CC MINS 19851106M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING NOVEMBER 6. 1985 The meeting was called to order at 7 :30 P.M. by Mayor McTaggart, at the Fred Hesse Community Park Center, 29301 Hawthorne Boulevard.. Following the pledge of allegiance roll call was answered as follows: PRESENT: HINCHLIFFE , BACHARACH , RYAN, HUGHES, & MAYOR McTAGGART Also present were City Manager Donald F. Gulu zzy, City Attorney Steve Dorsey, Environmental Services Director Sharon W. Hightower, Public Works Director George Wentz, Community Services Director Tom Bandy, and City Clerk Jo Purcell. WAIVER OF FULL READING OF ORDINANCES Councilwoman Bacharach moved, AND RESOLUTIONS seconded by Councilman Hughes and carried, to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. APPROVAL OF AGENDA The City Clerk announced the addi- tion of the following: Cab le TV negotiations (Hughes), film permits (Ryan), and Holiday Transit (Bacha- rach). The matter regarding side- walk schedule and correspondence was removed from the Consent _Calendar to be discussed at the end of the meeting. Couniilman Hughes moved, seconded by Councilman Hinchliffe and carried to apporve the agenda as amended. CONSENT CALENDAR ORDINANCE N0. 194 - MISCELLANEOUS REVISIONS (1801) The Consent Calendar was approved as follows on motion of Councilman Hinchliffe, seconded by Councilwoman Bacharach : ADOPTED ORDINANCE NO. 194 OF THE CITY OF RANCHO PALOS VE RDES MAKING MISCELLANEOUS REVISIONS TO THE DEVELOPMENT CODE AS CODE AMENDMENT N09 20 AND AMENDING THE RANCHO PALOS 703CP /MIN15.1 -7 -1- November 6, 1985 VERDES MUNICIPAL CODE. (This ordinance was reintroduced at the October 15, 1985 meeting and was originally introduced at the August 20, 1985 City Council meeting.) REJECTION OF CLAIM - I . ERIC Rejected the claim and directed the RANDALL (303) City Clerk to notify the claimant of Council's action. PEDESTRIAN PATH - MINOR AMENDMENT (1) Authorized staff to send the TO TRAILS NETWORK PLAN (701) proposed letter to the City of Palos Verdes Estates regarding the pedes- trian path from Crest Road to Via Victoria. (2) Initiated a minor trails network plan amendment, MIRALESTE GUARD RAIL - LANDSCAPING Authorized the Public Works Depart - (1201) went to provide $800 to Miraleste Parks and Recreation District for landscaping the guardrail in the Miraleste median. F.A.U. PROJECT - PALOS VERDE S DRIVE SOUTH (1404) B IKEPATH - PROJECT APPROVAL (112) AMBULANCE SERVICE AGREEMENT (801) D .0 . I . ENFORCEMENT - HOLIDAY PROGRAM (15 0 2 ) Directed staff to proceed with in- corporating a Class II in lieu of a Class I bikeway' into the Palos Verdes Drive South /West Project. Authorized the Public Works Depart- ment to proceed with the design and construction of Class I and II pro- jects along both sides of Crest Road from Crenshaw to Hawthorne. Approved an Agreement with Goodhew Ambulance Service, Inc . and author- ized the Mayor and City Clerk to execute this agreement on behalf of the City should the temporary re- straining order against the City be 1 i f t ed by the Court on November 7, 1985. Approved the City's participation in the Regional Holiday D.U.I. Enforce- ment Program. 703CP /MIN15.1 -7 -2- November 6. 1985 RESOLUTION N0. 85 -66 — REGISTER Adopted Resolution No. 85 -66 of the OF DEMANDS City Council of the City of Rancho Palos Verdes allowing certain claims and demands and specifying funds from which the same are to be paid. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: HINCHLIFFE, BACHARACH, RYAN, HUGHES, & MAYOR McTAGGART NOES NONE PUBLIC HEARING VARIANCE NO. 121 - APPEAL Mayor McTaggart opened the Public (1804) Hearing on this appeal of the Plan - ning Commission's denial for a vari- ance to allow an illegally converted garage. The City Clerk reported that notice of this public hearing had been duly published and no written protests were received by the City. Staff recommended dismissal of this appeal. City Manager Guluzzy presented the November 6th Staff Report. Responding to the Mayor's call for public testimony were the following residents: Applicant Joey Schaefer, 20523 Cartier Drive, who, citing the financial loss of reconverting this cabana back to a garage, requested that Council grant a variance to allow the improvements to remain. Also speak- ing in support of allowing this variance were Sabina Dorn, 30605 Cartier, Dick Jones, 6644 Lautrec, and Fred Eaton, 30615 Cartier Drive. All of these speakers indicated that they were residents of the same neighborhood and said they had not seen anyone live in the converted garage, nor had they noticed any impact upon the neighborhood. Speaking against the variance was Stanley Mucha, 5538 Littlebow Road. Council then commented on the fact that allowing such a variance might affect the ability to enforce zoning applications in the future, how this variance had the appearance of being a "Granny flat", and if it actually could meet the required findings to allow a variance. Councilwoman Bacharach moved, seconded by Councilman Hinchliffe to dismiss the appeal. The motion carried unanimously. The applicant was advised that the improvements must be removed, that she can apply for an application to provide a garage, and that she has thirty (30) days to remove the improvements in the garage. 