REGULAR MEETING
SEPTEMBER 7, 1982
The meeting was called to order at 7:30 P.M. by Mayor Robert E. Ryan at the
Palos Verdes Unified School District Building, 30942 Hawthorne Boulevard.
After the Pledge of Allegiance to the flag, roll call was answered as
follows:

APPROVAL OF THE AGENDA The City Clerk announced
that the following items

Traffic Committee resignation (Shaw) , City Manager Recruitment for
Parks & Recreation Director (Hein), and Approval of Yarmudian versus Rancho

WAIVER OF FULL READING OF ORDINANCES Councilman Dyda moved,
AND RESOLUTIONS seconded by Councilwoman
Shaw and carried to waive
further reading in full of all ordinances and resolutions adopted at this
meeting with consent to the waiver of the reading deemed to be given by
all councilmembers after reading of the title, unless specific request
was made at that time for the reading of such ordinance or resolution.
CONSENT CALENDAR The City Clerk announced
that items A -1 (Minutes
of August 3, 1982), A -4 (Lease Agreement with Messrs. Hatano and Petterson),
and A -7 (Agreement for state testing of signal controllers) were removed
from the Consent Calendar. The remainder of the items were approved as

Change No. 10.

GENERAL PLAN AMENDMENT NO. 13 AND Mayor Ryan declared the public

LADERA LINDA ( 701 x 18 0 2 ) change the designation from
institutional to residential
2 - 4 units per acre, and a zone change to change the classification from
Institutional to Residential, 3 units per acre (RS -3). The City Clerk reported
that notice had been published and that no written protests had been received
by the City. Director Hightower presented the staff report of September 7, 1982
which recommended that the City Council approve General Plan Amendment No. 13
pursuant to the proposed resolution and Zone Change No. 11 pursuant to the
proposed ordinance.
There being no..response to the Mayor's call for public testimony, he declared
the hearing closed.
Councilman Dyda moved, seconded by Councilwoman Bacharach and carried to
ADOPT RESOLUTION N0. 82 -63 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES ADOPTING GENERAL PLAN AMENDMENT N0. 13 OF THE CITY OF RANCHO PALOS
VERDES.
Councilman Dyda moved, seconded by Councilwoman Shaw and carried to INTRODUCE
ORDINANCE N0. 160 OF THE CITY OF RANCHO PALOS VERDES APPROVING ZONE CHANGE
N0. 11.
RESOLUTION NO. 82 -64 - APPLYING Mayor Ryan declared the hearing
CERTAIN PROVISIONS OF THE STATE open on this request from
VEHICLE CODE TO PRIVATE PROPERTY Marineland to perform traffic
=- MARINELAND (1206 x 1502) enforcement duties on Marineland's
property. The City Clerk reported
that notice had been published and that no written protests had been received.
City Manager Guluzzy presented the staff report of September 1 which explained
that the California. Vehicle Code allows cities to enforce traffic regulations
and controls on privately owned and maintained off - street parking facilities.
This can be enacted by either ordinance or resolution.
Responding to the Mayor's call for public testimony was John Corcoran, General
Manager of Marineland, who told the Council that there are frequent violations
of the handicapped parking spaces and patrolling by the Sheriff's Department
is the only way to enforce that regulation.
There being no further response to the Mayor's call for public testimony, he
declared the hearing closed.
Council then discussed the costs involved in having the Sheriff perform this
additional patrolling, if this would affect response time on City calls,
the amount of fines and forfeitures accruing to the City from this patrolling,
and if this situation should be tracked for a year to find out how much time
will be spent on it.
Councilwoman Shaw moved, seconded by Councilwoman Hein and carried to ADOPT
RI.aOLUTION NO. 82 -64 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
APPLYING CERTAIN PROVISIONS OF THE STATE VEHICLE CODE TO PRIVATELY OWNED
AND MAINTAINED OFF STREET PARKING FACILITIES.

