After the Pledge of Allegiance to the flag, roll call was answered as follows: PRESENT: HUGHES, RYAN, McTAGGART, HINCHLIFFE, AND MAYOR BACHARACH ABSENT: NONE Also present were City Manager Donald F. Guluzzy, City Attorney Strausz, Environmental Services Director Sharon Hightower, and City Clerk Jo Purcell. NO. RDA 84---10 Agency Counsel Strausz summarized the intent of ACQUISITION BY this resolution: The Agency. will not adopt a EMINENT DOMAIN resolution acquiring property under eminent domain (1801) until the Agency has held a public.hearing on such acquisition This hearing would be in addition to any other public hearing which may be required with respect to that acquisition. RESOLUTION NO. RDA 8410 OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY REGARDING ACQUISITION BY EMINENT DOMAIN was read by title and adopted on motion of Councilman Ryan, seconded by.Councilman Hughes. The motion carried on a 4 --- 0, vote with Councilman Hinchliffe abstaining. JOINT PUBLIC HEARING Mayor Bacharach opened up the joint public REDEVELOPMENT PLAN FOR hearing of the Rancho Palos Verdes City Council PROJECT AREA N0. 1 and the Rancho Palos Verdes Redevelopment Agency (1801) on the proposed redevelopment plan for Project Area No. 1. The City Clerk reported that notice had been duly published. Additionally, the City Clerk summarized the letter signed by Rose Marie DiSanto and Pat DiSanto, LaVon Malin, Mary Witt and Ernest Witt, Thomas H. and Pauline Sears, Hazel DiSanto and Joe DiSanto. A letter was received from Stephen K. Heller suggesting wording for the Redevelopment Agency plan, a letter from D. E. Clark requesting clarification of.., Section 33820 of the Health and Safety Code, and a letter from Erica and Charles Stewart objecting to the Land Use part of the redevelopment proposal. Mayor Bacharach ordered that these letters be made part of the record of the hearing. City Manager Guluzzy briefed the Council on the report from the Agency which he said contained, among other things, the reasons for the selection of the Project Area and ,a description of the physical, social, and economic conditions in the area. He further stated that the Project Area was selected because of the economic dislocation, deterioration and disuse in the Project Area resulting from faulty planning and inadequate public improvements. The landslide activity in the area has caused a reduction of, or lack of, proper utilization of the area to such an extent that it constitutes a serious physical, social, and economic burden on the City. In three of the last five years, assessed values in the area have actually decreased. The disproportionate amounts of City funds spent on the constant repairs to Palos Verdes Drive South are well known. There are 269 homes in the Project Area which are in active landslide areas. Of those, 142 have been either destroyed, abandoned,, or relocated because of damage caused by the landslide. The conditions existing in the Project Area are described in greater detail in the report to Council. He went on to say that the nature and scope of the projects to be undertaken by the.Agency pursuant to the Redevelopment Plan, are. limited to improvements designed to abate landslide activity and the reconstruction or relocation of Palos Verdes Drive South. City Manager Guluzzy requested that the Report to Council by the Agency (contained in a binder which was before each of the Council and Agency menmbers) and the Declaration of Marshall Linn, which was a part of the agenda packet, be made a part of the record of this meeting. COUNCIL 3� 11/20/84 #702---B12 Responding to the Mayor's call for public testimony were the following individuals: Franklyn Weiss, representing the Rancho Palos Verdes Council of Homeowners Associations, expressed that organization's support for the Redevelopment Agency. John McCarthy, President of the Portuguese Bend Lease Holders Association, also.expressed support from that organization. June Dunbar, 83 Spindrift Drive expressed her support for the Redevelopment . Agency. Connie Sandifer, an attorney representing the ALPHA group, a group. of 32 homeowners in the Project Area, cited the support from those residents for the Redevelopment Agency. Robert Such, 11 Cinnamon Lane talked about the general concern of residents in the area and how the Agency should be sensitive to those concerns. Florence Smith inquired about future development in the area that would be allowed under.the Redevelopment Agency. Sheila Hoff, representing the League of Women Voters, requested clarification alternatives as cited in the Environmental Impact Report. Bill Griffin, 5 Ginger Root Lane, representing a group of 32 homeowners in the area, reaffirmed his support for the Agency. He also spoke about the effects of the slide on the tidal area. Ludwig Zelt , Chairman of the Klonkide Canyon Landslide Abatement District, said he.felt the Council was taking positive action in forming this agency.for the stabilization of the area. Cathy Snell, 8 Vanderlip Drive, read.a prepared statement in opposition to the Redevelopment Agency. This letter is on file with the City Clerk's office and was made a. part of the record of the hearing. Joseph McLaren, 3923 Palos Verdes Drive South, questioned the financial plan for the Agency and expressed his concern. about Palos Verdes Drive South reconstruction. He also questioned some definitions of the plan. Representing the County of Los Angeles was Chief Deputy County Counsel Tighe Hudson. He questioned the Fact Sheet prepared for the hearing and inquired if it had been entered