CC MINS 19850903M I N U T E S RANCHO PALOS VE RDES CITY COUNCIL REGULAR MEETING SEPTEMBER 3 , 1985 The meeting was called to order at 7:30 P.M. by Mayor McTaggart at the Fred Hesse Park Community Center, 29301 Hawthorne Boulevard. After the pledge of allegiance to the flag, roll call was answered as follows: PRESENT: HINCHLIFFE, BACHARACH, RYAN, HUGHES & MAYOR McTAGGART Also present were City Manager Donald F. Guluzzy, Environmental Services Direc- tor Sharon W. Hightower, City Attorney Steve Dorsey, Director of Public Works Charles Abbott, and City Clerk Jo Purcell. RECESS TO CLOSED SESSION & At 7:35 P.M. the meeting recessed RECONVENE to a closed session for discussion of the Horan, et al. case. At 7:57 P.M. the meeting reconvened with no action taken. WAIVER OF FULL READING OF ORDINANCES Councilwoman Bacharach moved, AND RESOLUTIONS seconded by Councilman Hinchliffe and carried, to waive reading in full of all ordinances and resolu- tions adopted at this meeting with consent to waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolution. APPROVAL OF AGENDA The City Clerk announced the following changes to the agenda: Ordinance No. 194 would be removed from the Consent Calendar and dis- cussed at the end of the meeting; an item regarding legislation was added under City Council reports. The amended agenda was approved on motion of Councilwoman Bacharach, seconded by Councilman Hinchliffe and carried. CONSENT-CALENDAR MINUTES Approved the minutes of July 30, August 6 Adjourned Meeting and Regular Meeting, August 12 Special Meeting, and August 20 Adjourned Meeting and Regular Meeting. 703CP /MIN.18.1 -7 -1- September 3, 1985 RESOLUTION N0. 85 -53 ADOPTED RESOLUTION N0. 85 -53 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VE RDE S ALLOWING CER- TAIN CLAIMS AND DEMANDS AND SPECI- FYING FUNDS FROM WHICH THE SAME ARE TO BE PAID, PARK MAINTENANCE CONTRACT - Authorized the Mayor and City FISCAL 1985 -86 (1201) Clerk to sign a contract with Four Star Landscape to maintain the parks and Civic Center grounds for Fiscal Year 85-86, total amount of contract is $101,880. ENVIRONMENTAL SERVICES (1) Awarded the contract to A.J. PUBLIC WORKS BUILDING Fistes Painting Company to paint (1204) the Environmental Services /Public Works & Recreational Services building. ( 2 ) Approved addi- tional $5,500 for operating- and maintenance budgets to finance this project. CLAIM AGAINST THE CITY - Rejected the claim and directed MARK PALMER City Clerk to notify the claimant ( 303 ) of the Council's action. PROJECTS = DESIGN Approved the agreement with Mohle , AGREEMENT (1404) Grover Associates to perform pre- liminary engineering and to pro- vide plans, specifications, and construction cost estimates for City -wide collector sign4!lpgrading and for Palos. Verdes Drive East curve numbers 2, 10 , 11, and 12. , RESOLUTION NO. 85 -54 - ISLAND VIEW VISION SAFETY ZONE (1502 ) ADOPTED. COUNTY SOLID WASTE Received and filed correspondence MANAGEMENT PLAN (140.2) dated August 14, 1985 from the Los Angeles County Department of Pub- lic Works regarding revisions to the proposed March 1984 update of the Los Angeles County Waste Man- agement Plan, RESOLUTION NO. 85 -55 - ADOPTED RESOLUTION N0, 85 -55 OF VARIANCE NO. 118 THE CITY COUNCIL OF THE CITY OF (1804 ) RANCHO PALOS VERDES APPROVING VAR - IANCE NO. 118 SIDEWALK REPAIR AND THEE In response to the Mayor's call REMOVAL POLICY (1405) for public testimony were the following residents of the City: Dick Hallsted 7011 Maycroft, and Jane Felland, 5558 Shoreview Drive. They requested clarification of the area that the homeowner is respon- sible,'-for intaining and questioned the policy which had previously ""pe-fmifted payment of the'tree removal by the City and not the residents. Council then proceeded to discuss the sidewalk repair and tree removal and re- placement policy. During that discussion the following changes were made to the proposed policy: 1. As each sidewalk area of the City is inspected, all Italian Stone Pines and other species known to cause serious damage to City sidewalks shall be removed. As these areas are inspected, any tree that is causing damage to the curb, gutter, or street shall alsso'be removed, even if it is not an Italian Stone Pine or other species. Motion made by Council - woman Bacharach, seconded by Councilman Ryan and carried. 