CC MINS 19860429M I N U T E S RANCHO PALOS VE RDES CITY COUNCIL REGULAR MEETING APRIL 29, 1986 The meeting was called to order at 7:40 P.M. by Mayor Douglas Hinchliffe at the Fred Hesse Community Park Building, 29301 Hawthorne Boulevard. PRESENT: HUGHES, McTAGGART , BACHARACH , & MAYOR HINCHLIFFE ABSENT: RYAN Chairman Von Hagen called the Planning Commission to order. PRESENT: ORTOLANO , WIKE , McNULTY , HODGE & COMMISSIONER VON HAGE N Also present were City Manager Donald F. Guluzzy, Associate Planner Steve Rubin, Acting Director of Environmental Services Ann Negendank, City Clerk Jo Purcell, and Public Works Director George Wentz, WAIVER OF FULL READING OF Councilwoman Bacharach moved, sec - ORDINANCES & RESOLUTIONS onded by Councilman Hughes and car - ried, to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolu- tion. APPROVAL OF AGENDA The City Clerk announced the addi- tion of three items to the Agenda: Update on the Hesse Park the re- placement; League of California Cit- ies, and presentation by Claims Ad- justor. The Agenda was approved as amended on motion of Councilman Hughes, seconded by Councilwoman Bacharach and carried. AFFORDABLE HOUSING - GOLDEN COVE ( 701) 704CP /MIN5.1 -4 Commissioner Von Hagen gave a brief overview of the Commission's study of the issues involved in the af- fordable housing portion of the Gol- -1- April 29, 1986 den Cove Condominium Project. The Commission's major concerns centered on the criteria for eligibility to purchase these units, controls on windfall profits and resale; income criteria and hidden assets; purchase of one unit by the City; administration of the program; and owner occupancy. Council and the Commission then discussed the origin of the proposed agree- ment, if this agreement had been reviewed by the City Attorney, and the constraints that the City is faced with in determining priority groups. A good deal of the discussion focused on the levels of income that should be established as the median income for the City and the obligation of the City in meeting the State's criteria for, affordable housing. The discussion between the Council and Commission then focused on the cost to the developer in supplying these units, who would administer these units, whether these units could be willed to another, the restrictions on resale, and the length of time the City should have control over ownership. It was concluded that discussion of this matter should be continued until the May 6, 1986 meeting so it could be discussed with the benefit of coun- sel from the City Attorney, SPECIFIC PLAN N0, 3 Associate Planner Alice Angus re- viewed the staff memorandum of April 29 which gave the background on the March 6, 1986 workshop and listed the concerns expressed at that meet- ing. The Council and Commission then discussed the trade -offs in set -backs for allowing greater heights on some structures which would result in a more varied building plan, how this plan compared with the other Specific Plans, the requirement that no flat roof be allowed and that equipment could not be exposed on roofs, and architectural controls that could be imposed on building structures. (At this time the Planning Commission adjourned to May 6.) TRACT N0. 35040 - STREET LIGHTS (1411) Acting Director Negendank and Public Works Director Wentz then showed a videotape of this tract showing the proposed location of street lights for that tract. Staff requested clarification for Condition No. 27(d) of Resolution No. 80 -48, Councilwoman Bacharach moved, seconded by Councilman Hughes and carried to replace existing street lights with new lights and add lights at new inter- sections and cul -de -sacs. 704CP /MIN5.1 -4 -2- April 29, 1986 VALLEY -VIEW TRACT NO 31714 Another videotape showed the char- acteristics of the curbs and gutters and the resulting drainage problems in this development. After discussion whether the street should be slurry sealed, if a drainage system could be installed, and the status of Trail No. 6 which runs along the development, and possible encroachment onto this trail, it was the con- sensus that staff should pursue improvements in the existing roadway from the developer of this tract. REAL ESTATE TRANSACTION Acting Director Negendank summarized the law which now requires realtors at the time of sale of a home to check all building permits which have been issued for that structure. Responding to these requests requires a substantial amount of staff time and staff recommended that consideration be given to charging a fee for this service. It was the consensus of Council that staff prepare a policy recommendation on this matter. RELEASE OF RETENTION FOR The City Clerk reported that Sunset SUNSET OIL - SLURRY Oil had requested payment on their SEAL CONTRACT final invoice for this contract. (1404) The Notice of Completion has been recorded with the County Recorder's. Councilwoman Bacharach moved, seconded by Councilman McTaggart and carried to release the $25,058.76 to the Sunset Oil Company on the Slurry Seal Con- tract for Fiscal Year 1984 -85 - 1985 -860 LEAGUE OF CALIFORNIA CITIES CLAIMS PROCESS HESSE PARK TILE (1201) Councilwoman Bacharach requested Council support for her candidacy as Treasurer for the League. It was the consensus of Council to support her candidacy. It was the consensus of Council to have a representative of Carl Warren & Company make a presentation ex- plaining the claims process at the May 20 meeting. Public Works Director Wentz gave an update on the installation of the tile at Hesse Park: another subcon- tractor has been hired to replace 704CP /MIN5.1 -4 -3- April 29, 1986 the tile surrounding the Community Building. He requested Council's appro- ..val of Johansen Title Company. Councilman McTaggart so moved, seconded by Councilman Hughes and carried. PROPOSITION 51 - TV DEBATE ADJOURNMENT ATTEST: A brief discussion took place on the format for such a debate. No action was taken. At 10:30 P.M. the meeting adjourned to May 6 at 5:30 P.M. for a Joint Meeting with the Planning Commission to discuss affordable housing. Mo- tion made by Councilman Hughes.
