A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES VACATING A PORTION•OF
PALOS VERDES DRIVE EAST BETWEEN MIRALESTE PLAZA
AND CORSINI PLACE ADJACENT TO 4315 VIA FRASCATI
The City Council of the City of Rancho Palos Verdes hereby RESOLVES,
FINDS and DETERMINES as follows:

Section 1. The City Council of the City of Rancho Palos Verdes on
June 7, 1983, adopted Resolution No. 83-32 entitled "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF RANCHO PALOS VERDES DECLARING THEIR INTENTION TO CONDUCT
A PUBLIC HEARING REGARDING THE VACATION OF RIGHT OF WAY OF A PORTION OF PALOS
VERDES DRIVE EAST BETWEEN MIRALESTE PLAZA AND CORSINI PLACE," adjacent to 4315
Via Frascati and setting a time and place for a public hearing thereon.
Section 2. Notices of the proposed street vacation were duly published
and posted in the manner and form and at the time required by Streets and Highways
Code Section 8323.
Section 3. The City Council of the City of Rancho Palos Verdes held
public hearings thereon on June 21, 1983, at 7:30 o'clock P.M. in the Council
Chambers located at 30942 Hawthorne Boulevard, Rancho Palos Verdes, California,
at which time said Council heard all evidence offered by persons interested in
said vacation. • • •
Section 4. The City Council has considered the General Plan of the
City of Rancho Palos Verdes and finds the right of way vacation to be in con-
formity with said General Plan, which does not designate Palos Verdes Drive East
as having a 150' width.
Section 5. Pursuant to Section 2381 of the Streets and Highways Code
of the State of California, the City Council finds and determines the right of
way hereby vacated is not useful as a nonmotorized transportation facility, due
to the steep grade of the right of way and the adjacent improved right of way.
Section 6. The right of way described in Section 10 was dedicated as
a 150 foot-wide easement for street purposes by Tract Map 7145 recorded in 1924.
Subsequently Palos Verdes Drive East (formerly Granvia Miraleste) was constructed
to a 100-foot width. The portion of the easement hereby vacated was in excess of
the easement necessary for street purposes, and for that reason the vacated portion
of said easement has not been used or improved for street purposes.
Section 7. The City Council finds and determines that the right of way
hereby vacated has never been used or developed for street or highway purposes,
is not needed for street or highway purposes and is an excess right of way, be-
cause the adjacent improved right of way is adequate for present and future needs
and because of the extreme grade of the portion hereby vacated makes improvements
economically infeasible.
Section 8. The City Council hereby finds and determines that the public
convenience and necessity require the reservation of easements in the property
described and the right from time to time to construct, maintain, operate, replace,
remove, renew and enlarge sanitary sewers and storm drains and appurtenant struc-
tures in, upon, over and across the right of way hereby vacated and to construct, .
maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits,
cables, wires, poles, and other convenient structures, equipment, and fixtures
for the operation of telegraphic and telephone lines and for the transportation
or distribution of electric energy and for incidental purposes including access to
protect such works from all hazards in, upon and over the right of way hereby
vacated and hereby declares that these proceedings are subject to such reserva-
tions and exceptions.

Section 9.. The City Council hereby finds and determines that the public
convenience and necessity require the reservation of a slope easement in the
vacated property and hereby declares that these proceedings are subject to such
reservations and easements.
Section 10. The City Council hereby orders that the portion of Palos
Verdes Drive East between Miraleste Plaza and Corsini Place in the City of Rancho
Palos Verdes and described as:
That portion of South Palos Verdes Drive East, in the City
of Rancho Palos Verdes, County of Los Angeles, State of
California, formerly known as Granvia Miraleste, as shown on s("`-
map of Tract Na 7145, filed in Book 96, pages 19 through 23, of
Maps, in the office -of the Recorder of said county, within the
following described boundaries:
Beginning at the most .:easterly corner of Lot 11, .Block 4800,
Tract No. 7145, as shown on said map; thence N40 54'10"W along
the northeasterly boundary of said lot a distance of 100.00
feet to that certain curve having a radius of 595 feet in said
northeasterly boundary; thence northwesterly along said certain
curve through a central angle of 0°57'47" a distance of 10.00
feet to the most northerly corner of said lot; thence N31 0 57'55"E
along the northeasterly prolongation of that certain course having
a bearing of N31 57'55"E in the nor i:hwestcrly boundary of said lot
a distance of 51.89 feet to the most westerly intersection of said
northeasterly prolongation with a curve concentric with and 50 feet
northeasterly, measured radially, from said certain curve, a radial
of said concentric curve to said intersection bears S46 51'02"W;
thence southeasterly along said concentric curve through a central
angle of 2°14'48" a distance of 25.29 feet to a line parallel with
and 50 feet northeastly, measured at might angles, from the north-
easterly line of said lot; thence S40 54'10"E along said parallel
line 101,10 feet to the northeasterly prolongation of that certain -
course havin g g a bearing of N50°21'45"E in the southeasterly boundary
of said lot; thence S50 o 21'45"W along said northeasterly prolonga-
tion 50.01 feet to the point of beginning.
Section 11. The City Clerk shall cause a certified copy of this resolu-
tion, attested by the City Clerk under seal, to be recorded in the office of the
County Recorder of Los Angeles County.
