ADJOURNED REGULAR MEETING
APRIL 19, 1983
The meeting was called to order at 6:30 P.M. by Mayor Robert E. Ryan, at the
City offices, notice having been given with affidavit thereto on file.
PRESENT: BACHARACH, DYDA, HEIN, & MAYOR RYAN
ABSENT: NONE
Also present were City Attorney Steve Dorsey, City Manager Donald F. Guluzzy,
City Clerk Mary Jo Lofthus, and Director of Public Works Carl Abel.
COUNCIL VACANCY Councilwoman Bacharach moved, seconded by Mayor
Ryan to appoint Mel Hughes to fill out the
unexpired term of Ann Shaw. The motion failed on a two -two tie vote with
Councilmembers Fein and Dyda voting in opposition.
Councilwoman Hein's motion to appoint Dave Ruth died for lack of a second.
Councilwoman Bacharach moved, seconded by Mayor Ryan to appoint Douglas
Hinchliffe. The motion failed on a two -two tie vote with Councilmembers Hein
and Dyda voting in opposition.
Councilman Dyda moved, seconded by Mayor Ryan to leave the position vacant.
The motion failed on a two -two vote with Councilmembers Bacharach and Ryan
voting in opposition.
Mayor Ryan moved, seconded by Councilwoman Bacharach to fill the vacancy. The
motion failed on a two -two vote with Councilmembers Dyda and Hein voting in
opposition.
Councilwoman Bacharach moved, seconded by Mayor Ryan and carried to send a
letter to all of the applicants thanking them and rejecting all of the applica-
tions.
PALOS VERDES DRIVE EAST Director Abel presented the staff report of
SLIDE RECONSTRUCTION (1404) April 19, 1983 which explained the overrun costs
on this reconstruction project and made the
following recommendations: (1) Authorize staff to generate a letter to Sukut
Construction Company for the Mayor's signature notifying them of the unprofes-
sional manner in which they conducted themselves in the billing and notification
process. (2) Authorize staff to pay $49,000 to Sukut Construction until grant
increase has been officially approved. (3) Council approved the expenditure
of $103,100 for construction and $25,000 for engineering services on Palos
Verdes Drive East reconstruction.
Councilwoman Bacharach moved, seconded by Councilwoman Hein to approve staff
recommendations. The motion carried on the following roll call vote:

INCOMPATIBLE OFFICES City Attorney Dorsey presented the
April 14, 1983 opinion prepared in response
to Council's request as to whether the offices of City Councilmember and
member of the Board of Directors of the Abalone Cove and Klondike Canyon
Landslide Abatement Districts are incompatible. After reviewing the cases and
the Attorney General's opinions on the subject, it was his opinion that the
rule against holding incompatible offices does not apply, at least for the
first four years following formation of the districts, because the State
legislature authorized holding both offices simultaneously during the initial
four year period.
ADJOURNMENT At 7:05 P.M. the meeting was adjourned on
motion of Councilman Dyda.
