CC MINS 19851119M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING NOVEMBER 19, 1985 The meeting was called to order at 7:30 P.M. by Mayor McTaggart at the Fred Hesse Community Park Center, 29301 Hawthorne Boulevard. Following the pledge of allegiance roll call was answered as follows: PRESENT: HINCHLIFFE , BACHARACH , RYAN , HUGHES , & MAYOR McTAGGART Also present were City Manager Donald F. Guluzzy, City Attorney Steve Dorsey, Environmental Services Director Sharon W. Hightower, Public Works Director George Wentz, Community Services Director Tom Bandy, and City Clerk Jo Purcell, CEREMONIAL MATTER - Mayor McTaggart presented a Procla- JENNIFER BOLTON mation to Jennifer Bolton thanking (304) and commending her for her leader- ship and personal involvement as a member of the Citizen Advisory Com- mittee for the South Coast Project. WAIVER OF FULL READING OF ORDINANCES Councilman Ryan moved, seconded by AND RESOLUTIONS Councilman Hughes and carried, to waive reading in full of all ordi- nances and resolutions adopted at this meeting with consent to waiver of reading deemed to be given. by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. APPROVAL OF AGENDA The City Clerk announced the addi- tion of the following: Recycle Cen- ter ( Bacharach), Tree Removal Per- mits (Ryan), Trail No. 6 (City Mana- ger), and P.V. Transit Holiday Ser- vice ( City Manager) . The Agenda as amended was adopted on Motion of Coun- cilwoman Bacharach, seconded by Councilman Hinchliffe and carried. November 19, 1985 MINUTES ORDINANCE NO. 195 - REVISING REGULATIONS FOR SOLICITATION ( 20 2 ) ESCROW INSTRUCTIONS - DAUNTLESS DRIVE LOT (1411) TRACT N0. 38848 - RELEASE OF BOND (1411) FINAL TRACT MAP NO. 40640 - APPROVAL (1411) CIVIC CENTER SITE - PROPOSAL FOR APPRAISAL RESOLUTION N0. 85 -67 - REGISTER OF DEMANDS Approved minutes of October 15th, 28th and 29th. Waived further reading and ADOPTED ORDINANCE N0, 195 OF THE CITY OF RANCHO PALOS VERDES REVISING REGULA- TIONS FOR SOLICITATION AND AMENDING THE RANCHO PALOS VE RDE S MUNICIPAL C ODE . Accepted and authorized Mayor and City Clerk to sign the proposed escrow instructions and amendment as a preliminary step in completing the sale of the Dauntless Drive lot to the General Telephone Company. Accepted the cash payment received as the replacement for Faithful Per- formance Bond No. 02850. Approved the final Tract Map. Approved and authorized Mayor and City Clerk to sign agreement for appraisal not to exceed $5,000. ADOPTED RESOLUTION NO. 85 -67 OF THE CITY OF RANCHO PALOS VE RDE S ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH SAME ARE TO BE PAID, The motion to approve the Consent Calendar carried on the following roll call vote: AYES: HINCHLIFFE , BACHARACH , RYAN, HUGHES , AND MAYOR MCTAGGART NOES: NONE ABSENT: NONE 704CP /MIN1.1 -8 -2- November 19, 1985 PUBLIC HEARING - TENTATIVE PARCEL Mayor McTaggart opened the public MAP N0. 16748 (1410) hearing on this matter, the City Clerk reported that notice had been duly given, and the City Manager presented the staff recommendation to approve this Tentative Parcel Map No. 16748 in concept and direct the staff to prepare a resolution of appro- val with appropriate conditions of approval. He reported that the Planning Commission recommended denial of this parcel map. Representing the applicant in this matter was his attorney John Mercant, 1706 Camino de la Costa, Redondo Beach, who stated that he felt the fif- teen foot easement was adequate. He described the configuration of the lots and how the present design is the only viable one for this parcel. He said his client is willing to take the garage out to allow access to the flood control project. Speaking in opposition to this development were the following residents of the area: Anthony Sosa, 28909 Gunter Road; Scott Lindsay, 28825 Gunter Road; and Robert Downing, 1914 Caddington. These residents expressed con- cern about the drainage problem in the Canyon, the increased run -off that this development would create, and questioned whether the flooding aspect has been investigated. There being no additional public testimony, the Mayor declared the public hearing closed. Council then questioned if the Flood Control District had expressed any concern about-this area, and the amount of communication that staff has ` had with them. Council comments included concern about the fact that this neighborhood was developed a number of years ago and that this project will add an additional three homes in the cul -de -sac area. Additionally, con- cern was expressed about the potential drainage problems and if they had been investigated- thoroughly and the fact that there would be no buffer between, the house and the proposed -driveway. Councilman Hinch 1 i f f e moved, seconded by Councilman Ryan and carried to deny the appeal and instruct staff to prepare a resolution of denial. ORDINANCE NO* 196 - CABLE TV FRANCHISE (605) City Manager Guluzzy presented the staff memorandum-of November 19, and the recommendation to adopt the pro- .posed ordinance granting a cable television franchise to Times Mirror Cable Television of Palos Verdes Peninsula , Inc. After Council request to include the annotation on the contribution for- mula, .:and the deletion of specifically named entities on Exhibit "D ", ORDI- NANCE NO 196 OF THEE CITY OF RANCHO PALOS VERDES GRANTING A FRANCHISE FOR A CABLE TELEVISION SYSTEM TO TIMES MIRROR CABLE TELEVISION OF PALOS VERDES PENINSULA, INC. was presented by title. Councilwoman Bacharach moved, seconded by Councilman Hughes and carried to waive further reading and INTRODUCE Ordinance No. 196. 