Councilwoman Hein moved, seconded by Mayor Ryan to keep track of the traffic
calls at Marineland for one year and bring that information back to Council.
After discussion of how this patrolling compared with patrolling on certain
private streets within the City and the amount of time involved in this
recordkeeping, the motion failed on a three - two vote with Councilmembers
Bacharach, Dyda, and Shaw voting in opposition.
DISSOLUTION OF EL PRADO Community Services Director Bandy
RECREATION AND PARK DISTRICT presented the staff report of
(1201) August 30, 1982 which outlined
the request from the E1 Prado
Parks & Recreation Board of Directors to dissolve that district because of its
very limited operation. Staff recommended that Council direct staff to proceed
with the creation of a subsidiary district to replace the El Prado Recreation
and Park District.
Council then discussed the fact that the property tax collected would be
restricted for use in that district only, and if there would be an administrative
fee for this district. Concern was expressed that perhaps other groups would
expect the City to maintain other entryways within the City if homeowners groups
couldn't afford their maintenance.
Councilwoman Bacharach moved, seconded by Councilwoman Shaw, to direct staff
to proceed with the creation of a subsidiary district to replace the E1 Prado
Recreation and Park District.
Representing the E1 Prado District was Kenneth Kalbfleisch, Vice Chairman of
the Board of Directors. He told the Council that since the district pays only two
light bills the staff recommendation to form a subsiduary district would be a
more efficient way to serve the community. Should the City decide to remove
the stone entryway and lights, the Board would want to be involved in this
because he felt the homes association would want to reconsider taking over the
responsibility for maintenance.
Considering the comments made by Mr. Kalbfleisch, it was the consensus of Council
that should the decision ever be made to remove the stone entryway and lights
then the City should inform the district prior to such action being taken.
The motion to adopt staff's recommendation carried unanimously.
INSPECTION AT 100 VANDERLIP DRIVE Commenting that he had talked with
(1801) the City Attorney about this matter,
Mayor Ryan requested that the Council
consider postponing this matter for 30 days to give the City Attorney an opportunity
to review it. Councilman Dyda so moved, seconded by Councilwoman Shaw and carried.
ORDINANCE NO. 161 - SANITARY SEWER Director Hightower presented the

the municipal code.

ORDINANCE N0, 161 OF THE CITY OF RANCHO PALOS VERDES ADOPTING BY REFERENCE
PURSUANT TO SECTION 50022.2 OF THE GOVERNMENT CODE, LOS ANGELES COUNTY CODE,
TITLE 209 UTILITIES, DIVISION 29 SANITARY SEWERS AND INDUSTRIAL WASTE, AND
AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE,
IMPROVEMENT OF HAWTHORNE Director Abel presented the staff
BOULEVARD (1404) report of September 7, 1982 which
explained that negotiations had
taken place between the City, Rolling Hills Estates and the County of Los Angeles
to jointly reconstruct Hawthorne Boulevard from Silver Spur to Palos Verdes Drive
North. The City has -greed to pay half its jurisdictional share of the construction
cost, and the County has agreed to pay the other half. The City's portion will be
funded by the Federal Hazard Elimination Safety (HES) Program. Also included
in the construction package is an improvement to Palos Verdes Drive East which is

PALOS VERDES PROPERTIES In response to Council's inquiry
about the grading taking place
at the upper Barkentine tract, staff said that two more boles remained to be
drilled and that it should be completed by the end of September; after that,
hydroseeding is to be done by the developer.
TRAFFIC COMMITTEE RESIGNATION (1502) It was the consensus of Council
that the City Clerk should sAart
the notification process to fill
the vacancy on the Traffic Committee created by the resignation of Irmgard Chapsky.
PARKS & RECREATION DIRECTOR It was the consensus of Council
RECRUITMENT (1201 x 1202) to discuss the recruitment of the
Parks & Recreation Director at
the September 16, 1982 Work
Session.
STATUS REPORT Council briefly discussed the
status report. No action was
taken.
ITEMS REMOVED FROM THE CONSENT CALENDAR:
MINUTES OF AUGUST 39 1982 Page 3, second paragraph, fifth
lifie amended as follows: ". . .
totalled an unverified 53018% protest. . ." Motion made by Councilman Dyda,
seconded by Councilwoman Hein and carried with Councilwoman Bacharach abstaining.
Minutes as amended were approved on motion of Councilwoman Shaw, seconded by
Councilman Dyda and carried with Councilwoman Bacharach abstaining.
AGREEMENT FOR STATE TESTING OF Council discussed whether
SIGNAL CONTROLLER (1404) installation of these controllers
could be coordinated with the
widening and improvement of Hawthorne Boulevard; it was the consensus that
staff should see if this could be accomplished.
Councilman Dyda moved, seconded by Councilwoman Shaw to authorize the mayor
to enter into a contract with CALTR.ANS to test four controllers at an estimated
cost of $4,340.000 The motion carried on the following roll call vote:
