abbott, Associate Planner Richard Thompson, Associate Civil Engineer Gordon Siebert, Community Services Director Tom Bandy, Administrative Services Officer George Wunderlin, and Deputy City Clerk Mary Jo Lof thus. APPROVAL OF AGENDA The City Manager requested that authorization of expenditure of $2,400 for preparation of a legal description of the proposed Landslide Abatement District be added to the agenda. Council- man Ryan moved, seconded by Mayor Pro Tem Bacharach and carried to approve the agenda as amended. WAIVER OF FULL READING OF Councilwoman Shaw moved, seconded by ORDINANCES AND RESOLUTIONS Councilman Ryan' and carried to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to the waiver of reading deemed to be given by all members of Council after reading of the title unless specific request was made at that time for reading of such ordinance or resolution. CONSENT CALENDAR After removal of Item No. A -4, the remainder of the Consent Calendar was approved as follows on motion of Council- man Ryan, seconded by Councilwoman Shaw. MINUTES Approved as presented the minutes of the Adjourned Regular Meeting of November 18, and Adjourned Regular Meeting of December 2nd. Approved the minutes of the October 30th Work Session, Regular Meeting of November 18th, and Regular Meeting of December 2nd with the following amendments: October 30, 1980 - Page 2, eleventh paragraph, third line, amend to read: "approval has been given. This data could be used by the Committee as a guideline." November 18, 1980 - Page 2, Fourth paragraph, first line, amend to read: it . .spoke in favor of other park sites. . . ." Page 2, Audience Questions, second paragraph, second line, amend to read: ". . .Traffic Committee for study and. . . ." December 2, 1980 - Page 3, last paragraph, amend as follows: ". . at 7:30 P.M. to review the Sedwick Cook study which establishes guidelines for development in Subregions 1 and 7 of the coastal area.". Page 4, ninth paragraph, last line, amend as follows: it . they will be required to put their signs. . . ." Because he was absent from the Regular Meeting of November 18th and December 2nd, Councilman Ryan indicated his abstention from voting on the minutes of those meetings. RESOLUTION NO. 80 -77 ADOPTED RESOLUTION NO. 80 -77 OF THE REGISTER OF DEMANDS CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $303,901.98, DEMAND NUMBERS 8904 THROUGH 8946. RELEASE OF BOND - PARCEL MAP NO. 7153 (1410 ) RESOLUTION NO. 80 -78 SOLID WASTE GRANT FUNDS APPLICATION (1402) CLAIM OF ROBERT AND DONNA SEPKE AGAINST THE CITY (303) RESOLUTION NO. 80 -79 COUNTY AID TO CITIES (1404) Released Bond No. 51251 issued by Fremont Indemnity Company. ADOPTED RESOLUTION NO. 80 -78 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING THE APPLICA- TION FOR GRANT FUNDS UNDER THE SOLID WASTE MANAGEMENT ACT OF 19800 Rejected the claim as provided in Government Code Section 912.6. ADOPTED RESOLUTION N0. 80 -79 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES REQUESTING AN ALLOCATION AND PAYMENT OF COUNTY AID TO CITIES FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS. PT. VICENTE - REQUEST FOR FUNDS Approved the installation of land - TO LANDSCAPE s cap ing on the lower half of the (1404) Pt. Vicente Walkway for a cost not to exceed $1,500. Funds to be appropriated from the General Fund Contingency Account. COUNCIL /MANAGER RETREAT (1101) Account and added to 1980 -81 Council budget. Appropriated $2,600 for a Council/ Manager retreat. Funds to be appro- priated from General Fund Contingency The motion to approve the Consent Calendar carried on the following roll call vote: AYES: SHAW, RYAN AND MAYOR PRO TEM BACHARACH NOES: NONE ABSENT: DYDA & MAYOR HEIN REOPEN AGENDA that the agenda be reopened to moved, seconded by Councilman by Councilman Ryan and carried item of business, Indicating that she received a request to speak about Miraleste Drive Safety Study, Mayor Pro Tem Bacharach requested consider placement of this matter. Councilwoman Shaw so Ryan and carried. Mayor Pro Tem Bacharach moved, seconded to consider the Miraleste Drive Traffic Study as the next MIRALESTE DRIVE SAFETY STUDY Associate Civil Engineer Siebert (1404) presented the staff memorandum of December 16, 1980 which described the engineering report presented to the Traffic Committee recommending in- stallation of a guardrail, improved signing and striping, raised pavement markers, installation and construction of left turn pockets and increased traffic enforcement to alleviate some of the traffic problems along Miraleste Drive. The striping and pavement markers will be installed using Federal PMS funds; guardrail installation and signing will be eligible for 90% Federal funding under the HES program. The estimated cost for HES- funded projects is $20,500 which means that the City's share would be $2,000. Staff recommended that the Council accept the Traffic Committee's recommendation to proceed with preliminary engineering and specifications upon approval of Federal funding and allocate $2 , 000 to cover the City's 10% matching share for this project. Mr.