704CPIMIN1.1 -8 -3- November 19, 1985 Council requested that a letter be sent to all of the entities listed under Exhibit "D" explaining to them the institutional drops that are now avail- able or will become available with this franchise agreement. COMMITTEE AND COMMISSION City Manager Guluzzy presented the APPLICATION (106) November 19th staff memorandum and recommended that Council set a date to interview the applicants for Com- mittee and Commission appointment. Councilwoman Bacharach moved, seconded by Councilman Hughes and carried to suspend interviews for7 the Parks and Recreation Committee and evaluate their role within the next quarter. It was the consensus of Council to extend the deadline for the advertising of Committee and Commission vacancies to December 3rd and to interview the candidates on December 9th at 7:00 P.M. Staff was instructed to issue a press release on this matter. REVENUE ALTERNATIVES City Manager Guluzzy reviewed the (602) utility user tax surcharge on resi- dential and commercial utility bills and the amount of revenue generated from a one -half percent to a five percent charge on bills. Representing General Telephone was Kevin Petersen, Customer Relations, who told the Council that his company collects a utility tax for the cities of Hermosa'Beach and Palos Verdes Estates. A brief discussion ensued regarding the Gann limitation on revenue raising, imposing a parcel tax, and the number of parcels in the City. Council requested that staff provide them with information on the maximum amount that can be raised within this limitation and the amount of revenue that could be raised from a parcel tax. PUBLIC WORKS CONTRACT - CHARLES City Manager Guluzzy presented the ABBOTT ASSOCIATES (1204) November 19th Staff Memorandum and recommended that Council authorize the Mayor and City Clerk to sign a contract with Charles Abbott Asso- ciates (CAA) for fiscal year 85 -86 for a not to exceed amount of $696,028. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe to adopt the staff recommendation. The motion carried on the following roll call vote: 704CP /MIN1.1 -8 -4- November 19, 1985 -AYES: HINCHLIFFE , BACHAR-ACH--, RYAN.,- HUGHES-, AND MAYOR MCTAGGART .,N OES : NO ABSENT:: = NONE HIGHRIDGE ROAD PROJECT City Manager Guluzzy presented the (112) (1404) November 19th staff memorandum and recommended that the City contribute $20,000 to the proposed Highridge Road improvements and bypass pro - ject. Council questioned whether the City will be able to recover any of these costs since this area will be improved in the future and since this project will benefit the future development. Additional comments disclosed the fact that this property is now in, the process of _being sold for a sub- division. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe to approve the expenditures of funds,The motion carried on a 4 -1 vote with Councilman. Hughes -voting - in _ oppos i t ion . It was the consensus that the City Attorney would review the statute re- quiring -thee owner of the property to participate in these improvement costs* RECESS - RECONVENE At, 9:00 P .M: the Mayor declared a recess:, The meeting_ reconvened at 9:15 P.M.. SITE PLAN REVIEW NO., -.3378 LA VISTA VERDE DRIVE (1801) City - Manager Guluzzy presented the November 19th staff memorandum and recommended denying the applicants request to allow an existing storage building to remain within an open space hazard zone. The applicant in this matter, Mr. Joseph Kubicek, 18 La Vista-Verde, cited the approval that he received from the County of Los Angeles to install the tennis court and the lights. Council discussion of this matter revealed than --no electrical- permit was issued for installation of the lights. Further discussion disclosed that members of Council wanted to visit the site. Councilwoman - Bacharach moved, seconded by Councilman Hinchliffe and carried to continue this matter to the next meeting and that- Mr. Kubicek coordinate with staf f for Council to visit the project area. - SALARY RANGE ADJUSTMENTS (1202) Mayor McTaggart and Councilman Hinchliffe summarized their meetings with staff to discuss the issue of salary ;,ranges. Council then 704CP /MIN1.1 -.8 -5- November 19, 1985 discussed how frequently the salary ranges should be reviewed and how the internal adjustments on these ranges would be handled, It was the consen- sus of Council that