CC RES 1984-017RESOLUTION N0.84 -17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AMENDING THE PROCEDURES IMPLEMENTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND THE GUIDELINES OF THE SECRETARY OF RESOURCES AND AMENDING RESOLUTION N0. 83 -749 THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE AS FOLLOWS: Section 1: Section III J of the Procedures Implementing the California Environmental Quality Act and the Guidelines of the Secretary of Resources adopted by Resolution No. 83 -74 is hereby amended to read as follows: J. Time Limit. For a private project involving a lease, license, permit, certificate or other entitlement for use, a negative.. Declaration must be completed within 105 days from the date the application is accepted as complete and the project must be approved or disapproved within six months from the date the application is accepted as complete. a reasonable extension may be granted where justified and the applicant consents. Section 2: Section IV A(3) of the Procedures Implementing the California Environmental Quality Act and the Guidelines of the Secretary of Resources adopted by Resolution No. 83 -74 is hereby amended to read as follows: (3) Notice of Preparation Immediately after deciding that an EIR is required, the Lead Agency shall send by certified mail, or other method providing a record, to each Responsible Agency, Trustee Agency and Jurisdiction of Law, a Notice of Preparation, as provided for in Section V of these Guidelines. Said agencies shall have thirty (30) days in which to respond to the Notice and a draft EIR may not be circulated for public review until that time has elapsed. Section 3: Section IV E(3) of the California Environmental Quality Act and the Resources adopted by Resolution No. 83 -74 is #7OOx -B6 Procedures Implementing the Guidelines of the Secretary of hereby amended to read as follows: (3) Time Limit. For, a project involving a lease, license, permit, certificate, or other entitlement for use, the Lead Agency shall complete and certify an EIR within one year from the date on which the application is accepted as complete. A reasonable extension, may be granted where justified and the applicant consents, provided that if such an extension is granted the project must be approved or disapproved •within ninety (90) days after certification of the final EIR.