29 This will be a two -year program in the two -year budget and appropria- tions are to be made as necessary to fund the removal of these problem trees in all areas. The funds will come from the City Hall acquisition fund in an amount not to exceed $200,000. There will be no payment plan. on the removal of trees. Motion made by Councilwoman Bacharach seconded by Councilman Ryan and carried, 30 Amended to include that the formal agreement between the property owner and the City be designed in a recordable format. Motion made by Councilwoman Bacharach, seconded by Councilman Hughes and carried. 90 Added Section D to cover vertical displacement for driveway aprons. Added Section E to cover four (4) inch lift on ramped sidewalks. Added that the property owner pay the standard building permit fee. Motion made by Councilman Hinchliffe, seconded by Counci lmanr Hughes- and carried. 11. Added a cap of $150 administrative fee. Motion made by Councilman Hinchliffe, seconded by Councilman Ryan and carried. 12. Added payment in arrears will be subject to standard lien process. Motion made by Councilwoman Bacharach, seconded by Councilman Hinch- liffe and carried. 13. Amended to permit the monthly payment plan for amounts of $500 or grea- ter. Motion made by Councilman Hughes, seconded by Councilman Hinch- liffe and carried. 14. Deleted (with previous motion). 16. Add Section B: staff person as contact; and Section C: one -half of the City's estimate or property owner's payment (with proof of pay- ment) whichever is less. RECESS AND RECONVENE At 10:15 P.M. the Mayor called a brief recess. The meeting recon- vened at 10:25 P.M. AUDIENCE QUESTIONS - GEORGIA CLARKE, Mrs. Clarke presented a fire peti- 26157 BARKSTONE DRIVE (603) tion signed by the Homeowners of Barkstone Drive. This petition expressed their concern for the fire condition they feel exists in the undeveloped City property situated directly west and adjacent to Barkstone Drive. It was the consensus of Council that staff contact the Fire Department and report back on these discussions at the next meeting. Also responding to the Mayor's call for audience questions was Randy Iwasaka, 28075 Ella Road who requested extension of the playing time at Hesse Park for AYSO. This extension would be until 2:30 P.M. q Councilman Bacharach moved, seconded by Councilman Hinchliffe and carried to refer this item to Leisure Services Director Mary Thomas and report back at the next meeting. SOLICITATION ORDINANCE (1801) City Manager Guluzzy presented the September 3 Staff Memorandum and recommended introduction of this proposed ordinance revising regu- lations for solicitation and amending the Rancho Palos Verdes Municipal Code. 703CP /MIN.18.1 -7 -4- September 3, 1985 Council then briefly discussed whether political activity would be included in this ordinance, if the ordinance would require posting of signs at homes for bidding - solicitation, and the fact that the City would now be required to issue permits to those soliciting within the City. Councilman Hughes moved, seconded by Councilman Ryan and carried to have the City Attorney draft an ordinance that makes it a misdemeanor to solicit at homes where no solicitation signs are posted; include a provision that a solicitor must leave when told, also include restriction on hours and-some requirement for identification. VARIANCE NO. 121 - APPEAL City Manager Guluzzy presented the (1804) Staff Memorandum of September' 3 on this Variance Appeal at 30523 Cartier Drive. Staff recommended dismissal of this appeal of the Planning Commission's denial on the applicant's request for a variance to allow an illegally converted garage. Applicant Joey Schaefer, requested that the Council allow this garage and cited the fact that they have invested a considerable amount of money in converting the garage. She also said there was ample parking in the neighborhood. Motion carried. REQUEST TO. HAVE C.U.P.