703CP /MIN15.1 -7 -3- November 6, 1985 REVENUE RAISING -MEASURES - ADMISSIONS TAX (602) City Manager Guluzzy presented charts showing the flat rate admis- sion starting at 5(,% and going as high as 25r,-. Additionally, the chart showed the revenues raised from a percentage admissions tax with a rate as low as 5% going up to 25%0 In response to Council's question about who an admissions tax could be levied against in addition to Marineland, it was stated that staff is checking the possibility of an admissions tax for the county golf course. Representing Marineland was John Corcoran, Vice President and General Mana- ger. He stated his concern for the City's financial position, but ques- tioned the wisdom of applying an admissions tax to Marineland which has just recently reversed a downward trend in attendance at the park. He sum- marized the community activities that Marineland supports and participates in and cited the contribution made to the community in the way of employ- ment, and in the road improvement on Palos Verdes Drive west adjacent to their property. In response to Council's inquiry about improvements at Marineland, he stated that it is their hope to present plans to the City for such improvements by July, 1986. He said that he would provide the City Council with the history and pricing structure of admissions to Marineland. Speaking in opposition to an admissions tax was Luddy Zelt, 4354 Exultant Drive, who said that the City should consider a broader base revenue rather than imposition of an admissions tax. City Manager Guluzzy summarized what the next phase of discussion of reve- nue raising measures would be: At the November 19th meeting, the discus- sion will cover utility tax; on December 3 the refuse franchise fee will be discussed. It was the consensus of Council to have some publicity on these upcoming revenue raising issues. ORDINANCE N0. 195 - SOLICITATION City Manager Guluzzy presented the (20 2) October 1 s t Staff Memorandum and recommended that Council consider adoption of this ordinance to regu- late solicitors in various ways: No solicitations permitted between the hours of 10:00 P.M. and 7:00 A.M., no solicitation permitted if a resident posts a "No Solicitations" or similar sign, no solicitor should touch or otherwise harass any person being soli- cited. Council discussed the hours during which solicitation was prohibited and it was the consensus to prohibit solicitation between the hours of 9:00 P.M. and 8:00 A.M. Councilwoman Bacharach moved, seconded by Councilman Ryan to WAIVE FURTHER READING AND INTRODUCE ORDINANCE NO. 195. The motion carried unanimously, 703CP /MIN15.1 -7 -4- November 6, 1985 RECESS TO CLOSED SESSION AND RECONVENE City Attorney Dorsey announced that tial litigation and also discussed was taken. TRANSIT ADVISORY COMMITTEE RECOMMENDATIONS (1505 ) At 9:00 P.M. the Mayor declared a brief recess. At 9:15 P.M. the meeting reconvened and immediately recessed to a closed session. At 9 :32 P.M. the meeting reconvened. Council discussed two matters of poten- the status of the Horan case. No action City Manager Guluzzy presented the November 6th Staff Memorandum con - taining the Committee's statement of goals, logo selection for Palos Verdes Transit, and Transit Guide for public transit services on the Peninsula. Representing the Transit Advisory Committee was its Chairman Margaret Blue who briefed the Council on the background of these goals, the Palos Verdes Transit logo, and the revised Palos Verdes Transit brochure that would com- bine the Peninsula Dial -A -Ride information with that of Palos Verdes Transit. During Council discussion of these recommendations concern was expressed about what constitutes a quorum and what would happen in the event that a member from one of the cities was absent. The suggestion was made that if such a meeting was held and no quorum was present, the Council would be notified. Additional