A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES ESTABLISHING A TREE
REMOVAL, REPLACEMENT, AND MAINTENANCE POLICY,
AND RESCINDING RESOLUTION NUMBER 77 -53♦
WHEREAS, the City of Rancho Palos Verdes hereby FINDS, RESOLVES and
ORDERS as follows:
Section 1. The following tree removal, replacement and maintenance
policy is hereby adopted:
TREE REMOVAL, REPLACEMENT AND MAINTENANCE POLICY
Purpose: To define and establish City Policy on tree removal, tree
replacement and tree maintenance in the public right -of -way.
Definition: All definitions utilized in the Tree Removal, Replace-
ment and Maintenance Policy shall be the same as in Chapter 2 of Article VII
of the Rancho Palos Verdes Municipal Code, except for the following additions:
(a) The term "undesirable" parkway tree used in this Policy
means any tree within the parkway area that is not wanted
or desired by the adjacent property owner because of
abnormal shape or growth; prevention of normal lawn
growth; or other compelling reason.
Polic : 1. The City shall trim parkway trees only for traffic and
pedestrian saf ety.
2. The City shall spray parkway trees only to control
disease and /or insects.
3. The City will remove and replace a parkway tree at no
cost to the property owner when in the judgement of the Department of Public
Works at least one of the following conditions exist:
(a) Tree is dead or diseased
(b) Tree is a hazard
(c) Tree roots have caused extensive damage to the side-
walk and /or curb and gutter
(d) Tree has undesirable root growth characteristics,
and will soon cause concrete damage; provided, root
pruning is not feasible.
4. The City may remove and replace an "undesirable" parkway
tree when requested by property owner; provided the property owner pays to the
City an amount sufficient to defray tree removal and replacement costs.
5. If the property owner wishes to remove the tree himself,
he must obtain a permit from the Public Works Department and deposit an amount
sufficient to cover the cost of replacement.
6. Replacement trees shall be of the size designated by the
Director of Public Works, and the tree specie shall be as designated in the
official tree list. Furthermore, replacement tree shall be planted according to
the City of Rancho Palos Verdes planting specifications. If not done according
to these specifications, the City may remove and replace the tree at the property
owner's expense.
7. Should property owners within a residential block desire a
specie of parkway tree different from that designated in the official list for
Street Trees, a petition requesting the change may be submitted to the City; the
petition must be signed by 60% of the property owners on the block with agreement
on the specie of the replacement tree. Removal and replacement costs will be
paid by the petitioning property owners prior to commencement of any tree work.
8. Should a property owner within a residential block desire a specie
of tree different from the one designated for that block, the resident may select
an alternate from the approved species list if the request is submitted in
writing and if no additional costs are incurred by the City.