& Mrs. Stanley Walsh, 4215 Miraleste Drive, spoke against the installation of a guard- rail fearing that it would cause cars to ricochet across the street. They requested that it be removed from the proposal. City Council -2- 12/16/80 Speaking on behalf of the Miraleste Parks & Recreation District was Michael Gray, 4125 Miraleste Drive, who requested that the guardrail be placed farther down the embankment to prevent the possibility of ricocheting. He also requested that a study be done to see if additional access down the hill from the Miraleste area was feasible. Councilman Ryan moved, seconded by Councilwoman Shaw to accept the Traffic Committee's recommendation to proceed with preliminary engineering and specifications upon approval of Federal funding and allocate $2,000 to cover the City's 10% matching share for this project with the understanding that staff will examine the trade -offs involved in installing a guardrail. The motion carried on the following roll call vote: AYES: SHAW, RYAN & MAYOR PRO TEM BACHARACH NOES: NONE ABSENT: DYDA & MAYOR HEIN ORDINANCE NO. 137 ORDINANCE NO. 137 OF THE CITY OF RANCHO TRUCK ROUTES PALOS VERDES REPEALING ORDINANCE NO. 129 (1502) AND RESTRICTING THE USE OF CERTAIN STREETS AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE was presented for adoption, first reading having taken place on December 2, 1980. Councilman Ryan moved, seconded by Councilwoman Shaw to waive further reading and ADOPT ORDINANCE NO. 137. The motion carried on the following roll call vote: AYES: SHAW, RYAN & MAYOR PRO TEM BACHARACH NOES: NONE ABSENT: DYDA & MAYOR HEIN MONTEMALAGA MEDIAN - Director Abbott presented the staff memo - AWARD OF DESIGN CONTRACT randum of December 16, 1980 which listed (1502) the proposals submitted to the City for design of this median. He recommended that Council authorize the Mayor to execute an agreement with Alderman, Swift & Lewis to provide engineering services for the preparation of plans and specifications for the construction of raised median islands on Montemalaga Drive. Councilman Ryan so moved, seconded by Councilwoman Shaw and carried. CITY -WIDE HOUSING ELEMENT Director Hightower presented the staff (1203) memorandum of December 16, 1980 which summarized the program of resources, steps to address mixed use criteria, elements of getting sufficient data to begin addressing city -wide housing element, and a definition of approach to affordable housing concept, Councilwoman Shaw moved, seconded by Councilman Ryan and carried that staff consider Council's direction that the City will definitely do a revision of the housing elements as demanded by law and start as soon as feasible. Also, that a request for additional staffing be brought to the Council in January. Councilman Ryan moved, seconded by Councilwoman Shaw and carried that the City Attorney formalize his mixed use housing guidelines and present to the Council. SEAVIEW LANDSLIDE AREA - Director Abbott summarized the staff CONCRETE REPAIRS report of December 16th which contained (1801) the recommendation that the Council appropriate $5,680 to repair (1) curb and gutter and related sidewalks and driveway aprons ($3,580), and (2) the concrete swale at such time as the homeowners have begun construction of the drainage ditch ($2,000). Funds to be appropriated from General Fund Contingency Account. Councilwoman Shaw moved, seconded by Councilman Ryan to adopt the staff recommendation. The motion carried on the following roll call vote: AYES: SHAW, RYAN, MAYOR PRO TEM BACHARACH NOES: NONE ABSENT: DYDA & MAYOR HEIN City Council -3- 12/16/80 PUBLIC HEARING Mayor Pro Tem Bacharach opened the TENTATIVE TRACT-MAP N0. 38512 - public hearing on this tentative RESOLUTION 80 -80 tract and the Clerk reported that (1411) notice of the hearing had been given, with evidence on file, and no written protests were received. Associate Planner Richard Thompson summarized this request for approval to subdivide a 2.14 acre, two parcel site, into six lots for the future construction of single - family homes. The map provides for the construction of a public cul -de -sac street, drainage system, rough site preparation, sewers and undergrounding of utilities. The applicant has requested that the amount of street improvements required be reduced. Staff recommended that the Council approve this tentative tract map subject to the conditions listed in Exhibit "A" of the draft resolution. The applicant, Mrs. Dorothy Tielens, 3 Wrangler Road, Rolling Hills, requested that Council delete the requirement for improvement of Palos Verdes Drive South adjacent to the property. Speaking on behalf of the Palos Verdes South Homeowners Association was Art Maier, 3711 Vigilance Drive, who expressed concern about the use of street lights in the tract. There being no response to the Mayor Pro Tem's call for additional public testimony, she declared the hearing closed. Council then discussed the pros and cons of public versus private streets. Speaking on behalf of the Planning Commission was Chairman Harvey Brown who told the Council that the Commission was in favor of keeping the road public. RESOLUTION NO. 80 -80 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING TENTATIVE TRACT MAP NO. 38512 was read by title and ADOPTED on motion of Councilwoman Shaw, seconded by Mayor Pro Tem Bacharach and carried. (At 8:50 P.M. the City Attorney was excused from the meeting.) DIAL -A -RIDE Mayor Pro Tem Bahcarach reported that (1201) an administrator has now been hired for this program which will start on January 5th and that tickets will be sold at City Hall. LOS ANGELES COUNTY TRANSPORTATION COMMISSION (306 x 1505) LANDSLIDE ABATEMENT DISTRICT - REQUEST FOR FUNDS TO PREPARE LEGAL DESCRIPTION (1801) Mayor Pro Tem Bacharach moved, seconded by Councilwoman Shaw and carried to endorse John C. VanDoren from the City of Duarte as alternate to the LACTC. The City Manager requested approval of an expenditure of $2,400 for preparation of a legal description of the Landslide Abatement District.