discussion centered on the advisability of having a year -round satellite stop at Pacific Coast Highway and Crenshaw - Boulevard. Council also requested that Harbor General Hospital be added to the list of hospitals served by the Transit service. Councilwoman Bacharach moved, seconded by Councilman Hinchl i f f e to approve the Transit Advisory Committee's recommendations. HOLIDAY TRANSIT. SERVICE Citing. the fact that the Dial -A -Ride (1505) could be available until - two or three in the morning on New Year's Eve, and questioning the cost in- volved in providing such a service, Councilwoman Bacharach moved, seconded by Councilman Hughes to refer the matter of New Year's Eve service to the Transit Advisory Committee for their investigation into the cost. It was the consensus that this idea would be presented to the other representatives on the Committee. If the other cities do not agree to go along with - such an arrangement it was decided that Rancho Palos Verdes would-go ahead with it anyway. CITY COUNCIL REPORTS Report on Rental Housing - Councilman Ryan reported that the subcommittee will be meeting with the landlords of the Palos Verdes Apartments on Friday. Another meeting is scheduled for Saturday at the Palos Verdes 703CP /MINI -5.1 =7 -5- November 6, 1985 Apartments at 10:00 A.M. He reported that they met with the Porto Verde attorney and that they have put a thirty ( 30 ) to sixty ( 60 ) day moratorium on rent increases and will be meeting with each tenant to negotiate their needs. The subcommittee has met with the owners of the Porto Verde Apart- ments twice and with the management of the Palos Verdes Apartments once. It is the City Council's intent to obtain voluntary agreement on the issue of rent increases. Pam Foreman, 6756 Los Verdes Drive, #3, expressed her appreciation for the Council's action in this matter, but also expressed concern for the lack of security at the apartments. She said that some of the rent increases had been rescinded. Ronald L. Howard, 6764 Los Verdes Drive, #5, suggested that any pressure had been put on the - tenants during the negotiations on the rent increases. (605) Cable TV Negotiations - Citing the fact that negotiations are still going on, Councilman Hughes moved, seconded by Councilwoman Bacharach, to extend the franchise negotiations to November 19th. Motion carried. Film Permits - - Citing inquiries that-,he had received from residents in the Ladera Linda area regarding parking problems and the inconvenience result- ing from film crews, Councilman Ryan suggested that a system be investi- gated whereby spectator permits could be issued so that people could view the filming on sets. Additionally, residents inquired whether it would be possible for the film crews to post the name of the film being made and some indication as to when it might be aired on television. It was the consensus that the film task force would look into these sugges- tions. Additional discussion of filming disclosed that when filming is done in adjacent cities that provisions. be made for parking of the crews in- the cities where the filming is taking place. It was the consensus that a letter be sent to the City of Palos Verdes-Estates requesting their com- pliance, CITY MANAGER REPORTS (604) Seacliff Drain - City Manager Guluzzy Memorandum and recommended approval of Drain pending receipt of a commitment construct the Via Lorado Drain, presented the November 6th Staff the construction of the Seacliff from the County of Los Angeles to Councilman Hughes moved, seconded by Councilman Ryan and carried to adopt the staff recommendation. Representing the County of Los Angeles was Leah Jeffries, Deputy to Super- visor Dean Dana, who responded to Council's question about the Seacliff Drain being scheduled ahead of the Via Loredo Drain since it was felt that the latter was more. critical. Miss Jeffries indicated that funds could probably be committed for this project within the next two or three weeks. ITEMS REMOVED FROM THE CONSENT CALENDAR Sidewalk Schedule and Correspondence - After review of the revised corre- spondence going out on the4 sidewalk matter, Councilwoman Bacharach moved, seconded by Councilman Ryan and carried to approve the revised correspon- dence. 703CP /MIN15.1 -7 -6- November 6, .19.85 Via Colinita Traffic Survey - City Manager reported that additional funding was needed for the continued traffic enforcement on Via Colinita. It was the consensus that the City Manager should find out what the trend in vio- lations is in this area and report back to the City Council in the near future.