- -PROCESSED City Manager Guluzzy presented the PRIOR TO SPECIFIC -PLAN September 3 Staff Memorandum on (701 X 1804) this request that a conditional use permit application for a small shopping center at the corner- of Western and Crestwood he processed "in a timely fashion to the extent practicable." On June 20, 1985 the Council approved a policy regarding new com- mercial development on Western Avenue relative to the preparation of a specific plan. That policy provided that staff delay hearings on new commercial applica- tions while proceeding as rapidly as possible on preparing specific plans and, if any specific plans are not completed when application deadlines are reached, to impose -�a moratorium until the plans are done. Staff recommended reaffirmation of the Council policy. The applicant in this matter, Tom Layman, 19725 Sherman Way, Canoga Park and the applicant's attorney, Robert Ozell presented the background on this project and sited the financial impact they will experience if the C.U.P. is not processed. Council then questioned if the applicant would re- submit their plans if they did not meet these specific plans. and generally inquired about the timeframe on their application, Councilwoman Bacharach moved, seconded by Councilman Hughes and oarr_ied, to re --a_f firm the Council's policy. PALOS VERDES TRANSIT ANALYSIS - CONSULTING SERVICES (1505) City Manager Guluzzy presented the September 3 Staff Memorandum and recommended that Council consider 703CP /MIN.18.1-7 -5- September 3, -1985 the consultant evaluations made by the Transit Advisory Committee in selecting a consultant to perform a service analysis on Palos Verdes Transit, Councilwoman Bacharach moved, seconded by Councilman Hinchliffe and carried that a sub-committee of herself, Transit Advisory Committee Chairman Margaret Blue, Mayor McTaggart, and Charles Abbott review the proposals submitted. ABALONE COVE LANDSLIDE ABATEMENT City Manager Guluzzy presented the DISTRICT - APPOINTMENT OF BOARD September 3 Staff Memorandum which MEMBER (106 X 1801) recommended that Council appoint Mary D. Sheridan for a four (4) year term, Seymour Y. Warner for a four (4) year term, Harriett V. Medve, for a four (4) year term, and Steven L. King for a two (2) year term to the ACLAD Board of Directors. Councilman Hughes moved, seconded by Councilman Ryan and carried to approve the staff recommendation. KLONDIKE CANYON LANDSLIDE ABATEMENT DISTRICT - APPOINTMENT OF TWO MEMBERS (106 X 1801) City Manager Guluzzy presented the September 3 Staff Memorandum which recommended appointing' 'Charles' 'B . Hotchkiss and Bernard L. Prober t to the Klondike Canyon Geological Hazard Abatement District to a four (4) year term to expire Sep- tember, 1989, Councilman Hughes moved, seconded by Councilman Ryan to approve the staff recom- mendation. The motion carried on a 4 -0, with Councilman Hinchliffe abstaining. LANDSLIDE SUBCOMMITTEE (1801) Councilman Hinchliffe presented the report dated August 22, prepared by Robert Stone & Asso- ciates and entitled Report -on Geologic Investigation Origin 'of Canyon Along Valley View,-Road He moved, seconded by Councilman Hughes and carried to accept the report and make it public, LEGISLATION (306) Councilwoman Bacharach moved, seconded by Councilman Ryan and carried to support SB 300 and ACA 7; and oppose SCA No. 27 . 703CP /MIN.18.1 -7 -6- September 3, 1985 ITEMS REMOVED FROM THE CONSENT CALENDAR ORDINANCE N0, 194 ADJOURNMENT r CITY CLERK A brief discussion ensued regarding the contents of this ordinance and it was the consensus that a work session be held on September 17 at 6:30 P.M. to discuss the entire ordinance.
