FEBRUARY 18, 1986
The meeting was called to order at 7:30 P.M. by Mayor Hinchliffe at the
Fred Hesse Community Park Center, 29301 Hawthorne Boulevard. Following the
pledge of allegiance to the Flag, roll call was answered as follows:

REVENUE RAISING - UTILITY
USERS TAX (15 04 )
City Manager Gulu zzy reviewed the
report outlining the revenue and op-
erating needs and capital require-
ments of the City. He went on to
explain the revenue limitations

imposed on the City through the Gann Initiative, the reduction of revenues
from both the State and Federal governments, and the effects of statewide
initiatives now being currently circulated. Contained in his report were
explanations of possible funding sources: Utility Users Tax, Business
License Tax, Admission Tax, Refuse Franchise Tax, and Parcel "Special"
Tax,
Expressing their views on the implementation of a utility users tax were
the following residents: Franklyn Weiss, representing the Rancho Palos
Verdes Homeowners Council; Melinda Downing, 1914 Caddington Drive;
Richard Mahoney, 26736 Menominee Place; Margaret Flynn, Vallon Drive;
Patrick M. Flaherty, 2160 Dorada Drive; Don Huseman, 2778 Calle Aventura;
Laura Lee Lukas, 26727 Shorewood Drive; and James W. Hatch, 15 Mustang
Road. These residents inquired if they would vote on this tax, whether
this tax would be on the basic service, and how these funds would be spent.
Mayor Hinchliffe explained that an extensive article explaining the utility
tax would appear in the next issue of the NEWSLETTER.
RECESS AND RECONVENE At 9:10 P.M. the Mayor declared a
recess. At 9:30 P.M. the meeting
reconvened.
DISCUSSION OF PROPOSED UTILITY During Council discussion of this
USERS TAX proposed tax, it was the consensus
that the City Attorney should inves-
tigate the tax exempt status of the
parcel tax imposed by other cities,
that the City Manager should get a
quote -from a Big Eight accounting firm on the preparation of an opinion on
the tax exemption of such a tax, and that staff should make preparations
for a presentation at the March 4 public hearing showing the City's needs
and revenue sources. Additionally, Council requested that the most recent
budget be made available at the libraries.
During discussion of the proposed ordinance, it was agreed that exemptions
should be granted for only two years, and it should contain a five year
"sunset" clause with annual review by the City Council. Council- members
Hughes moved, seconded by Mayor Hinchliffe and carried to set a public
hearing for this matter on March 4, 1986.
VARIANCE NO. 111 City Manager Guluzzy summarized the
( 1804) February 18, 1986 memo which recom-
mended that this matter be set for a
public hearing on March 18, 19860
Assistant Planner Steve Rubin explained the rationale in setting this mat-
ter for a public hearing. According to the provisions of the Municipal
Code, Council has the option to set this matter for a public hearing, or if
no new evidence is presented, Council can deny the appeal.

Council then discussed the provisions of the Code and whether it was ne-
cessary to hold a public hearing on this matter. Councilwoman Bacharach
moved, seconded by Councilman Ryan to table this matter for two weeks so
Council can receive the staff report and then make the decision whether to
affirm the Planning Commission's decision or hold a public hearing The
motion carried on a three - two vote with Councilmen Hughes and McTaggart
voting in opposition.
RESOLUTION NO. 86 -8 AMENDING
DEVELOPMENT CODE FEES (1203 )
City Manager Gulu zzy presented the
February 18 staff report and recom-
mended adoption of this proposed
resolution revising the Planning
Application Fee Schedule,
Assistant Planner Rubin further explained these revisions and the justifi-
cations for increasing these fees.
A brief discussion took place on the existing policy of refunding the fee
on successful appeals.
RESOLUTION NO. 86 -8 OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
AMENDING THE FEES TO BE CHARGED UNDER THE DEVELOPMENT CODE was read by
title and ADOPTED under motion of Councilman Ryan, seconded by Councilman
Hughes. The motion carried on a three - two vote with Councilmembers Bach -
arach and McTaggart voting in opposition.
PALOS VE RDES TRANSIT - City Manager, Gulu zzy presented the
PREPAYMENT SYSTEM February 18 memorandum recommending
(1505) approval of the Transit Committee's
recommendation to institute a pre-
paid fare program for Palos Verdes
Transit patrons.
Representing the Transit Committee was Arvid Von Nordenflycth who briefed
the Council on the Committee's discussion of the various methods considered
by them for implementing such a prepaid program.
After discussion of whether there should be a surcharge for "walk -ins" re-
questing these prepaid tickets versus mail -in requests, and the fact that
these tickets should be made available to Rolling Hills Estates and Palos
Verdes Estates on a pre -paid basis, Councilman McTaggart moved, seconded
by Councilman Ryan to approve the Committee's recommendation with the ad-
dition that the City pay the start -up costs of $1,808 out of Proposi-
tion "A" funds and that a surcharge of $1 be added to each transaction.

PALOS VE RDE S TRANSIT "NO SHOW'/
CANCELLATION POLICY

City Manager Gulu zzy presented the
February 18 staff report recommend-
ing Council' adoption of the Commit-
tee's recommendation that after the
first "no- show" a passenger would
receive a warning letter, after the
second "no- show" the passenger would
be required to pay for two trips.
Representing the Committee was its Chairman Arvid Von Nordenflycth who re-
lated the Committee's discussion of the "no- show" problem faced by the Pal-
os Verdes Transit,
After Council discussion of various suggestions on how to manage this "no-
show" policy with subscription users versus casual users, Councilwoman
Bacharach moved, seconded by Councilman Ryan and carried to adopt the Com-
mittee's recommendation with the modification that the occasional user re-
ceive a warning letter for the first "no- show" and for the second "no-
show" that they pay double. This is to be repeated each time there is a
"no- show"
City Council Subcommittee Reports
Public Safety - Councilman Hughes reported that the subcommittee met with
representatives of the Fire Department to discuss.the Smoke and Heat Detec-
tor ordinance. The Fire Department is gathering additional information and
another meeting will be held when all of the data has been collected.
Post Office - Councilman McTaggart reported on the subcommittee's meeting
with Congressman Lungren where it was disclosed that the Post Office is no
longer interested in acquiring the School District Building. However, the
Post Office still needs facilities to adequately meet their needs. He pro-
posed a meeting with representatives of the other Peninsula cities and Lo-
mita to discuss those needs. He also briefly reported on the Navy's reduc-
tion in claims for off -shore drilling.
CITY MANAGER REPORTS Status of Council Directive - After
a brief discussion of the status of
the Western Avenue annexation, the
consensus was that we should seek
special legislation from Senator
Beverly and Assemblyman Felando to
facilitate this annexation.
