CC MINS 19860318M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING MARCH 18, 1986 The meeting was called to order at 7:30 P.M. by Mayor Hinchliffe at the Fred Hesse Community Park Center, 29301 Hawthorne Boulevard. Following the pledge of allegiance to the Flag, roll call was answered as follows: PRESENT: RYAN , HUGHES, BACHARACH , McTAGGART & MAYOR HINCHLIFFE ABSENT: NONE Also present were City Manager Donald F. Guluzzy, City Attorney Steve Dor- sey, Public Works Director George Wentz, and Community Services Director Tom Bandy, CEREMONIAL EVENT Mayor Pro Tem Hughes presented a Proclamation on behalf of the Commu- nity to the educational exchange students from Chiben Wakayama High School in Japan. WAIVER OF FULL READING OF Councilwoman Bacharach moved, sec - ORDINANCES & RESOLUTIONS onded by Councilman Hughes and car - ried, to waive reading in full of all ordinances and resolutions adopted at this meeting with consent to waiver of reading deemed to be given by all councilmembers after reading of the title, unless specific request was made at that time for the reading of such ordinance or resolu- tion. APPROVAL OF AGENDA An item regarding the RTD Community representation ( Bacharach) was added to the agenda. The agenda as amend- ed was approved on motion of Coun- cil man McTaggart, Hughes, seconded by Councilman Ryan and carried, 705CP /MIN8.1 -6 -1- March 18, 1986 CONSENT CALENDAR The following items were deleted from the Consent Calendar: Claim by Mr. and Mrs. George Artanous and the Soccer Field renovation. The Con - sent Calendar was approved as fol- lows on motion of Councilman Hughes, seconded by Councilman McTaggart. (2) Directed the City Clerk to file a Notice of Completion and to exonerate Contract Bond and Retention 30 days after said notice is filed if no clams are filed against contractor during this period. TRACT NO. 38848 - RELEASE OF LETTER OF CREDIT FOR SECONDARY ENTRANCE (1411) Accepted the secondary entrance landscaping and directed the City Clerk to surrender letter of Credit No. LA56688 to Wells Fargo Bank. 705CP /MIN8.1 -6 -2- March 18, 1986 RESOLUTION NO 86 -11 - AMENDING CEQA GUIDELINES (1203) RESOLUTION N0. 86 -12 - RIGHT- OF -WAY CERTIFICATIONS (1204) LEGISLATION - STORM DRAINS (306) RESOLUTION NO. 86 -13 - REGISTER OF DEMANDS MINUTES ADOPTED RESOLUTION NO. 86 -11 MEND- ING RESOLUTION N0, 85 -39 AND THE CITY'S LOCAL CEQA GUIDELINES, - ADOPTED RESOLUTION NO. 86 -12 AUTHOR- IZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE RIGHT -OF -WAY CERTIFICA- T I ONS FOR FEDERAL AID PROJECTS. Authorized the Mayor to sign a letter urging the U.S. House /Senate Conference Committee to postpone implementation of the municipal storm water portion (HR8 and S1128) of the Clean Water Act for two years. ADOPTED RESOLUTION N0. 86 -13 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. Approved the minutes of February 25. PUBLIC HEARING TRACT Mayor Hinchli f f e opened the public N0: 37885 - REVISION hearing; City Manager Guluzzy re- ported that notice of the hearing had been published. Associate Planner Steve Rubin presented the staff report of March 18 on this request to revise the lot configuration on this 47 lot residential planned development. Staff recommended approval of the revision. Council inquired about the recommendation to add street lighting, the fact that maintenance of the horse trails was incumbent upon the homeowners, and the effect, if any, this revision might have on the habitat of the blue butterfly. Representing the applicant in this matter was Mark Sikand, 15 230 Burbank Boulevard, Van Nuys, who explained the geological conditions and street design which prompted this request for a revision. Also testifying about this tract were Ralph Ortolano, Jr., 3776 Coolheights Drive. His comments centered on the access to the open space area adjacent to this tract, and if a conservatory would be one way of maintaining public control of these 100 plus acres of open space hazard area. 705CP /MIN8.1 -6 -3- March 18, 1986 Speaking in opposition to this tract were Jan Smit , 3855 Pirate; P. Stehe- jim, 32215 Searaven, Max Thomas, 3849 Pirate, and Sunshine, 6 Limetree. Their concerns were about the vibrations resulting from trucks used during the construction phase, the continuing problem of illegal dumping in that area, and the maintenance of the equestrian trails in the area. There being no response to the Mayor's call for additional public testi- mony, he closed the public hearing. Council then discussed the buttress fill issue, whether there should be s teet lights, and if a grading problem existed in the area, Councilwoman Bacharach moved, seconded by Councilman Ryan and carried to deny this re- quest to revise the tentative tract map. RECESS At 9:07 P.M. the Mayor declared a recess. The meeting reconvened at 9:20 P.M. ORDINANCE NO. 204 - City Manager Guluzzy reviewed UTILITY USERS TAX staff's