REGULAR MEETING
AUGUST 169 1983
The meeting was called to order at 7:30 P.M. by Mayor Robert E. Ryan at the
Palos Verdes Unified School District building, 30942 Hawthorne Boulevard,
notice having been given with affidavit thereto on file.
PRESENT: HEIN, BACHARACH, DYDA, AND MAYOR RYAN
ABSENT: NONE
Also present were City Manager Donald F. Guluzzy, Environmental Services
Director Sharon W. Hightower, Associate Civil Engineer Gordon Siebert,
Administrative Services Director Kiti Laisure, City Clerk Mary Jo Lofthus,
and Community Services Director Tom Bandy.
WAIVER OF FULL READING OF Councilwoman Hein moved, seconded by Councilman
ORDINANCES & RESOLUTIONS Dyda and carried, to waive reading in full of
all ordinances and resolutions adopted at this
meeting with consent to the waiver of reading
deemed to be given by all Councilmembers after reading of the title, unless
specific request was made at that time for the reading of such ordinance
or resolution.
APPROVAL OF AGENDA The City Clerk announced the following deletions
from the agenda: General Plan Amendment No. 16,
Grading Application No. 670, and Variance No. 92.
The following items were added: Legislation HR 3876 (Dyda), and Improvements
at Abalone Cove Beach (City Manager). The Agenda as amended was approved on
motion of Councilwoman Bacharach, seconded by Councilwoman Hein and carried.

TRAVERS TREE SERVICE Council authorized payment to Travers Tree Service

retention withheld from their contract and recog-
nized the satisfactory completion of their Fiscal
Year 1982 -83 agreement.

TRAVERS TREE SERVICE Authorized the Mayor and City Clerk to sign an agree -
CONTRACT - 83 -84 ment with Travers Tree Service for the Fiscal Year
(1407) 1983 -84 for the Tree Removal Program based on last
year's cost.
The motion to approve the Consent Calendar carried on the following roll call

Mayor Ryan abstained from voting on the August 1, 1983 Council
Minutes.
GENERAL, PLAN AMENDMENT Mayor Ryan opened the Public Hearing on this matter
N0. 12 - GOLDEN COVE and reported that the applicant had requested that
(701) the matter be continued to September 6, 1983.
Councilman Dyda so moved, seconded by Councilwoman
Hein and carried.
REQUEST FOR INITIATION OF Director Hightower reported that the applicant had
N0. 15 RECONSIDERATION requested that the City Council reconsider his
(701) application and Council agreed this matter concerns
a 26,000 square foot parcel currently being utiliz-
ed as a Nursery School (Hilltop Nursery School).
The Applicant is requesting an amendment to increase the density to 6 - 12
dwelling units per acre. Staff recommended denial of this application since it
required greater density than the surrounding land uses and could constitute
spot zoning.
Applicant, Mr. N. L. Zamfirescu, described to the Council his intended use of
this property and said that this change would be an improvement for the neighbor-
hood.

Council discussion included remarks about the integration of the Bikeway plan
for that area, the height of the berm around the proposed project, if this zoning
variation could be justified within this small area, and if it could be zoned
instead for 2 - 4 units per acre.
Councilwoman Hein moved, seconded by Councilwoman Bacharach to deny this request
for initiation of the General Plan Amendment No. 15. The motion carried unanimously.
PARATRANSIT MARKETING Associate Civil Engineer Siebert presented the staff
PLAN memorandum of August 16, 1983 which recommended:
(1505) (1) Authorize the City Manager to develop and conduct
community presentations to be conducted by December 20,
1983, at a cost not to exceed $2,500. (2) Authorize a
contract with Transit Contractors to provide promotion, as proposed, for a cost not
to exceed $5,605 using various publications.
Councilwoman Bacharach moved, seconded by Councilwoman Hein and carried to approve
the staff recommendations.
ORDINANCE N0. 173 - ORDINANCE N0. 173 OF THE CITY OF RANCHO PALOS VERDES
PERS CONTRACT AUTHORIZING THE AMENDMENT TO THE CONTRACT BETWEEN
(1202) THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF
THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM
was presented for adoption, first reading having taken place on July 19,.1983.
Councilman Dyda moved, seconded by Councilwoman Bacharach to ADOPT ORDINANCE
NO. 173. The motion carried on the following roll call vote:

HESSE PARK GATES City Attorney Dorsey presented the Indemnification
WAIVER OF DAMAGES Agreement permitting gates to be installed in the
AND INDEMNIFICATION Hesse Park fence. In particular, he described the
AGREEMENT General Liability Insurance required of the residents
(1201) in order to install such gates. This agreement
would permit the Public Works Department to authorize
installation of gates in this fence.
Councilman Dyda moved, seconded by Councilwoman Bacharach and carried to adopt the
Waiver of Damages and Indemnification Agreement and Writ of Ingress and Egress -
Covenant to run with the land.
COMMUNITY ASSOCIATION Councilman Dyda moved, seconded by Councilwoman
OF THE PENINSULA Hein and carried to approve the permit to the
(305) Community Association of the Peninsula (CAP) for
a September 11, 1983 door -to -door fund raising
campaign for that organization.
ABALONE COVE BEACH
IMPROVEMENTS

The City Manager Guluzzy reported on his contact
with the County regarding the reimbursement to the
City for improvements made at Abalone Cove. It was
his understanding that they would be reimbursing the
City for the $30,000 expended at the park.

LEGISLATION - Councilman Dyda moved, seconded by Councilwoman Hein
HR 3876 and carried to send a letter to Congressman Glen
(306) Anderson indicating the City's appreciation for his
help in having the provision for Landslide Abatement
Districts included in this Bill.
Councilwoman Bacharach moved, seconded by Councilwoman Hein and carried to go on
record as supporting this Bill.
AUDIENCE QUESTIONS
Jerry Cole, 6602 Verde Ridge, Rancho Palos Verdes, inquired about the

CLOSED SESSION On motion of Councilman Dyda, seconded by Council-
woman Hein and carried, Council adjourned to a
Closed Session to discuss pending litigation.
RECONVENE AND At 8:45 P.M. the Meeting reconvened with no action
ADJOURNMENT taken and immediately adjourned to 7:30 P.M.
August 22, 1983 for a Budget Work Session on motion
of Councilman Dyda.