they would like to see the data used in calculating these ranges. Councilwoman Bacharach moved, seconded by Councilman Hinch- liffe and carried to adopt in concept the salary ranges presented by the City Manager and that staff prepare a resolution for the December 3rd meeting for implementation of-these ranges. SUBCOMMITTEE REPORTS Transportation - Councilwoman Bacharach reported on a RTD meeting to be held in the City of Hawthorne on December 4th to discuss the service to cities within the South Bay Corridor. She requested that a staff member be present at that meeting. Post Office - Councilman Ryan reported on the subcommittee's (Ryan and McTaggart) meeting had with representatives of the post office during which they discussed the slow delivery into the 90717 and 90732 zip code areas within the City.. At the conclusion of that meeting it was decided to hold a meeting with the Postmasters of the Cities of Lomita, San Pedro, and the Palos Verdes Peninsula and a representative from Congressman Lungren's office. This meeting will be held sometime in January, 1986. After fur- ther discussion of the postal service it was the consensus that the Commu- nity Services Director should continue with the test letters; Council re- quested a copy of the results, Landslide - Councilman Hughes briefly reported on his attendance at a League of California Cities seminar to discuss Redevelopment Agency law. Rental Housing - Councilman Ryan reported on the sub - committee (Ryan /McTag- gart) meeting with tenants of the Palos Verdes Apartments. The tenants have formed an association, have elected a board of directors, and will negotiate with the landlord to arrive at some reasonable rent increases. Legislation - Mayor McTaggart reported on a letter received from Assembly- man Felando regarding a meeting to be held at the Torrance City Hall on December 11th. The subject to be discussed is AB 2198 - Surplus School sites. Staff was requested to call and schedule a time certain for the Mayor's testimony at this meeting. Recycle Center Referring to a letter received from the Recycle Center regarding its relocation, Councilwoman Bacharach moved, that a letter be sent to the City of Rolling Hills Estates indicating the City's support of a Recycle Center on the Peninsula. The motion was seconded by Councilman Hinchliffe and carried. Staff was directed to send a copy of that letter to the Recycle Center and to the AAUW. Tree Removal Permit - It was reported that a resident not in the median adjacent to their home, Councilman staff investigate this matter and that staff devise people requesting tree trimming permit certify that the are within their purview. trimmed City trees Ryan requested that some means whereby trees to be trimmed 704CP /MIN1.1 -8 -6- November 19, 1985 CITY.-MANAGER - REPORTS False Alarm Ordinance - The City Attorney summarized a meeting held with the District Attorney's Office, the Sheriff and the City Manager to discuss the -- enforcement problems experienced with this ordinance. Two problems exist 1(1) Development of a mechanism to collect the penalties imposed; and (2) Determination of how strictly the City Council wanted this ordi- nance enforced. Representing the Sheriff's Department was Captain Elmer Omohundro who dis- cussed the number of false alarms received and the cost incurred by respon- ding to those alarms. It was agreed that the Public Safety Committee (Hughes /McTaggart) should meet and discuss the issues involved in this false alarm ordinance. Trail No. 6 - Del Cerro Tract - City Manager Guluzzy presented the November 6th Staff Report and recommended that no further action be taken on implementing this Trail behind the Del Cerro Tract. Responding to the Mayor's call for public testimony was Sunshine, 6 Lime - tree, who said that the Horseman's Association supported the staff recom- mendation. Councilwoman Bacharach moved, seconded by Councilman Ryan and carried to adopt the staff recommendation. P.V. TRANSIT HOLIDAY SERVICE City Manager Gulu zzy presented the (1505 ) November 19th staff memorandum and recommended that Council authorize extending the evening service on P.V. Transit on New Year's Eve, Councilwoman Bacharach moved, seconded by Councilman Ryan to provide extended service until 3:00 A.M. on New Year's Eve at a cost not to exceed $600. The motion carried on the following roll call vote: AYES: HINCHLIFFE , BACHARACH , RYAN , HUGHES, AND MAYOR McTAGGART NOES: NONE ABSENT: NONE Council requested that the extended service be advertised in the Palos Verdes Peninsula News. TRAFFIC SIGNS - NON - REGULATORY SIGNS (1503) 704CP /MIN1.1 -8 Public Works Director Wentz summa- rized the discussion at a Traffic Committee meeting whereby the Committee requested Council direc- tion on whether or not nonregulatory signs such as "No Littering" and "No Dumping" signs be posted. -7- November 19, 1985 It was the general opinion of Council that if staff saw the necessity for such signs then it would be permissable to erect them.