into the administrative record. Citing the 180 million dollars.in tax increment that would be collected by the Agency over the next 40 years, he commented that 120 million would otherwise be allocated to the County of Los Angeles, the Flood Control District and the Consolidated Fire Protection District, Since formation of this Agency was considered implementation of extraordinary power, and since state law narrowly defined the parameters for such implementation, he questioned what specific section of the Community Redevelopment law.was being invoked to authorize this project. Additionally, he questioned the economic feasibility of the project. He commented that he had just received the Agency Report to Council and that it did not contain a copy of a letter from the City Manager to the Chief Administrative Officer. ..With regard to assessed valuation of the property, he said it was now estimated to exceed 22 million dollars. City Manager Guluzzy stated that the Agency does not intend to implement all projects at once. Projects will be undertaken only as financing becomes available. The Agency anticipates using combinations of grants, loans, and tax increments to finance the various projects contemplated by the Plan. The Agency is aware that the Landslide Abatement Districts are continuing to finance improvements to abate the landslide activity through special assess meets. It is anticipated that the. total cost of all projects will be approx--- imately $45,000,000. The limitations on bonded indebtedness and the taxes to be allocated to the Agency were placed into the plan with that in mind, and with cost of financing $45,000,000 improvements together with improving or increasing the City's supply of affordable housing. The Report to Council COUNCIL 4 11/20/85 #702-t--B13 contained certain letters that the Agency received as a result of consultations with taxing agencies.on the Redevelopment Plan and the allocation of taxes. He went on to say that he proposed to add a summary to the report of the efforts by staff to solicit from taxing agencies in October of this year their advise and opinions regarding the allocation of taxes,. The responses received are included in the report to City Council. Mr. Guluzzy requested that this summary be added to the report and be made a part of this hearing. MAYOR BACHARACH SO ORDERED* Stating that the fact sheet and summary referred to earlier was prepared under_ Mr. Guluzzyis direction, City Attorney Strausz stated that it should be corrected as follows: "the Agency staff, based on extensive geotechnic, engineering, legal and fiscal research, is.of the opinion that" City Attorney Strausz requested that this fact sheet be made a part of the record. MAYOR BACHARACH SO ORDERED. Mayor Bacharach declared the public hearing closed. City Attorney Strausz summarized the revised Redevelopment Agency resolution. Council then discussed Paragraph A, Section 1, and in particular the sentence dealing with the social and economic goals and objectives of the project. Councilman McTaggart moved, seconded by Councilman Ryan to amend that sentence as follows: "The social and economic goals and objectives of the Project Area may not be achieved without the construction of such new housing because there is a need for housing The motion carried on a 4 0 vote, with Councilman Hinchliffe abstaining. City Attorney Strausz presented the revised Redevelopment Plan resolution for Council adoption and cited the addition of the same Section 7 to this resolution. It was the consensus of Council to make the same amendment to this proposed resolution and that'the word "cannot" be struck and that the words "may not be inserted in Section 1, Paragraph A. Councilman McTaggart moved, seconded by Councilman Ryan to ADOPT RESOLUTION NO. 84---73 as amended and as presented by the City Attorney, The motion carried on a 4 0 vote, with Councilman Hinchliffe abstaining. ORDINANCE NO . 190 OF THE CITY OF RANCHO PALOS VERDES ADOPTING ,A REDEVELOPMENT PLAN AS THE OFFICIAL REDEVELOPMENT PLAN FOR PROJECT AREA N0. 1 was - introduced by title. Councilman McTaggart moved, seconded by Councilman Ryan to waive further reading and INTODUCE ORDINANCE N0. 190. The motion carried oat a' 4�0 vote with Councilman Hinchliffe abstaining. RECESS AND At 9:00 P.M. Mayor Bacharach adjourned the RECONVENE Redevelopment Agency to November 27, 1984 at 7:00 P.M. and declared a brief recess. At 9:15 P.M. the meeting of the City Council reconvened. CITY COUNCIL REPORTS: Peninsula Transportation Committee: Mayor Bacharach reported on the meeting of the Peninsula Transportation Committee where it COUNCIL 11/20/84 #702SB14 was concluded that they would meet with the RTD and discuss their modification in fares and any impact on our service. A brief discussion ensued about the makeup of the Transit Advisory Committee and, if representatives from other cities will be on the Committee, whether it should stay at five or if member ship should be increased. It was concluded that the appointment procedure for the Committee should be reviewed in January, 19850 . Cable TV: The Ordinance for Cable Television will be on the December 4 agenda. General Plan Amendment Tni fii afii nn Citing his concern for the sensitivity of the coastal bluff areas, Councilman Ryan requested that the Council consider authorizing staff to conduct a study to review the zoning of the coastal bluff areas* A brief discussion ensued regarding the drainage problems in the City and in particular in that area and whether or not those drainage problems had adequate controls.