research in determining the (1501) revenue necessary to cover the pro- jected shortfalls and the proposed Capital Improvement Projects total- ing an estimated $17 million. He recommended that Council consider adopting an 8% Utility User Tax, and preparation of a policy for use of this revenue. Council discussed if this tax would be assessed on billing from the various long- distance service companies, the cost increase as a result delaying street maintenance, if the utility tax ordinance should be placed on the November ballot, whether a 5% tax would be sufficient, the formation of a committee to study the need for a parcel tax. Councilwoman Bacharach moved, seconded by Counciman Hughes to Introduce Ordinance No. 204 for a 7% utility tax. Councilman Ryan moved an amendment, seconded by Councilman McTaggart to impose a 5% tax instead of a 7% tax. The amendment carried on the following roll call vote: AYES: RYAN, McTAGGART , AND MAYOR HINCHLIFFE NOES: HUGHES AND BACHARACH The main motion to introduce a utility user tax was adopted on the fol- lowing roll call vote: AYES: RYAN, BACHARACH, McTAGGART, AND MAYOR HINCHLIFFE NOES: HUGHES Mayor Hinchliffe appointed Councilmembers McTaggart and Hughes to act as a subcommittee to develop a charter for a citizen's advisory committee on the issue of the parcel tax. It was the general consensus that staff should prepare a policy statement for the April 1st meeting on the use of revenue from the utility user tax. 705CP/MIN8 . 1-6 -4- March 18, 1986 Speaking in opposition to the tax was Barry Hildebrand, Vigiland Drive. It was the consensus of Council that - staff should report back at a later meeting on the work involved in determining the number of parcels within the City. PEDESTRIAN TRAIL ON CREST City Manager Guluzzy presented the ROAD - TRACT NO. 29524 March 18 staff memorandum which rec- (450 X 701) ommended that he be authorized to work with the property owner to establish a formal pedestrian ac- cess. Acting Director Negendank explained where the easements and setbacks were located on the lot. Speaking in favor of maintaining this easement for pedestrian access were Mike and Don McLaughlin, 6966 Crest Road, who cited the use of this ease- ment by students. Representing homeowners in the area was their attorney Robert Welbourn, 2211 West Torrance Boulevard, Torrance, who cited the use of the path by motorcyclists in providing access to Palos Verdes Estates. The owner of the lot, Jacob Friend, 7071 Crest Road, said he purchased the lot in 1972, and that over the years he has placed "No Trespassing" signs in the area. He was concerned about liability and lack of use by people other than motorcyclists. Also objecting to the easement were the follow- ing residents: Rudy Meyler, 2724 Via Victoria, Palos Verdes Estates, Jane Torevich, 7051 Crest Road, and Gwen Friend, 7071 Crest Road. Their con- cerns focused on loss of privacy. After discussion, Councilwoman Bacharach moved, seconded by Councilman Hughes to have the City Manager work with the property owner on this matter in establishing an appropriate walkway, to contact the Monte Verde Home- owners Association about this issue, and to request a letter from the City of Palos Verdes Estates stating what they intend to do about this walkway. CITY COUNCIL REPORTS Heat Detector Ordinance: Councilman McTaggart reported that the subcommit- tee has not yet had a meeting to discuss this ordinance. He suggested that the time for compliance with this ordinance be extended. RTD COMMUNITY REPRESENTATIVE Commenting that the local RTD repre- (1505 ) sentative was being transferred out of the area, Councilwoman Bacharach moved that a letter be sent to Board Member Gordona Swanson, RTD Manager Jack Dyer, and RTD Board President Jan Hill requesting that they retain Sandy Learman in this area. The motion was seconded by Councilman McTag- gart and carried, 705CP /MIN8.1 -6 -5- March 18 , 1986 PURCHASE OF TIMER In an effort to keep all speakers within the five minute time limit, Councilwoman Bacharach moved, sec- onded by Councilman Ryan that a timer be purchased for use at City Council meetings. ITEMS REMOVED FROM THE CONSENT CALENDAR CLAIM AGAINST THE CITY BY MR. Commenting on the inherent dangers AND MRS. GEORGE ARTANOUS in using skateboards, and the fact (303) that this claim is for injury sus- tained in a skateboarding accident, Councilman Ryan requested that an article about the dangers of skate- boarding be published in the City's NEWSLETTER. He then moved , seconded by Councilwoman Bacharach to reject this claim and instructed the City Clerk to notify the claimant. SOCCER FIELD RENOVATION After clarification of the mainte- (1201) nance problem experienced with the turf on the soccer fields, it was the consensus that this item be brought back at a later meeting. RECESS TO CLOSED SESSION At 1:25 A.M. the meeting recessed to AND RECONVENE a closed session.
